CHAPTER XVII

ABANDONED VEHICLES

§ 17.01 Automobile, boat, or other vehicle repair and placement of abandoned or junked vehicles on private or public property.

The following shall not be permitted in Zones A, C, D, or on nonautomobile, boat or other vehicle repair business premises in Zone B:
(a) 
Repair or rebuilding of automobiles, boats or other vehicles for compensation.
(b) 
Placement of abandoned or junked vehicles, automobiles, boats or other vehicle on private or public property.
(c) 
Repair or rebuilding of automobiles, boats or other vehicles on city streets, in such a way as to present safety hazards, nuisances or unsightly displays.
In Zone B, automobile, boat or other vehicle repair or storage is permitted only in business licensed by the City of El Lago to repair and to overhaul automobiles, boats and other vehicles.

§ 17.02 Repair and rebuilding automobiles, boats or other vehicles for compensation.

No premises within El Lago shall be used by a resident or nonresident of El Lago to repair, remodel or rebuild automobiles, boats, or other vehicles for any kind of compensation, fee or wage unless a specific permit has been issued for a repair business in Zone B, Commercial, for the premise being used for the repair, remodeling or rebuilding.

§ 17.03 Abandonment of automobiles, boats or other vehicles.

No automobile, boat or other vehicle shall be abandoned, as that term is defined in Chapter 9, Article V, of this Code, on private or public property.

§ 17.04 Junked vehicles.

The city may cause the removal of junked vehicles or a part of a junked vehicle from private property, public property or public rights-of-way in accordance with Chapter 9, Article V, of this Code.

§ 17.05 Vehicle repair on city streets.

Only emergency repair, emergency refueling, restarting, tire changing or towing procedures, which permit movement of the automobile shall be performed on city streets. No engine repair, replacement of parts, adjustments, body repair or painting shall be permitted on the city streets.

§ 17.06 Creation of safety hazards, nuisances or unsightly displays while repairing or rebuilding vehicles in driveways.

No vehicle repair shall be permitted in front or side yards of premises within Zones A or C.
Repair work performed in driveways or side yards shall be performed in such a way as to preserve the attractiveness of the community and provide for the safety, health and welfare of the citizens of El Lago.
No fuels, solvents, petroleum products, paints, chemicals, tools, or parts shall be placed on driveways or yards in areas or places where they are unattended or where adults or children could willfully or accidentally be injured by any of these substances, parts or tools. Flammables or fuels shall be placed so that no fire hazard exists either from storage or from inadvertent spillage. Engine oils, gasoline, other petroleum products or caustic or toxic substances shall not be disposed of in storm drains.
Vehicles or heavy parts shall not be left on mechanical or hydraulic jacks or lifts when unattended.
When under repair in driveways, vehicles shall have doors, hoods and trunks closed except when the automobile is attended and has active repair work in progress. The repair site, vehicle and driveway shall be maintained in an orderly condition with tools and parts retained within ten (10) feet of the vehicle under repair. When active repair work is not in process, tools and parts shall be stored in back yards or garages. Chemically treating vehicle bodies or parts, steaming engines or applying undercoatings are all prohibited in driveways.
Repair activity is prohibited after 10:00 p.m. and before 7:00 a.m. each day.

§ 17.07 Repair of vehicles on El Lago premises not registered to El Lago addresses.

Repair of vehicles on El Lago premises, which belong to individuals not residing temporarily or permanently on the premises where repair is accomplished and which extends for more than seventy-two (72) hours, is prohibited.
