165.13 C-1

CENTRAL COMMERCIAL DISTRICT.

   1.   Purpose. The C-1 (Central Commercial) District is designed to accommodate the needs of the Central Business District, allowing a wide range of services and goods permitted for consumer daily and occasional shopping and service needs.
   2.   Permitted Uses. Principal permitted uses in the C-1 District are as follows:
      A.   Any use permitted in the R-3 District except multiple-family dwellings and mobile home parks.
      B.   Auto parts stores.
      C.   Bakeries and others whose products are sold only on the premises.
      D.   Barber and beauty shops.
      E.   Banks and other financial institutions.
      F.   Business, professional offices, and governmental offices.
      G.   Clothing stores.
      H.   Florist and gift shops.
      I.   Hardware stores.
      J.   Jewelry stores.
      K.   Medical and dental clinics.
      L.   Pharmacy.
      M.   Public buildings, playgrounds, community buildings, public parks.
      N.   Public utilities.
      O.   Restaurants.
      P.   Television and appliance repair and sales.
      Q.   Video/movie film and equipment rental.
      R.   Accessory uses and buildings which are customarily incidental to the above stated uses and including temporary buildings used in conjunction with construction work, provided such buildings are removed promptly upon completion of the construction work.
      S.   Churches.
      T.   Carpenter shops (subject to Subsection W(1) of this section). Carpenter shops means businesses engaged in building or repairing wooden items for consumer, residential, or commercial customers.
      U.   Electrical, plumbing, and heating shops (subject to Subsection W(1) of this section). Electrical, plumbing and heating shops means businesses engaged in fabrication, repair, and sales of residential or commercial electrical and/or HVAC systems or components.
      V.   Small engine repair shops (subject to Subsection W(1) of this section). Small engine repair shops means businesses engaged in the maintenance, repair, overhaul, and sales of repair parts for small gasoline engines used in yard and garden equipment.
      W.   Used car lots (Limited) (subject to Subsections (1) and (2) below). Used car lots means businesses engaged in sales and/or trade of automobiles and trucks with a maximum 10,000 pound GVWR, and limited to 20 vehicles displayed on lot.
         (1)   Provision 1. Front parking area shall be used for licensed motor vehicles only, and consist of concrete or asphalt paving. Front parking area shall not cause water runoff to negatively impact adjacent properties. Items stored in any rear yard shall be concealed from view of all adjacent properties, using solid fence of at least six feet in height (subject to provisions of Section 165.08(6) of this chapter).
         (2)   Provision 2. Front parking area (display lot) shall allow a minimum of 180 square feet per vehicle displayed. No more than 20 vehicles shall be displayed as ‘For Sale.’ Only vehicles that are fully-functional and legal for operation on public roads shall be allowed on display lot. Any inoperable vehicles (or parts thereof) shall only be allowed within building or fenced rear yard.
   3.   Permitted Accessory Uses. Permitted accessory uses in the C-1 District deemed to be of the same general character as the foregoing permitted uses, but not including any use that may become obnoxious or offensive, are as follows:
      A.   Apartment above first story level of a store or shop with off-street/on-site parking.
      B.   Grocery/convenience stores which may include gasoline sales.
   4.   Height Regulations. Height regulations in the C-1 Central Commercial District are as follows:
      A.   Principal uses: two stories or 35 feet, whichever is lower;
      B.   Accessory uses: one story or 18 feet, whichever is lower;
      C.   Exterior or roof sign: exterior or roof signs shall not exceed 16 feet above the roof line.
   5.   Area Regulations. The minimum regulations that shall be observed in the C-1 District are set out in Table 165.13.

Accessory Buildings
All accessory buildings shall not project the front building line of the principal building if the principal building setback line is increased.
