1. Districts Established. For the purpose and intent of this chapter, the incorporated area of the City is divided into seven classes of districts. The use, height, and area regulations are uniform in each class of district. The districts shall be known as:
A. A (Agricultural) District
B. R-1 (Residential) District
C. R-2 (Residential) District
D. R-3 (Multiple Residential) District
E. C-1 (Central Commercial) District
F. C-2 (Outlying Commercial) District
G. I (Industrial) District
2. Boundaries and Official Map.
A. The boundaries of these districts are indicated upon the Official Zoning Map of the City, which, with all notations, designations, references, and other matters shown thereon, shall be as much a part of this chapter as if fully described and set forth in this chapter. (See Editor’s Note at the end of this section.) The Official Zoning Map shall be posted in the public office of the City Hall.
B. If, in accordance with the provisions of this chapter, changes are made in the district boundaries or other matters portrayed on the Official Zoning Map, the resolution number and date of such change shall be recorded by the City Clerk on the Official Zoning Map and in the Editor’s Note at the end of this section.
C. In the event that the Official Zoning Map becomes damaged, destroyed, lost, or difficult to interpret because of the nature or number of changes and additions, the City Council, by resolution, shall adopt a new Official Zoning Map which shall supersede the prior Official Zoning Map. The new Official Zoning Map may correct drafting or other errors or omissions in the prior Official Zoning Map, but no such correction shall have the effect of amending the original Zoning Ordinance or any subsequent amendment thereof.
3. Zoning Map Adopted. The ordinance codified in this chapter adopts the proposed digital Official Zoning Map, including paper copy, as the Official Elk Run Heights Zoning Map.
4. Interpretation of District Boundaries. Where uncertainty exists with respect to the boundaries of the various districts as shown on the Official Zoning Map accompanying the ordinance codified in this chapter and made a part of this chapter, the following rules shall apply:
A. Boundaries indicated as approximately following the centerlines of streets, highways, alleys, or other public rights-of-way shall be construed to follow such centerlines; upon the vacation of the public right-of-way, the boundaries shall be interpreted as following the condition of the former right-of-way.
B. Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.
C. Boundaries indicated as approximately following City limits shall be construed as following City limits.
D. Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.
E. Boundaries indicated as following shorelines shall be construed to follow such shorelines, and in the event of change in the shoreline shall be construed as moving with the actual shoreline; boundaries indicated as approximately following the centerline of stream, river, or other bodies of water shall be construed to follow such centerline.
F. Boundaries not capable of being determined in the previous subsections shall be as dimensioned on the Official Zoning Map or, if not dimensioned, shall be determined by the scale shown on the Map.
