165.15 I

INDUSTRIAL DISTRICT.

   1.   Purpose. The I (Industrial) District is designed to provide for areas of industry which will be compatible with community needs and which will impact upon public services and utilities and surrounding property.
   2.   Permitted Uses. Principal permitted uses in the I District are as follows:
      A.   Any use in the C District; provided, that no structure shall be used for any dwelling, school, hospital, clinic, or other institution for human care, except where incidental and necessary to a permitted principal use.
      B.   Farm implement establishment for the display, sale, hire, and repair of such vehicles, including new and used sales lots.
      C.   Bakeries, other than those whose products are sold at retail only on the premises.
      D.   Carting, express, hauling, or storage.
      E.   Circus, carnival, or similar transient enterprise; provided such structures or buildings shall be at least 200 feet from any R District.
      F.   Concrete mixing, concrete products manufacture, and asphalt plant.
      G.   Contractors’ equipment storage yard or plant, or rental of equipment commonly used by contractors; storage and sale of livestock, feed, and/or fuel, provided dust is effectively controlled; and storage yards for vehicles of a delivery or draying service.
      H.   Creamery, cheese processing, bottling works, wholesale ice cream manufacturing, ice manufacturing, and cold storage plant.
      I.   Enameling, lacquering, or varnishing.
      J.   Foundry casting lightweight nonferrous metals, or electric foundry not causing noxious fumes or odors.
      K.   Laboratories; experimental, film, or testing.
      L.   Livery stable or riding academy.
      M.   Manufacture of musical instruments and novelties.
      N.   Lumber yards and building material sales yard.
      O.   Manufacture or assembly of electrical appliances, instruments, and devices.
      P.   Manufacture of pottery or other similar ceramic products, using only previously pulverized clay or kilns.
      Q.   Manufacture and repair of electric signs, advertising structures, sheet metal products, including heating and ventilating equipment.
      R.   Sawmill, planing mill, including manufacture of wood products, not involving chemical treatment.
      S.   Storage and warehouse businesses, but· not including any manufacturing or fabricating.
      T.   The manufacturing, compounding, processing, packaging, or treatment of cosmetics, pharmaceuticals, and food products.
      U.   The manufacture, compounding, assembling, or treatment of articles or merchandise from previously prepared materials such as bone, cloth, cork, fiber, leather, paper, plastics, metals, or stones, tobacco, wax, yarns, and wood.
      V.   Paint ball field and paint ball facility, which are designated for the supervised recreational use of paint ball guns and for the purpose of supervised paint ball activities, both indoor and outdoor.
   3.   Conditional uses.
      A.   The following uses may be permitted in the I District, subject to approval of the City Council after notice and public hearing and report from the Planning and Zoning Commission. In its determination upon a particular use at the location requested, the Council shall consider all of the following conditions:
         (1)   That the proposed location, design, construction, and operation of the particular use adequately safeguards the health, safety, and general welfare of persons residing or working in adjoining or surrounding property.
         (2)   That such use shall not impair an adequate supply of light and air to surrounding property.
         (3)   That such use shall not unduly increase congestion in the streets or public danger of fire and safety.
         (4)   That such use shall not diminish or impair established property values in adjoining or surrounding property.
         (5)   That such use shall be in accord with the intent, purpose, and spirit of this chapter and the land use policies of the City.
         (6)   That the best practical means known for the disposal of refuse matter or water carried waste, the abatement of obnoxious or offensive odor, dust. smoke, gas, noise, or similar nuisance, shall be employed.
         (7)   That all principal buildings and all accessory buildings to structures, including loading and unloading facilities, shall be located at least 200 feet from any R District and not less than 100 feet from any other district.
      B.   The uses subject to the provisions of Subsection A of this section are as follows:
         (1)   Agricultural seeding processing, storage, and sales.
         (2)   Recycling center to include wood waste or reusable lumber, asphalt, concrete, plastic, cardboard/paper, and metal, where the premises upon which such activities are conducted are wholly enclosed within a building with a roof. Recycling should not be construed to include waste or used tires.
   4.   Height regulations. There are no height regulations in the I District.
   5.   Area regulations. The minimum regulations that shall be observed in the I District are set out in Table 165.15.

1For every additional foot the front yard depth is increased over 25 feet, the rear yard may be decreased in direct proportion thereto, but, in no case shall the rear yard be less than eight feet; and, in addition, if any portion of this rear yard is used for an enclosed off-street loading space, the area above such an enclosure may be used for building purposes.
