Certain commonly used words and terms have a particular meaning when used in relation to zoning and land use. Wherever they occur in this Title, the following words, terms and phrases, and their derivations, shall have the meanings given in this Section.
ACCESSORY BUILDING OR USE: One which:
(A) 1. Is subordinate to and serves a principal building or principal use;
2. Is subordinate in area, extent or purpose to the principal building or principal use served;
3. Contributes to the comfort, convenience or necessity of occupants of the principal building or principal use served; and
4. Is located on the same zoning lot as the principal building or principal use served, with the single exception of such accessory off-street parking facilities as are permitted to locate elsewhere than on the same zoning lot with the building or use served.
(B) An "accessory use" includes, but is not limited to, the following:
1. A children's playhouse, garden house or private greenhouse;
2. A shed, garage or building for domestic storage;
3. Private swimming pools, for use by the occupant and his guests;
4. Storage of merchandise normally carried in stock on the same lot with any retail service or business use, unless such storage is excluded by the zoning district's regulations;
5. Storage of goods used in or produced by manufacturing activities on the same lot or parcel of ground with such activities, unless such storage is excluded by the zoning district's regulations;
6. Off-street motor vehicle parking areas, and loading and unloading facilities;
7. Signs as regulated and permitted in each zoning district;
9. Outdoor parking and storage of recreational vehicles or boat trailers on lots or parcels of land zoned and/or used exclusively for single-family detached dwelling purposes.
ALLEY: A public right of way, usually not more than thirty feet (30') wide, which normally affords a secondary means of access to abutting property.
ALTERATION: Any change in size, shape, character, occupancy or use of a building or structure.
ANIMAL HOSPITAL: Any building, or portion thereof, designed or used for the care, observation or treatment of domestic animals.
AUDITORIUM: A room, hall or building, part of a church, theater, school, recreation building or buildings, or any freestanding building, designed or used for the gathering of people as an audience to hear lectures, plays or other presentations.
AUTOMOBILE AND TRAILER SALES AREA: An open area, other than a street, used for the display or sale of new or used motor vehicles or trailers, and where no repair work is done except for minor automobile repair of motor vehicles or trailers to be displayed and sold on the premises.
AUTOMOBILE LAUNDRY (Car Wash): A building or portion thereof used for washing automobiles, using a chain conveyor, blower, steam cleaning device or other mechanical devices.
AUTOMOBILE REPAIR, MAJOR: Means a) engine rebuilding or reconditioning of worn or damaged motor vehicles or trailers; or b) collision service, including body, frame, or fender straightening or repair; or c) painting of vehicles.
AUTOMOBILE REPAIR, MINOR: Incidental repairs, replacement of parts and motor service to automobiles, but not including any operation or service specified as "automobile repair, major" above.
AUTOMOBILE SERVICE STATION: A place where gasoline, stored only in underground tanks, kerosene, lubricating oil or grease, are dispensed or offered for sale at retail for the operation of automobiles, and where tires, batteries and similar automobile accessories may be offered for sale on the premises at retail. An "automobile service station" may include "minor automobile repair", and installations customarily incidental thereto, and facilities other than an automobile laundry, for washing cars, only if enclosed in a building. "Automobile service station" does not include "open sale lots" as defined herein or the sale or storage of new or used automobiles, trucks or trailers. Automobile service stations may not provide major automobile repair.
AUTOMOBILE WRECKING YARD: Any place where two (2) or more motor vehicles, not in running condition, or parts thereof, are stored in the open and are not being restored to operation; or any land, building or structure used for wrecking or storing of such motor vehicles or parts thereof, stored in the open and not being restored to operating condition and including the commercial salvaging of any other goods, articles or merchandise.
AWNING: A rooflike projection from the wall of a building, that is retractable in operation and is covered with flexible material.
BASEMENT: A portion of a building partly or wholly under ground. Where more than one-half (1/2) of its floor-to-ceiling height is above the established curb level or above the average level of the adjoining ground where the curb level has not been established, a basement shall be counted as a story for purposes of height measurement.
BILLBOARD: Any structure or portion thereof upon which are signs or advertisements used as an outdoor display. This definition does not include signs or bulletin boards used to announce church services or to display court or other public office notices, or signs offering the sale or lease of the premises on which the sign is located.
BLOCK: A tract of land bounded by streets or by a street or streets and any combination of boundary lines of public or institutionally owned lands, railroad rights of way, rivers and lakes, Municipal corporate boundaries and other lines of demarcation.
BOARDING HOUSE: See definition of Lodging House.
BOUNDARY LINE: A line on the Zoning District Map designating the edge of a use district. Such a boundary line may be a boundary line for two (2) use districts depending on the particular use district located on each side of said line.
BUILDABLE AREA: The space remaining on a zoning lot after the minimum open space and setback requirements have been complied with.
BUILDING: A structure built for the support, enclosure, shelter or protection of persons, animals, chattels or movable property of any kind, and which is permanently affixed to the land.
BUILDING, ACCESSORY: A subordinate building or portion of a principal building, the use of which is incidental to that of the principal building and is customary in connection with that use.
BUILDING, COMPLETELY ENCLOSED: A building separated on all sides from the adjacent open space, or from other buildings or other structures, by a permanent roof and by exterior walls or party walls, pierced only by windows and normal entrance or exit doors.
BUILDING, DETACHED: A building surrounded by open space on the same lot.
BUILDING HEIGHT: The vertical distance from the curb level to the highest point of the under side of the ceiling beams in the case of a flat roof; to the deck line of a mansard roof; and to the mean level of the under side of the rafters between the eaves and the ridge of a gable, hop or gambrel roof. Chimneys, spires, towers, elevator penthouses, tanks and similar projections other than signs shall not be included in calculating the height.
BUILDING, PRINCIPAL: A nonaccessory building in which the principal use of the zoning lot on which it is located, is conducted.
BUILDING, RESIDENTIAL: A building which is arranged, designed, used or intended to be used for residential occupancy by one or more families or lodgers and which includes, but is not limited to, the following types: a) single-family detached dwellings; b) two-family dwellings; c) single-family or two-family attached and semi-detached dwellings developed initially under single ownership or unified control; and d) multiple family dwellings.
BUILDING, TEMPORARY: Any building not designed to be permanently located in the place where it is or where it is intended to be placed or affixed.
BULK: The term used to indicate the size and setbacks of buildings or structures and the location of same with respect to one another, and includes the following: a) size and height of buildings; b) location of exterior walls at all levels in relation to lot line, streets or to other buildings; c) floor area ratio; d) all open spaces allocated to buildings; e) amount of lot area provided per dwelling unit; and f) required parking areas.
BUSINESS: An occupation, employment or enterprise which occupies time, attention, labor and materials, or wherein merchandise is exhibited or sold, or where services are offered.
CLINIC, MEDICAL OR DENTAL: An establishment where two (2) or more doctors, licensed to practice medicine or dentistry, engage in such practice, operating on a group or individual basis, with pooled facilities, such as coordinated x-ray and allied departments, for the diagnosis and treatment of humans, and which may include a drug prescription counter (not a drug store) for the dispensing of drugs and pharmaceutical products to the patients of the clinic. A medical or dental clinic may also be referred to as a medical, health or dental center.
CLUB OR LODGE, PRIVATE: A nonprofit association of persons who are bona fide members paying annual dues, which meets the following requirements:
(A) Owns, hires or leases a building or portion thereof, the use of such premises being restricted to members and their guests; and
(B) Has its management and affairs conducted by a board of directors, executive committee or similar body chosen by the members at an annual meeting.
Food and meals may be served to members and their guests on the association's premises; provided, that adequate dining room space and kitchen facilities are available. The sale of alcoholic beverages to members and their guests shall not be allowed unless it is secondary and incidental to the promotion of some other common objective of the organization and unless such sale is in compliance with all applicable Federal and State laws and with all applicable provisions of the Village Code.
COMMUNITY RESIDENCE: See definition of Group Home.
CURB LEVEL: The level of the established curb in front of a building measured at the entrance of the front of the building. (Where no curb level has been established, the pavement elevation at the street center line similarly measured, or the mean elevation of the finished lot grade immediately adjacent to a building shall be considered the "curb level".)
DAY CARE CENTER OR DAY NURSERY: A building or part thereof used to provide daytime care of three (3) or more pre-school age children, for compensation.
DISABILITY: A physical or mental impairment which substantially limits one or more of a person's major life activities, impairs their ability to live independently, or a record of having such impairment, or being regarded as having such an impairment. The current use of, or addiction to, alcohol or a controlled substance is not a disability.
DISTRICT: A portion of the incorporated territory of the Village within which certain uniform regulations and requirements, or various combinations thereof, apply under the provisions of this Title.
DRIVE-IN ESTABLISHMENT: One which accommodates on the lot its patrons' automobiles, from which the occupants may watch, purchase, etc.
DWELLING: A permanent building, or portion thereof, designed or used exclusively for residential occupancy, including single-family dwellings, two-family dwellings and multiple- family dwellings. The term does not include hotels, motels or boarding or lodging houses; or automobile house trailers or mobile homes.
DWELLING, DETACHED: A dwelling which is entirely surrounded by open space on the same zoning lot.
DWELLING UNIT: One or more rooms which are arranged, designed or used as living quarters for one family, or for a group home, as a single housekeeping unit. A "dwelling unit" shall include permanently installed bathroom and kitchen facilities in addition to sleeping and living areas.
ELECTRIC DISTRIBUTION CENTER: A terminal at which electric energy is received from the transmission system and from which it is delivered to the distribution system only.
ELECTRIC SUBSTATION: A terminal at which electric energy is received from the transmission system and is delivered to other elements of the transmission system and, generally, to the local distribution system.
ESTABLISHMENT, BUSINESS: A place of business carrying on operations, the ownership and management of which are separate and distinct from those of any other place of business located on the same zoning lot.
FAMILY: (A) Either one or more persons related by blood, adoption or marriage, living and cooking together as a single housekeeping unit, exclusive of household servants.
(B) Or not more than two (2) adult persons living and cooking together as a single housekeeping unit though not related by blood, adoption, or marriage.
FLOOR AREA, GROSS: For determining the floor area ratio, "gross floor area" means the sum of the gross horizontal areas of the several floors of the building measured from the exterior faces of the exterior walls or from the center line of walls separating two (2) buildings. As used in this context, the "floor area of a building" shall include: the basement floor area which at least one-half (1/2) of the basement height is above the established curb level; elevator shafts; stairwells at each floor; floor space used for mechanical equipment, except equipment, open or enclosed, located on the roof; penthouses; attic space having headroom of seven feet ten inches (7'10") or more; interior balconies and mezzanines; enclosed porches; and floor area devoted to accessory uses; but shall not include floor area devoted to off-street parking or loading.
For structures devoted to bulk storage of materials, including, but not limited to, grain elevators and petroleum storage tanks, the "gross floor area" shall be determined on the basis of the height of such structure in feet, with each ten feet (10') in height considered to be equal to one floor. If the remaining portion of a structure measures more than five feet (5') over full floor equivalents, that remainder shall be considered as an additional floor.
FLOOR AREA OF A BUILDING: For determining off-street parking and loading requirements, "floor area of a building" means the sum of the gross horizontal areas of the several floors of the building, or portion thereof, devoted to a specific use, including: accessory storage areas located within selling or working space such as counters, racks or closets; and any basement floor area devoted to retailing activities, to the production or processing of goods, or to business or professional offices. For purposes of this definition, floor area shall not include: a) floor area devoted primarily to storage purposes, except as otherwise noted herein; b) floor area devoted to off-street parking or loading facilities, including aisles, ramps and maneuvering space; or c) basement floor area other than area devoted to retailing activities, to the production or processing of goods, or to business or professional offices.
FLOOR AREA RATIO (F.A.R.): The gross floor area of all buildings on a lot, divided by the area of such lot. In the case of a planned development, the "floor area ratio" means the gross floor area of all buildings in the development site, divided by the net site area.
FRONTAGE (Of A Block): All of the property fronting on one side of a street, between the nearest intersecting streets or between a street and a right of way, waterway or similar barrier.
FRONTAGE LOT: All of the property of such lot fronting on a street, and as measured between side lot lines.
GARAGE, BUS: Any building used or intended to be used for the storage of two (2) or more passenger motor buses, or motor coaches, used in public transportation, including school buses.
GARAGE, PRIVATE: An accessory building or an accessory portion of the principal building, including a carport, which is intended for and used for storing the private passenger vehicles of the family or families resident upon the premises, and in which no business, service or industry connected directly or indirectly with automotive vehicles is carried on; provided, that not more than one-half (1/2) of the space may be rented for the private passenger vehicles of persons not resident on the premises, except that all the space in a garage of one or two (2) car capacity may be so rented.
GARAGE, PUBLIC: Any building other than a private garage, used for the care or incidental servicing of automobiles, and sale of automobile supplies, or where motor vehicles are parked or stored for remuneration, hire or sale within the structure, but not including truck tractors, truck trailers and commercial vehicles exceeding one and one-half (11/2) tons capacity.
GARAGE, STORAGE: A building or premises used for the housing only of motor vehicles pursuant to previous arrangements and not by transients; and where no equipment or parts are sold, and vehicles are not rebuilt, serviced, repaired, hired or sold, except that fuel, grease or oil may be dispensed within the building to vehicles stored therein.
GARAGE, TRUCK: A building which is intended to be used for the storage of motor trucks, truck trailers, tractors and commercial vehicles exceeding one and one-half (11/2) tons capacity.
GRADE: The average level of the finished surface of the ground adjacent to the exterior walls of the building or structure.
GROUP HOME: A single dwelling unit occupied on a relatively permanent basis in a family-like environment by a group of three (3) or more unrelated persons with disabilities, plus paid professional support staff provided by a sponsoring agency, either living with the residents on a twenty four (24) hour basis, or present whenever residents with disabilities are present at the dwelling.
GUEST, PERMANENT: A person or persons who occupies or has the right to occupy accommodations in a lodging house, motel, hotel or apartment hotel as his domicile and place of permanent residence.
HOME OCCUPATION: Any occupation or profession carried on by a member of the immediate family residing on the premises, in connection with which: a) there is used no sign or display that will indicate from the exterior that the building is being utilized in whole or in part for any purpose other than that of a dwelling; b) there is no commodity sold upon the premises; c) no person is employed other than a member of the immediate family residing on the premises; and d) no mechanical or electrical equipment is used except such as may also be used for domestic or household purposes. A professional person may use his residence for consultation, emergency treatment, or performance of religious rites but not for the general practice of his profession. No accessory building shall be used for such home occupation.
HOTEL: An establishment which is open to transient guests, in contradistinction to a lodging house, and is commonly known as a hotel in the community in which it is located and which provides customary hotel services such as maid service, furnishing and laundering of linen, telephone and secretarial or desk service, the use and upkeep of furniture, and bellboy service.
HOTEL, APARTMENT: A hotel in which at least ninety percent (90%) of the hotel accommodations are occupied by permanent guests.
IMPERMEABLE SURFACES: Surfaces which do not allow water to drain, seep, filter or pass through into the ground below. Such surfaces shall include, but are not limited to, buildings, driveways, patios and other similar paved surfaces; except, however, that such surfaces shall not include any such continuous surface that has an area of less than sixteen feet (16').
INCOMPATIBLE USE: A use or service which is incapable of direct association with certain other uses because it is contradictory, incongruous or discordant.
INDUSTRIAL PARK: A planned development designed to accommodate a community of compatible and nonnuisance types of industry. Industrial parks may be promoted or sponsored by private developers, community organizations or government organizations.
JUNKYARD: An open area where waste or scrap materials are brought, sold, exchanged, stored, baled, packed, disassembled or handled, including, but not limited to, scrap iron and other metals, paper, rags, rubber tires and bottles. A "junkyard" includes an auto wrecking yard, but does not include uses established entirely within enclosed buildings, nor does it include an establishment engaged only in the processing of scrap iron or other metals to be sold specifically for the manufacture of steel or metal alloys.
KENNEL: Any premises or portion thereof on which more than four (4) dogs, cats or other household domestic animals over four (4) months of age are kept, or on which more than two (2) such animals are cared for, maintained, boarded or bred for compensation, or are kept for the purpose of sale.
LODGING HOUSE: A residential building or portion thereof, other than a motel, apartment hotel or hotel, containing lodging rooms for accommodation of three (3) or more persons who are not members of the keeper's family and where lodging or meals or both are provided by prearrangement and for definite periods, other than on a daily, overnight or per meal basis to transient guests.
LODGING ROOM: A room rented as sleeping and living quarters, but without cooking facilities and with or without an individual bathroom. (In a suite of rooms without cooking facilities, each room which provides sleeping accommodations shall be counted as one "lodging room" for the purposes of this Title.)
LOT: A parcel of land legally described as a distinct portion or piece of land of record. As used herein, a lot may be one of two (2) kinds: a lot of record or a zoning lot.
LOT AREA, GROSS: The area of a horizontal plane bounded by the front, side and rear lot lines.
LOT, CORNER: A lot situated at the intersection of two (2) or more streets, the interior angle of such intersection not exceeding one hundred thirty five degrees (135°).
LOT DEPTH: The mean horizontal distance between the front lot line and the rear lot line of a lot, measured within the lot boundaries.
LOT LINE, FRONT: The boundary of a lot which is along an existing or dedicated public street, or where no public street exists, is along a public way, where such public way is not a dedicated street. The owner of a corner lot may select either street lot line as the front lot line.
LOT LINE, REAR: The boundary of a lot which is most distance from, and is, or is most nearly, parallel to, the front lot line.
LOT LINE, SIDE: Any boundary of a lot which is not a front or rear lot line.
LOT OF RECORD: A lot which is part of a subdivision, the plat of which has been recorded in the office of the Recorder of Deeds of Cook County, or a parcel of land, the deed to which was recorded in the office of said Recorder prior to the adoption of this Title.
LOT, THROUGH: A lot having a frontage on two (2) nonintersecting streets as distinguished from a corner lot. On a through lot, both street lines shall be deemed front lot lines.
LOT WIDTH: The horizontal distance between the side lot lines of a lot, measured at the narrowest width within the first thirty feet (30') of lot depth immediately in back of the required front yard setback line.
LOT, ZONING: A single tract of land located within a single block, which (at the time of filing for a building permit) is designated by its owner or developer as a tract to be used, developed or built upon as a unit, under single ownership or unified control. A "zoning lot" may or may not coincide with a "lot of record" as defined in this Section.
MANUFACTURE: The making of any thing by any method of process.
MARQUEE OR CANOPY: A rooflike structure of a permanent nature which projects from the wall of a building and may overhang into a required yard.
MOBILE HOME: A trailer designed and constructed for dwelling purposes. (See definition of Trailer.)
MOBILE HOME PARK: A lot, parcel or tract of land developed with facilities for accommodating three (3) or more "mobile homes" as defined above, provided each mobile home contains a kitchen, flush toilet and shower or bath; and such park shall be for use only by nontransient dwellers remaining continuously for more than one month, whether or not a charge is made. The term "mobile home park" shall not include a sales lot in which automobiles or unoccupied trailers are parked for the purpose of inspection or sale.
MOTEL: An establishment consisting of a group of attached or detached living or sleeping accommodations with individual bathrooms and closet space, located on a single lot and designed for use by transients. A motel furnishes customary hotel services such as maid service and laundering of linen, telephone and secretarial or desk service, and the use and upkeep of furniture. In a motel, less than fifty percent (50%) of the living and sleeping accommodations are occupied or designed for occupancy by persons other than transient automobile tourists.
MOTOR FREIGHT TERMINAL: A building, a group of buildings, or an area, in which freight brought by motor truck is assembled and/or stored for routing and intrastate or interstate shipment by motor truck.
MOTOR VEHICLE: A passenger vehicle, truck, truck-trailer, trailer or semi-trailer propelled or drawn by mechanical power. "Motor vehicle" includes "recreational vehicle" as defined in this Section.
MUNICIPAL SERVICE BUILDING: A building or structure belonging to the Village and used by the Village for Municipal purposes.
NAMEPLATE: A sign indicating the name and address of a building, or the name of an occupant thereof and the practice of a permitted occupation therein.
NONCONFORMING BUILDING OR STRUCTURE: Any building or structure which: a) does not comply with all of the regulations of this Title or of any amendment hereto governing "bulk", as that term is defined in this Title, for the zoning district in which such building or structure is located; or b) is designed or intended for a nonconforming use.
NONCONFORMING USE: A use of land, buildings or structures which does not comply with all of the regulations of this Title or of any amendment hereto governing use for the zoning district in which such use is located.
NOXIOUS MATTER: That which is capable of causing injury to living organisms by chemical reaction or is capable of causing detrimental effects upon the physical or economic well-being of individuals.
NURSING HOME: See definition of Rest Home.
OPEN SALES LOT: Land used or occupied for the purpose of buying or selling merchandise stored or displayed out-of-doors prior to sale. (Such merchandise includes, but is not limited to, passenger cars, trucks, motor scooters, motorcycles, boats and monuments.)
PARTICULATE MATTER: Finely divided solid or liquid matter, other than water, which is released into the atmosphere.
PERFORMANCE STANDARDS: The criteria established in Section
10-8-10 of Chapter 8 of this Title to control noise, odor, smoke, toxic or noxious matter, vibration, fire and explosive hazards, waste or glare or heat generated by or inherent in uses of land or buildings.
PLAN COMMISSION: The Planning and Zoning Board of the Village, as provided in Chapter 1 of Title 2 of the Village Code.
PLANNED UNIT DEVELOPMENT: A tract of land which is developed as a unit under single ownership or unified control, which includes two (2) or more principal buildings and one or more principal uses and which may be granted waivers from specified land use regulations and design standards in order to accomplish the purposes of the planned unit development regulations as specified in Chapter 13 of this Title.
PRINCIPAL USE: The main use of land or buildings as distinguished from a subordinate or accessory use.
PROPERTY LINES: The boundary lines of a lot.
PUBLIC UTILITY: Any person, firm, corporation or governmental unit duly authorized to furnish the general public with cable television, electricity, gas, sewer, steam, telephone, transportation, water or similar services, pursuant to applicable regulations.
PUBLIC WAY: A sidewalk, alley, street or limited access highway.
RAILROAD RIGHT OF WAY: A strip of land with railroad tracks and auxiliary facilities for track operation, but not including freight depots or stations, loading platforms, train sheds, warehouses, car or locomotive shops or car yards.
RECREATIONAL VEHICLE: A vehicular type unit originally designed or permanently connected and used for temporary living quarters while camping, traveling or on vacation from the owner's residence, and which has its own motive power or is mounted on or drawn by another vehicle and is not used for commercial purposes. This definition shall include the following:
(A) Travel trailers, being portable vehicular structures built on a chassis, designed to be drawn by another vehicle, usually having fixed and rigid sides, ends and rooms and sometimes referred to as "self-contained";
(B) Truck campers, being portable units designed to be loaded onto or affixed to the bed or chassis of a truck;
(C) Camping trailers, being portable vehicular units mounted on a chassis constructed with collapsible side walls, ends and roof which fold down for travel and storage;
(D) Motor homes, being vehicular units built on a self-propelled motor vehicle chassis as a self-contained integral part of the chassis; and
(E) Boat trailers, being portable vehicular units designed to be drawn by another vehicle and designed or utilized for the transportation of a boat or boats, whether or not loaded with a boat or boats.
RESERVOIR PARKING: Those off-street parking spaces allocated to automobiles awaiting entrance to a particular establishment.
REST HOME (Or Nursing Home): A private home for the care of children or the aged or infirm, or a place of rest for those suffering bodily disorders, but which does not contain equipment for surgical care or for the treatment of disease or injury.
SETBACK: The minimum horizontal distance between the front line of a building or structure and the front property line.
SIGN: A name, identification, description, display or illustration which is affixed to, or painted or represented directly or indirectly upon a building, structure, billboard, or piece of land and which directs attention to an object, product, place, activity, person, institution, organization or business. A "sign" shall not include: a) the display of official court or public office notices; b) the flag, emblem or insignia of a nation, political unit, school or religious group; nor c) one located completely within an enclosed building, except signs located behind window areas so as to be exposed to view from outside the building. Each display surface of a sign shall be considered to be a separate sign.
SIGN, ADVERTISING: A type of sign which directs attention to a business, commodity, service or entertainment not exclusively related to the premises where such sign is located or to which it is affixed.
SIGN, BUSINESS: A type of sign which directs attention to a business or profession conducted or to a commodity, service or entertainment sold or offered upon the premises where such sign is located or to which it is affixed.
SIGN, FLASHING: An illuminated sign on which the artificial light is not maintained stationary or constant in intensity and color at all times when such sign is in use. Any revolving, illuminated sign shall be considered to be a "flashing sign".
SIGN, GROSS AREA OF: The entire area within a single continuous perimeter enclosing the extreme limits of such sign and in no case passing through or between any adjacent elements of same. However, such perimeter shall not include any structural or framing elements lying outside the limits of such sign and not forming an integral part of the display.
SIGN, IDENTIFICATION: A structure, building, wall or other outdoor surface used to display and identify the name of the individual business, profession, organization or institution occupying the premises on which it is located.
SMOKE: The visible discharge from a chimney, stack, vent, exhaust or combustion process which is made up of particulate matter.
STORY: The portion of a building included between the surface of any floor and the surface of the floor next above or, if there is no floor above, the space between the floor and the ceiling next above. A basement having more than one-half (1/2) the clear floor-to-ceiling height above curb level shall be considered a story. Any portion of a story exceeding fourteen feet (14') in height shall be considered as an additional story for each fourteen feet (14') or fraction thereof.
STORY, HALF: The portion of a building or structure under any type of sloping roof, the wall plates of which on at least two (2) opposite exterior walls are not more than four and one-half feet (41/2') above the top level of the story below.
STREET: A platted, partially or fully improved public right of way, which affords the principal means of access to abutting property, excluding driveways to buildings and alleys.
STRUCTURAL ALTERATION: Any change, other than incidental repairs, which would prolong the life of the supporting members of a building, such as the addition, removal or alteration of bearing walls, columns, beams, girders or foundations.
STRUCTURE: Anything constructed or erected, the use of which requires more or less permanent location on the ground or attached to something having a permanent location on the ground including but not limited to fences, freestanding walls, buildings, decks and parking lots. A sign, billboard or other detached or projecting advertising medium shall be construed to be a structure.
TOXIC MATTER OR MATERIALS: Any substances, whether solid, liquid or gaseous, which are capable of impairing health or causing injury to living organisms by chemical means when present in relatively small amounts.
TRAILER: A vehicle, which may be self-propelled or propelled by other means, used or adaptable for living, sleeping, business or storage purposes, no foundation other than wheels, blocks, skids, jacks, horses or skirting, and which has been or reasonably may be equipped with wheels or other devices for transporting it from place to place. A permanent foundation shall not change its character unless the entire structure is erected in accordance with prevailing Village laws.
USE (Of Property): The purpose or activity for which the land or a building thereon is designed, arranged or intended, or for which it is occupied or maintained.
USE, NONCONFORMING: The use of any building, structure or parcel of land which is lawfully occupied and maintained upon the effective date of the adoption or amendment of this Title and which does not conform to the use regulations of the zoning district in which the use is located by reason of the adoption or amendment of this Title.
USE, PERMITTED: A use which may be lawfully established in a particular district or districts, provided it conforms with all requirements, regulations and performance standards of such district.
USE, PRINCIPAL: The main use of land or buildings as distinguished from a subordinate or accessory use.
USE, SPECIAL: A use which, because of its unique characteristics, cannot be properly classified as a permitted use in any particular district or districts, but which may be permitted pursuant to the provisions of Chapter 17 of this Title.
UTILITY FACILITY: A building, structure or use of land which provides, under public regulations, electricity, gas, steam, telephone, communications, television, transportation, sewer or water services and which is operated by a public utility.
VARIATION: A waiver of the terms of applicable zoning regulations pursuant to the procedures of Chapter 16 of this Title where, due to conditions peculiar to the property, a literal enforcement of the regulations would result in unnecessary and undue hardship.
YARD: An open space on the same zoning lot with a principal building or structure, which is unoccupied and unobstructed from its lowest level upward, except as otherwise permitted. A yard extends along a lot line, and to a depth or width specified in the yard requirements for the zoning district in which such zoning lot is located.
YARD, CORNER SIDE: A side yard which adjoins a public street or limited access highway.
YARD, FRONT: A yard extending along the full length of the front lot line between the side lot lines.
YARD, INTERIOR SIDE: A side yard which is located immediately adjacent to another lot or to an alley separating such side yard from another lot.
YARD, REAR: A yard extending along the full length of the rear lot line between the side lot lines.
YARD, SIDE: A yard extending along a side lot line from the front yard to the rear yard.
YARD, TRANSITIONAL: A yard which must be provided: a) on a lot in a business district which adjoins a lot in a residence district; or b) on a lot in a manufacturing district which adjoins a lot in either a residence or business district.
ZONING ADMINISTRATOR: The person appointed by the Village President and Board of Trustees to be responsible for enforcing and administering all requirements of this Title.
ZONING BOARD: The Planning and Zoning Board of the Village, as provided in Title 2, Chapter 1 of this Code.
ZONING DISTRICT: A section or sections of the Village for which the regulations and requirements governing use, lot and bulk of buildings and premises are uniform.
ZONING MAP: The map or maps incorporated herein by reference, designating zoning districts.
ZONING ORDINANCE: The Forest View Zoning Ordinance. (Ord. 93-13, 8-10-1993; amd. Ord. 96-19, 12-10-1996; Ord. 99-19, 9-28-1999)
