CHAPTER 5

R SINGLE-FAMILY RESIDENCE DISTRICT

10-5-1: PERMITTED USES:

The following uses are permitted in the R Single-Family Residential District:
Home occupations, subject to the regulations of Section 10-5-16 of this Chapter.
Parks and playgrounds, publicly owned and operated.
Schools, nonboarding, elementary, junior high and high, public or private.
Signs, subject to the regulations of Section 10-5-17 of this Chapter.
Single-family detached dwellings.
Temporary buildings or sheds for construction purposes, for a period not to exceed the earlier of the date of completion of such construction or one year.
Accessory uses. (Ord. 93-13, 8-10-1993)

10-5-2: SPECIAL USES:

The following uses may be allowed by special use permit in accordance with the provisions of Chapter 18 of this Title.
Cemeteries, including mausoleums in conjunction therewith, but excluding crematories.
Day care centers and day nurseries.
Libraries, public.
Municipal service buildings.
Municipally owned buildings and community centers.
Satellite dishes no more than three feet (3') in diameter, but only when used as an accessory use.
Utility and public service uses:
Electric substations.
Fire stations.
Police stations.
Telephone exchanges.
Water filtration plants, pumping stations and reservoirs.
Other similar public service uses. (Ord. 93-13, 8-10-1993)

10-5-3: LOT AREA:

Not less than five thousand four hundred (5,400) square feet. (Ord. 61-56, 12-1961)

10-5-4: LOT WIDTH:

Not less than forty feet (40') at the buildable area. (Ord. 61-56, 12-1961)

10-5-5: FLOOR AREA RATIO:

Floor area ratio, nonresidential permitted uses and special uses, not to exceed 0.6. (Ord. 61-56, 12-1961)

10-5-6: BUILDING HEIGHT:

Single-family dwelling uses, not to exceed two and one-half (21/2) stories, or thirty five feet (35'), whichever is lower. (Ord. 61-56, 12-1961)

10-5-7: GROUND FLOOR AREA PER DWELLING:

All dwellings not less than one thousand (1,000) square feet. (Ord. 61-56, 12-1961)

10-5-8: FRONT YARD:

Single-family dwelling uses, not less than twenty five feet (25') in depth. (Ord. 61-56, 12-1961)

10-5-9: SIDE YARDS:

Single-family dwelling uses:
   (A)   Two (2) side yards having a combined width of twelve feet (12') and neither side yard less than four feet (4') in width on less than sixty foot (60') lots; on sixty foot (60') lots no less than five feet (5') on either side.
   (B)   A side yard abutting a street not to be less than twenty five feet (25') wide, except if a corner lot, subdivided and duly recorded on the effective date of this Title, has insufficient width to provide such yard of twenty five feet (25') width and still to maintain a buildable width of thirty two feet (32'), including required side yard along the opposite side lot line, then the side yard abutting the street may be reduced in width by the distance necessary to maintain a buildable width of thirty two feet (32'), provided the side yard abutting a street is not reduced to less than thirty percent (30%) of the width of the lot. 10-5-10: REAR YARD:

For single-family dwelling uses, the rear yard shall be not less than forty feet (40') in depth. The total of all impermeable surfaces in the rear yard shall not exceed fifty percent (50%) of the total area of the rear yard. (Ord. 96-19, 12-10-1996)

10-5-11: YARDS:

Nonresidential permitted uses and special uses, front, side and rear yards, as required for single-family dwelling uses for a building less than thirty five feet (35') in height; but for a building thirty five feet (35') or more in height, each yard, front, side and rear, as required for single- family dwellings, shall be increased by one foot (1') in depth or width for each additional one foot (1') of building height over thirty five feet (35'). 10-5-12: OFF-STREET LOADING:

Nonresidential permitted uses and special uses: loading berths in accordance with provisions set forth in Chapter 12 of this Title. (Ord. 61-56, 12-1961)

10-5-13: OFF-STREET PARKING:

Parking spaces in accordance with provisions set forth in Chapter 12 of this Title. (Ord. 61-56, 12-1961)

10-5-14: ACCESSORY BUILDINGS:

   (A)   Private garages shall be permitted accessory uses in the Residential Zoning District. No private garage shall be more than twenty four feet (24') in length, twenty four feet (24') in width and fourteen feet six inches (14'6") high. The garage shall be no less than four feet (4') from any side lot line and no less than four feet (4') from the rear lot line.
   (B)   Private sheds shall be permitted accessory uses in the Residential Zoning District. Private sheds shall not exceed ten feet (10') in length, or ten feet (10') in width, and twelve feet (12') in height. The shed shall be no less than four feet (4') from any side lot line and no less than four feet (4') from the rear lot line.
   (C)   Private gazebos or covered patios shall be permitted accessory uses in the Residential Zoning District. Private gazebos or covered patios shall not exceed one hundred fifty square feet (150 sq ft) or exceed twelve feet (12') in height. The gazebo shall be no less than four feet (4') from any side lot line and no less than four feet (4') from the rear lot line.
   (D)   Private carports shall be permitted accessory uses in the Residential Zoning District. Private carports shall not exceed two hundred square feet (200 sq ft) or exceed twelve feet (12') in height. The carport shall be no less than four feet (4') from any side lot line and no less than four feet (4') from the rear lot line. (Ord. 96-19, 12-10-1996; amd. Ord. 22-21, 9-13-2022)

10-5-15: PROHIBITED USES; YARDS:

Specifically prohibited in front, side or back yards are:
   (A)   Open storage of building material except during active construction for permissible uses and not to exceed a period of one year from date of permit issue.
   (B)   Storing of junk or nonoperating automobiles or trucks.
   (C)   Storing of machinery and equipment used in building construction and alteration or heavy road type machinery.
   (D)   Open storing of mobile homes and residence in same.
   (E)   Dilapidated, unsightly, unsanitary sheds or temporary shelter for materials or equipment.
   (F)   Burning of paper and rubbish.
   (G)   Piles of rubbish, junk or miscellaneous articles.
   (H)   Raising of poultry, pigeons, bees, livestock or furbearing animals for sale or for sale of the products therefrom. (Ord. 61-56, 12-1961)

10-5-16: HOME OCCUPATIONS:

Home occupations shall be governed by the following regulations:
   (A)   Permitted home occupations may include any of the following:
      1.   Art, craft or ceramic studio.
      2.   Dressmaking.
      3.   Professional offices of a clergyman, lawyer, architect, engineer or accountant.
      4.   Barbershop or beauty parlor, provided that such services are not rendered to more than one person at a time or more than three (3) persons per day.
      5.   Babysitting services, but excluding daycare centers or day nurseries. (Ord. 93-13, 8-10-1993)
   (B)   Permitted home occupations shall not, under any circumstances, include any other occupation such as, but not limited to, the following:
      1.   The operation of any wholesale or retail business unless conducted entirely by mail or via the internet, and which does not involve the sale, receipt or delivery of merchandise on the premises; (Ord. 17-06, 3-25-2017)
      2.   Any manufacturing or fabricating of products other than art works, craft works, pottery works and dressmaking;
      3.   A repair shop or service establishment of any kind operating on or from the premises;
      4.   A clinic or hospital;
      5.   A barbershop or beauty parlor rendering more services than provided in subsection (A)4 of this section;
      6.   A daycare center or day nursery;
      7.   A stable or kennels;
      8.   A restaurant;
      9.   Any activity that produces noxious matter, or in any other respect constitutes a nuisance.
   (C)   Permitted home occupations shall not be conducted in any building on the premises other than the building which is used by the occupant as his private dwelling.
   (D)   Permitted home occupations may not include the employment of any additional person on the premises in the performance of such service, except such members of the immediate family residing on the premises, and further, shall not include exterior display or exterior signs except as such are permitted by section 10-5-17 of this chapter. There shall be no exterior storage of equipment or materials used in such home occupations, and no mechanical equipment shall be used except such as may also be used for domestic or household purposes. 10-5-17: SIGNS:

   (A)   Illuminated nameplates are permitted subject to the following conditions:
      1.   A nameplate shall not exceed forty eight (48) square inches in area, and shall indicate only the name or name and address of the occupant.
      2.   There shall not be more than one such nameplate for each dwelling.
   (B)   Unilluminated "for sale" and "for rent" signs are permitted, subject to the following conditions:
      1.   There shall not be more than one sign per lot, except that on a corner lot two (2) signs, one facing each street, shall be permitted.
      2.   No sign shall exceed twelve (12) square feet in area, nor be closer than eight feet (8') to any side and rear lot line, and four feet (4') to the front lot line, or one-half (1/2) the depth of the front yard, whichever is greater.
      3.   No sign shall project higher than one story, or twenty feet (20') above curb level, whichever is lower. (Ord. 93-13, 8-10-1993)
