CHAPTER 6

B-1 RETAIL AND SERVICE BUSINESS DISTRICT

10-6-1: GENERAL CONDITIONS:

   (A)   Dwelling units are not permitted, except as accessory uses to the principal business use.
   (B)   All business, service, storage, merchandise, display and, where permitted, repair and processing shall be conducted wholly within an enclosed building, except for off-street automobile parking, off-street loading and open sales lots.
   (C)   Unless otherwise specifically permitted in this Chapter, goods sold shall consist primarily of new merchandise and any goods produced on the premises shall be sold at retail, primarily on the premises.
   (D)   All nonresidential uses shall meet the performance standard requirements of the M-1 Restricted Manufacturing District, as set forth in Section 10-8-10 of Chapter 8 of this Title. (Ord. 93-13, 8-10-1993)

10-6-2: PERMITTED USES:

The following retail business and service uses are permitted in the B-1 Retail and Service Business District:
Antique shops.
Art galleries and museums, but not including auction rooms.
Art supply stores.
Automobile accessory stores.
Bakeries where not more than fifty percent (50%) of the floor area is devoted to processing.
Banks and financial institutions.
Barber shops and beauty parlors.
Bicycle stores, sales, rental and repair.
Blueprinting and photocopying establishments.
Book and stationery stores.
Building material sales, not including outside storage.
Camera and photographic supply stores.
Candy and ice cream stores.
Carpet and rug stores.
Catering establishments.
China and glassware stores.
Clothes pressing establishments.
Clothing and costume rental shops.
Coin and philatelic stores.
Contractors' and construction offices, not including outside storage.
Custom dressmaking.
Currency exchanges.
Department stores.
Drug stores and pharmacies.
Dry cleaning and laundry receiving establishments, with processing done off-site.
Dry cleaning establishments, retail only, with processing done on-site.
Dry goods stores.
Electrical and household appliance sales and service, including radio and television sales and repairs.
Flower shops.
Food stores, grocery stores, meat markets and delicatessens.
Frozen food shops, but not including locker rental in conjunction therewith.
Furniture sales, which may include furniture upholstering and the making of draperies, slipcovers and other similar articles, when conducted as part of the retail operations and secondary to the principal use.
Furrier shops, including the incidental storage and conditioning of furs.
Garden supply and seed stores.
Gift shops.
Hardware stores.
Hobby shops, retail, for sale of items to be assembled or used away from the premises.
Interior decorating and design shops, which may include furniture upholstering and making of draperies, slip covers and other similar articles, when conducted as part of the retail operations and secondary to the principal use.
Jewelry sales and repairs.
Laboratories, medical, dental and optical.
Leather goods and luggage stores.
Liquor stores, retail sales.
Loan offices.
Locksmith shops.
Machinery sales, but not including outside display or storage.
Mail order houses.
Mail order service stores.
Medical and dental clinics, including laboratories incidental thereto.
Musical instrument sales and repair.
Newspaper office, but not including newspaper printing operations.
Office and school supply stores.
Office and business support services, including printing, mailing and photocopy services.
Offices, business, professional and public.
Optician and optometrist offices, including laboratories as incidental thereto.
Orthopedic and medical appliance stores, but not including the assembly or manufacture of such articles.
Paint and wallpaper stores.
Pet shops, including pet supplies and pet grooming.
Photography studios, including developing and printing of photographs when conducted on the premises as part of the retail business.
Physical culture and health services, reducing salons.
Picture framing.
Plumbing showrooms and shops.
Post offices.
Restaurants, but not including entertainment or dancing.
Schools, music, dance or business.
Shoe sales and repair.
Signs, subject to the provisions of Section 10-6-6 of this Chapter.
Sporting goods stores.
Tailoring, alterations and needlework services.
Taverns and cocktail lounges.
Telegraph offices.
Temporary buildings for construction purposes, for a period of one year or the end of construction, whichever is shorter.
Toy shops.
Travel agencies, travel bureaus and transportation ticket offices.
Variety stores.
Wearing apparel shops, including hats and shoes.

10-6-3: SPECIAL USES:

The following uses may be allowed by special use permit in accordance with the provisions of Chapter 18 of this Title:
Animal hospitals.
Auditoriums.
Automobile body work facility.
Automobile service stations.
Churches.
Clubs and lodges, private, fraternal or religious.
Garages, public, servicing automotive vehicles of three (3) ton weight and under, but not including body repair or painting.
Greenhouses.
Health centers.
Laboratories, medical, dental and optical, including research and testing.
Libraries, public.
Liquor stores, retail sales.
Municipal buildings, recreational buildings and community centers.
Municipal service buildings.
Satellite dishes no more than three feet (3') in diameter, but only when used as an accessory use.
Schools, commercial or trade, including those teaching music, dance, commercial, business or technical subjects.
Utility and public service uses:
   Electric substations and distribution centers.
   Fire stations.
   Police stations.
   Telephone exchanges.
   Planned unit developments. (Ord. 93-13, 8-10-1993)

10-6-4: FLOOR AREA RATIO:

Not to exceed 1.8. (Ord. 61-56, 12-1961)

10-6-5: YARDS:

   (A)   Side Yards: If a side yard is provided, not less than five feet (5') wide, except where a side lot line coincides with a side lot line in an adjacent residence district, or adjacent to an alley which separates business and residence districts, a yard shall be provided along such side lot line. Such yard shall be equal in dimension to the minimum side yard which would be required under this Title for a residential use on an adjacent residential lot.
   (B)   Rear Yard: There shall be provided a rear yard of not less than twenty feet (20') in depth. (Ord. 61-56, 12-1961)
   (C)   Front Yard: There shall be provided a front yard of not less than five feet (5') in depth measured from the inner edge of the sidewalk away from the curb of the street. (Ord. 93-31, 11-23-1993)

10-6-6: SIGNS:

Nonflashing but illuminated business signs with no moving parts, awnings and marquees are permitted subject to regulations set forth elsewhere in the provisions of the Village Code and the following:
   (A)   Exterior signs may be illuminated until eleven o'clock (11:00) P.M., or the close of business, whichever is later. Where a sign is illuminated by light reflected upon it, direct rays of light shall not beam upon any part of any existing residential building, nor into a residence district, or into a street. A sign in direct line of vision of any traffic signal shall not have red, green or amber illumination.
   (B)   The gross surface area in square feet of business signs on a lot shall not exceed three (3) times the lineal feet of frontage of the lot, and for lots fronting on more than one street, only the established front lot line shall be considered as frontage of the lot.
   (C)   No sign shall project more than twenty four inches (24") into a public right of way. (Ord. 61-56, 12-1961)
   (D)   Any sign located within three feet (3') of a driveway, parking area, or within fifty feet (50') of the intersection of two (2) or more streets shall have the lowest elevation at least twelve feet (12') above the curb level. No temporary, portable or removable signs shall be placed on or within a driveway, public right of way or parkway area. (Ord. 69-206, 10-28-1969)
   (E)   No sign shall project higher than the building height or thirty feet (30') above the curb level, whichever is lower.
   (F)   In a unified shopping center, in single ownership or control, one additional sign may be erected for it; the sign shall not exceed one hundred twenty (120) square feet in area nor display more than the name and the location of the shopping center; such sign shall be set back at least half the required yard depth distance from each abutting street and its bottom edge shall be at least eight feet (8') above the level of the ground, and its overall height shall not exceed sixteen feet (16') above the curb level.
