CHAPTER 11

R-6 MULTIPLE-FAMILY DWELLING DISTRICT

10-11-1: PERMITTED USES:

Except as permitted by special use permit, no use of property in an R-6 District shall be carried on except the following:
Uses permitted in the R-5 District.
Apartment houses, row houses and similar multiple-family dwellings up to twelve (12) dwelling units per building.
Boarding and rooming houses.
Hotels.
Nursery and nursery schools.
Private clubs, fraternities, sororities, lodges except when operated primarily for commercial gain.
Rest and retirement homes.
Signs, as permitted in chapter 18 of this title. (Ord. B-39, 1969)

10-11-2: SPECIAL USES:

The following uses may be allowed by special use permit in accordance with the provisions of chapter 22 of this title:
Special uses permitted in the R-5 District.
Apartment houses over twelve (12) units per structure.
Cottage business.
Planned developments, as approved by the Planning and Zoning Commission.
Public service uses.
Tiny Homes, provided they comply with 10-22-11. (Ord. B-39, 1969; amd. Ord. B-424, 10-4-1983; Ord. D-085, 3-1-2022)

10-11-3: OFF-STREET PARKING FACILITIES:

Automobile parking facilities shall be provided as required or permitted in chapter 19 of this title. (Ord. B-39, 1969)

10-11-4: HEIGHT OF BUILDINGS:

   A.   For one-family detached dwellings, two-family detached dwellings and churches, the same regulations shall apply as permitted or required in the R-1 One-Family Dwelling District.
   B.   For multiple-family dwellings, apartments and one-family row dwellings, thirty five feet (35') or three (3) stories. (Ord. B-39, 1969)

10-11-5: LOT REQUIREMENTS:

   A.   Every one-family dwelling hereafter erected shall be located on a lot having an area of not less than eight thousand (8,000) square feet and a minimum width at the established building line of seventy feet (70').
   B.   Every two-family detached dwelling hereafter erected shall be located on a lot having an area of not less than seven thousand (7,000) square feet and a minimum width at the established building line of sixty feet (60').
   C.   Every multiple-family detached dwelling hereafter erected shall be located on a lot having a minimum area in accordance with the schedule below. A minimum lot width of eighty feet (80') at the established building line must be provided:
 
2 to 4 family
2,500 square feet per unit
5 to 8 family
2,000 square feet per unit
9 to 12 family
1,500 square feet per unit
 
   D.   Minimum lot sizes for special uses shall be prescribed and conditions stipulated at the time a special use permit is authorized. All such uses shall be served by a public sewer and water supply.
   E.   No zoning lot shall be built upon unless the lot is served by both public sewer and water supply approved by the City. (Ord. B-39, 1969)

10-11-6: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained in connection with such building, structure or enlargement: (Ord. B-39, 1969)
   A.   Front Yard: On every zoning lot, a front yard of not less than twenty five feet (25') in depth shall be provided. However, where lots within the same block and comprising forty percent (40%) of the frontage on the same street are already developed with front yards with an average depth of less than twenty five feet (25'), then such average depth shall be the required front yard depth for such frontage in said block.    B.   Side Yards: Ten percent (10%) of the lot width on either side, but not less than ten feet (10') required for single story and two story dwellings. Where multi-story construction is used there shall be a side yard of ten percent (10%) of the lot width plus one additional foot for each story above the second floor, but not less than ten feet (10').
On corner lots, the side yard on the intersecting street side shall be not less than fifteen feet (15').
   C.   Rear Yard: In the R-6 District, there shall be provided and maintained the following rear yards:
      1.   For one- and two-family dwellings, a rear yard of not less than thirty feet (30').
      2.   For row dwellings, a rear yard of not less than twenty five feet (25').
      3.   For multiple-family dwellings and apartments, a rear yard of not less than twenty five feet (25').
      4.   For nonresidential buildings, a rear yard of not less than thirty feet (30').
Detached accessory buildings may be located in required rear yards as allowed in section 10-4-10 of this title. (Ord. B-39, 1969)
   D.   Zero Lot Line Dwellings:
      1.   "Zero lot line dwellings" are defined as:
         a.   A two-family dwelling in which the dwelling units are joined by a common party wall standing part upon each of the two (2) adjoining lots; or
         b.   Three (3), or more, one-family attached dwellings located on two (2) or more individual lots joined by a common party wall.
      2.   The required lot area for a zero lot line dwelling unit shall be:
         a.   In case of a two-family dwelling at least one-half (1/2) the minimum lot area for a two-family detached dwelling unit.
         b.   In the case of three (3), or more, family dwellings, at least one-half (1/2) the minimum lot area for a two-family detached dwelling unit.
      3.   a. Every lot upon which there is erected a two-family zero lot line dwelling unit shall have a minimum width of seventy feet (70') and a minimum depth of one hundred feet (100').
         b.   Every lot upon which there is erected a three (3), or more, family zero lot line dwelling shall have a lot width of at least twenty five feet (25') or a minimum depth of one hundred feet (100') for each interior unit. Any dwelling unit that is not an "end unit" is classified as an "interior unit".
      4.   Every zero lot line dwelling shall have a front and rear yard of not less than twenty five feet (25'). Each end unit in a zero lot line dwelling arranged as townhouses or row houses shall have a side yard of not less than ten feet (10'). On corner lots, side yard requirement on the intersecting street side shall not be less than fifteen feet (15').
      5.   Zero lot line dwellings are governed by the height and lot coverage restrictions of the zoning district. (Ord. C-211, 8-2-1994)
      6.   Each dwelling unit shall be provided with separate building access and with separate utility service. No portion of the wall, roof or appurtenance on the zero yard side shall project over the lot line. Openings in the wall shall be prohibited. (Ord. C-238, 4-4-1995)
      7.   This subsection shall apply to zero lot line dwellings erected after January 1, 1994. (Ord. C-211, 8-2-1994)

10-11-7: LOT COVERAGE:

Not more than fifty percent (50%) of the lot area may be occupied by buildings or structures, including accessory buildings. (Ord. B-39, 1969)

10-11-8: DWELLING STANDARDS:

   A.   For one-family dwellings, the same regulations shall apply as required in the R-4 One-Family Dwelling District.
   B.   Every two-family dwelling hereafter erected shall have a minimum total floor area of six hundred (600) square feet per unit, measured from the outside of the exterior walls, including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes.
   C.   Every multiple-family dwelling hereafter erected shall have a minimum total floor area of four hundred (400) square feet per unit, measured from the outside of the exterior walls, including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes.
   D.   All multiple-family dwellings shall be served by parking lots and service drives with adequate provisions for exit, entry and turning movements. (Ord. B-39, 1969)
   E.   Every dwelling erected in any R-6 Multiple-Family Dwelling District shall have a minimum of twenty four feet (24') in building width. (Ord. C-340, 3-20-2001)
