CHAPTER 13

B-2 BUSINESS DISTRICT, GENERAL RETAIL

10-13-1: PERMITTED USES:

The following retail and service uses are permitted provided they are operated entirely within a building, except for off street parking or loading facilities, and except for establishments of the drive-in type offering goods and services directly to customers waiting in parked motor vehicles:
Any use permitted in the B-1 business district.
Ambulance service.
Auction rooms.
Auto accessory store, where there is no driveway entrance across the sidewalk into the main building.
Automobile and truck sales and service shops, including painting and repairing.
Bicycle sales and repair.
Blueprinting and photostating establishments.
Catering establishments.
Costume rental shops.
Cutting of glass and glazing establishments.
Dry cleaning establishments, retail, with equipment for dry cleaning not to exceed one unit of sixty (60) pounds' capacity or standard coin operated, self-service dry cleaning equipment.
Exterminating shops.
Garages, public, for storage of private passenger automobiles and commercial vehicles under one and one-half (11/2) tons.
Hand laundries.
Laboratories (medical, dental, research, experimental and testing), provided no production or manufacturing of products takes place and provided the performance standards of the I-1 district are complied with.
Loan offices, when located above the first floor.
Mirror and glazing shops.
Monument sales, but not including the cutting or grinding of stones or other material, on an open lot or within a building.
Off street parking and loading facilities, as permitted or required in accordance with the provisions of chapter 19 of this title.
Pawnshop.
Physical culture and health services.
Printing and publishing of newspapers, periodicals, books and including letter process work.
Radio and television broadcasting stations.
Schools: music, dance, business, commercial or trade.
Secondhand stores and rummage shops.
Silver plating and repair shops.
Telephone exchange, repeater stations, microwave relay towers and stations, mobile transmitting towers and stations, antenna towers and other outdoor equipment essential to the operation of the exchange in the interest of public convenience and necessity, and including business offices in conjunction therewith.
Theater, indoor.
Undertaking establishments, funeral parlors or mortuaries.

10-13-2: SPECIAL USES:

The following uses may be allowed by special use permit in accordance with the provisions of chapter 22 of this title:
Amusement establishments, bowling alleys, pool halls, dance halls, swimming pools, skating rinks and coin operated amusement device establishments.
Apartment houses, row houses and similar multiple-family dwellings, provided the yard areas and lot coverage comply with those required in the R-6 multiple-family dwelling district.
Automobile laundry (automatic and self-service) facilities.
Automobile service stations.
Banks – drive-in.
Boarding or rooming houses, provided the yard areas and lot coverage comply with those required in the R-6 multiple-family dwelling district.
Churches, temples and synagogues – on a lot not less than one acre in area.
Establishments licensed for the on premises consumption of beer and liquor, however, such businesses in existence prior to July 1, 1994, are exempt and will not be required to obtain a special use permit.
Health centers, public.
Laboratories, research and testing.
Lodging rooms, provided the yard areas and lot coverage comply with those required in the R-6 multiple-family dwelling district.
Outdoor merchandise display of machinery or equipment to take orders, but no regular delivery of large or heavy items.
Parking lots.

10-13-3: CONDITIONS OF USE:

All uses permitted in this district, except residential district uses, shall be retail establishments only and shall be subject to the following conditions:
   A.   Any conditions of use applicable to permitted uses in the B-1 district shall apply in the B-2 district.
   B.   There shall be no manufacture, processing or treatment of products other than those which are clearly incidental and essential to the retail business conducted on the premises.
   C.   Not more than five (5) persons, exclusive of manager, clerk and drivers, shall be engaged in said manufacturing, processing or treatment of products, including catering, cleaning, laundering, plumbing, upholstering and other similar permitted uses.
   D.   Such uses, operations or products shall not be objectionable due to odor, dust, smoke, noise, vibrations or other similar causes. (Ord. B-39, 1969)

10-13-4: HEIGHT OF BUILDINGS:

The same regulations shall apply as permitted or required in the B-1 limited retail business district. (Ord. B-39, 1969)

10-13-5: YARD AREAS:

   A.   Front Yard: A front yard of not less than twenty feet (20').
   B.   Side Yards: Side yards of not less than six feet (6') on any one side with total combined side yards of not less than fifteen feet (15').
   C.   Rear Yard: A rear yard of not less than twenty feet (20'). (Ord. C-417, 5-3-2005)

10-13-6: SIGNS:

The erection, construction, alteration and location of signs, other advertising structures, marquees and awnings shall be in conformity with the provisions of chapter 18 of this title. (Ord. B-39, 1969)

10-13-7: OFF STREET PARKING AND LOADING FACILITIES:

Off street parking and loading facilities shall be provided as permitted or required in chapter 19 of this title. (Ord. B-39, 1969)
