CHAPTER 24

BED AND BREAKFAST ESTABLISHMENTS

10-24-1: PURPOSE:

In that there has been recent interest in the creation of bed and breakfast establishments which would provide lodging to visitors, promote economic development and tourism, and encourage the saving and restoring of buildings of historic value in our city, it is the purpose of this chapter to protect the public health, safety and welfare of the citizens by regulating such establishments. 10-24-2: DEFINITION OF BED AND BREAKFAST ESTABLISHMENTS:

A bed and breakfast establishment shall be defined as a residence which provides for overnight lodging and which serves only the breakfast meal to guests. The structure must be owner occupied or have a dwelling unit within, which will be the residence of the host or hostess or operator(s). (Ord. C-062, 8-21-1990)

10-24-3: NUMBER OF GUEST ROOMS PERMITTED:

No more than five (5) guest rooms may be made available for sleeping rooms. (Ord. C-062, 8-21-1990)

10-24-4: SPECIAL USE PERMIT REQUIRED:

   A.   Bed And Breakfast, Permit Required: A special use permit granted by the board of adjustment and appeals is required for the establishment of a bed and breakfast facility, the granting of which is provided for in title 10, chapter 22 of this code. (Ord. C-062, 8-21-1990; amd. 1993 Code; Ord. D-39, 1-17-2017)
   B.   Application: An application for a special use permit shall be filed with the zoning administrator and shall include the following:
      1.   A reproducible site plan reasonably to scale depicting the existing conditions or any proposed modifications to the location of property lines, structures, landscaping, driveways and parking. Any future changes from the initial application shall also be submitted for approval.
      2.   A reproducible detailed floor plan reasonably to scale of the structure showing all room uses.
   C.   Personal, Not Transferable: The special use permit shall be personal to the applicant and not transferable. (Ord. C-062, 8-21-1990; amd. 1993 Code)
   D.   Bed And Breakfast, Validity: A special use for a bed and breakfast may be granted for a specified length of time or may be granted indefinitely upon application, hearing and authorization by the board of adjustment and appeals as long as the owner and operator of the business remains unchanged. As with all special uses, the board may review the validity of the special use at any time in the future if concerns arise or it is found to no longer conform to the code or conditions placed on said special use permit.    E.   Parking Requirements: The number of off street parking spaces required, their locations, surfacing, screening and setbacks from property lines shall be determined on the special use permit. (Ord. C-062, 8-21-1990; amd. 1993 Code)

10-24-5: FOOD SERVICE AND ALCOHOLIC BEVERAGE RESTRICTIONS:

Food service and alcoholic beverages are limited to overnight guests only. Any alcoholic beverages offered by the owner, operator, or agent thereof shall not be paid for by the guest(s) in any fashion, but shall be complimentary only. (Ord. C-062, 8-21-1990)

10-24-6: HOTEL/MOTEL TAX REQUIRED:

Proof of registration with the Iowa department of revenue for the purpose of collecting and submitting hotel/motel tax shall be given to the zoning administrator within ninety (90) days after the issuance of the special use permit. (Ord. C-062, 8-21-1990)

10-24-7: FIRE SAFETY REQUIREMENTS:

Combination smoke and heat detectors, in proper working order, are required in each guest sleeping room. A fire extinguisher, in proper working order, is required on each floor. At least two (2) separate, remote exits are required for second and third floor guest rooms. (Ord. C-062, 8-21-1990)

10-24-8: SIGNS:

The use of signs shall be limited to naming the business. In residentially zoned districts, one (1) wall sign with a total area of four (4) square feet is allowed, except that on a corner lot, a wall sign may face each adjacent street. (Ord. C-062, 8-21-1990)
