- Temporary uses.
13.100. This section regulates temporary uses conducted on private property.
13.101. Temporary use permit applications:
(1)
Any person desiring to obtain a temporary use permit, as required by this section, shall file an application on a form provided by the town through the director of code enforcement.
(2)
The director of code enforcement reviews and approves temporary use permits. The director shall determine that the proposed use complies with the requirements of this section of this ordinance.
(3)
Every temporary use shall comply with this ordinance and all local regulations. The director of code enforcement may impose additional conditions as part of the temporary use approval to achieve the purposes of this ordinance and to protect the public health, safety and welfare. No temporary use is permitted in any district if it would have a significant negative impact on any adjacent property or on the area as a whole.
13.102. General provisions: Every temporary use shall comply with all the requirements below:
(1)
A temporary use that causes, or threatens to cause, an on-site or off-site threat to the public health, safety, and welfare is prohibited.
(2)
Every temporary use shall be operated in accordance with such restrictions and conditions as the Fire Department or other relevant entities may require.
(3)
No temporary use may block handicapped or fire lanes.
(4)
No temporary use may be permitted if it conflicts with another previously authorized temporary use for the same time frame.
13.103. Permitted temporary uses:
(1)
Recreational vehicle (RV) lots (temporary). This section regulates the temporary use and occupancy of recreational vehicles located on private property only for a specific period of time in conjunction with the Washington Parish Free Fair. This section does not apply to unoccupied recreational vehicles parked on private lots.
(a)
General regulations and application.
1.
Recreational vehicle (RV) defined: For the purpose of this section, a recreational vehicle (RV) includes: any motor home, vacation trailer, or any other vehicle licensed and capable of movement on a roadway which is fully self-contained with bathroom and cooking facilities.
2.
Recreational vehicles are only permitted to be occupied in the yards of private lots beginning the Saturday prior to the start of the fair through the Sunday following the close of the fair. Tent camping is not permitted.
3.
No recreational vehicle may encroach on the public right-of-way and may not obstruct the view of vehicular traffic.
4.
Property owners requesting to have up to three (3) recreational vehicles on their property must register, on a form supplied by the town, the RV's at least one (1) week prior to the start of the Washington Parish Free Fair. The property owner shall agree to comply with all of the design and performance standards in 13.103.b with the exception of the required installation of utilities (13.103.b.2).
5.
Property owners requesting to have more than three (3) recreational vehicles on their property must receive a temporary use permit. Applicants seeking a temporary use permit must submit an application no later than the close of business on July 1 of each year. All applicable fees shall be paid upon permit submittal.
6.
All applicants requesting more than three (3) RV spaces must submit a site plan and shall agree to comply with all of the design and performance standards in 13.103.b. including onsite utilities for all recreational vehicles. The site plan shall include:
a.
The number of recreational vehicles and their proposed location on the property.
b.
The boundaries and dimensions of the property and the general location of all existing utility connections, easements, property lines, existing streets, structures or waterways, and other significant physical features.
c.
Approximate location and sizes of sanitary and storm sewers, water mains, culverts, and all other utilities, including existing and proposed RV connections, and structures on the property.
d.
General location of parking and site circulation/traffic flow.
(b)
Design and performance standards.
1.
All recreational vehicles must be set back a minimum of five (5) feet from all property lines and ten (10) feet from all permanent structures.
2.
All recreational vehicles must be served by on-site utilities that are permitted and approved by the appropriate regulatory body or agency (sewer, water and electric).
3.
Any form of open burning is prohibited.
4.
Trash Collection is the sole responsibility of the property owner.
5.
No generators shall be used to provide electrical power to any recreational vehicle.
13.104. Non-conforming recreational vehicle lots (temporary):
[(1)]
All property owners that have maintained legally permitted temporary recreational vehicle lots in accordance with the Town of Franklinton regulations (including the installation of all required utility connections) prior to the adoption of the temporary recreational vehicle lot regulations in section 13.103(1) are considered legal non-conforming.
(2)
Legal non-conforming temporary recreational vehicle lots shall meet the general requirements and application process in 13.103(1)a. However, non-conforming temporary recreational vehicle lots are not required to comply with any of the standards regarding distance setbacks and open space in section 13.103(1)b, subject to the following conditions:
(a)
A property owner may not increase the area used for the temporary recreational vehicle lot or the number of permitted recreational vehicles. If a property owner wishes to increase the area of the lot or number of permitted RVs, the applicant will be required to conform to the requirements of section 13.103(1)b.
(b)
If a property owner fails to obtain a temporary use permit for a temporary recreational vehicle lot for one (1) year of the Washington Parish Free Fair, the property owner will be required to conform to all the requirements of this ordinance, including the design and performance standards in section 13.103(1)b, in any successive applications.
