- Amendments of the ordinance.
10.100. The Council may amend this Ordinance upon its own motion or upon petition.
10.101. Any citizen may petition for an amendment to this Ordinance.
10.102. Procedures for amending this Ordinance shall be as follows:
(1)
Petition submitted to the Zoning Commission by a citizen, or a motion for change may be originated by the Commission.
(2)
Notice of proposed amendment shall be published in the official journal of a public hearing on the matter three (3) times prior to such hearing. Person petitioning for a change to this ordinance must pay the cost of advertising at the time the application is received by the Town.
(3)
A public hearing is held by the Commission.
(4)
After a vote of the Commission, a recommendation to grant or deny is sent to the legislative body.
(5)
A simple majority of the legislative body may enact a change receiving a favorable recommendation by the Zoning Commission or may uphold an unfavorable recommendation of the Zoning Commission.
10.103. Zoning in case of enlargement of Municipal limits: Parties requesting annexation by the Town of Franklinton, including annexation requests by the Town of Franklinton itself, must submit the following information to the Planning and Zoning Commission:
(a)
Map of the area to be annexed showing the streets, boundaries, and property owners involved.
(b)
Any additional provisions of state law shall be followed if applicable.
When the Town of Franklinton extends its boundaries by incorporating additional acreage into its city limits, the property will be annexed into the city with an R-1 zoning designation. In the event already operating commercial or industrial business ventures are located within this newly annexed property, said property will be "grandfathered" with appropriate zoning designations so the already operating businesses will not be in violation of Town of Franklinton zoning regulations. If one (1) of these "grandfathered" businesses closes or is out of operation for six (6) months or longer, the property may revert to R-1 zoning designation if the surrounding area is used as predominately residential property or existing zone of surrounding properties. On occasion the town may extend its boundaries to incorporate additional land with the specific intention of adding a section of non-residential use acreage. In these instances, the property will be annexed into the Town with the appropriate zoning designations. Such newly designated districts shall constitute an amendment to this Ordinance.
All uses, yards, and lots in the newly annexed area that do not meet the requirements of this Ordinance will be considered "Grandfathered" and may continue to exist.
Any livestock on newly annexed property will be covered by grandfather classification. If property deed is transferred to another name no livestock will be allowed on property.
