CHAPTER 10

OP OFFICE PARK DISTRICT

10-10-1: PURPOSE:

The purpose of the OP office park district is to provide a controlled and protected environment for the development of professional offices and selected service activities at accessible locations in the village. The OP district is further intended to implement the village land use plan for land that is designated as office park. The OP district is not intended to allow any industrial, storage or retail businesses. In addition to the professional office and selected service uses that are permitted uses, other selected service uses which would not normally be appropriate in the OP district may be allowed as special uses with conditions specified by the village board of trustees to safeguard the public health, safety, morals and welfare. 10-10-2: APPLICABILITY OF PROVISIONS:

The regulations set out in this chapter include additional regulations over and above those regulations contained in any other provisions of this title. All uses within the OP district must conform to the regulations and performance standards described in this chapter. These regulations apply to both individual lots and to larger developments with multiple lots. In case of conflict between the regulations in this chapter and those of any other provisions of this title, the regulations in this chapter shall prevail unless the conflicting regulation of the other provisions of this title clearly requires a more stringent standard. 10-10-3: PERMITTED USES:

The OP district is designed to allow considerable latitude in the range of professional offices allowed; provided, that the uses are legal and no outdoor storage is conducted except as specifically provided for herein. Permitted uses are listed according to the standard industrial classification (SIC) manual published by the office of management and budget, 1987 edition. Three (3) copies of the 1987 SIC manual are on file in the office of the village clerk. If a particular use not listed or within the same classification codes as listed permitted use, it is not allowed within the OP district. In addition, any building used primarily for any of the uses listed in this section may have not more than forty percent (40%) of the floor area devoted to storage. Buildings or structures may be erected, altered or used for one or more of the following: (Ord. 98-36, 10-13-1998; amd. 2001 Code)
   A.   Transportation and communication uses, including only the following:
      Communications, including only the following:
      Telegraph and other message communications (all uses within SIC code 482 except radio, television and communication transmitting or relay towers, antennas and other similar structures).
      Telephone communications (all uses within SIC code 481 except radio, television and communication transmitting or relay towers, antennas and other similar structures).
      U.S. postal service (all uses within SIC code 43).
   B.   Depository institutions, including only the following:
      Central reserve depository institutions (all uses within SIC code 601).
      Commercial banks (all uses within SIC code 602).
      Credit unions (all uses within SIC code 606).
      Foreign banking (all uses within SIC code 608).
      Functions related to depository banking, including only the following:
      Functions related to depository banking, not elsewhere classified (all uses within SIC code 6099 except check cashing agencies).
      Nondeposit trust facilities (all uses within SIC code 6091).
      Savings institutions (all uses within SIC code 603).
   C.   Nondepository credit institutions, including only the following:
      Business credit institutions (all uses within SIC code 615).
      Federal and federally sponsored credit agencies (all uses within SIC code 611).
      Mortgage bankers and brokers (all uses within SIC code 616).
   D.   Security and commodity brokers, dealers, exchanges and services (all uses within SIC code 62).
   E.   Insurance carriers (all uses within SIC code 63).
   F.   Insurance agents, brokers and service (all uses within SIC code 64).
   G.   Real estate, including only the following:
      Real estate agents and managers (all uses within SIC code 653).
      Real estate operators (except developers) and lessors (all uses within SIC code 651).
      Subdividers and developers, except cemeteries (all uses within SIC code 6552).
      Title abstract offices (all uses within SIC code 654).
   H.   Holding and other investment offices (all uses within SIC code 67).
   I.   Tax return preparation services (all uses within SIC code 7291).
   J.   Business services, including only the following:
      Advertising including only the following:
      Advertising agencies (all uses within SIC code 7311).
      Advertising, not elsewhere classified (all uses within SIC code 7319).
      Radio, television, and publisher's advertising representatives (all uses within SIC code 7313).
      Computer programming, data processing, and other computer related services (all uses within SIC code 737).
      Consumer credit reporting agencies, mercantile reporting agencies, and adjustment and collection agencies (all uses within SIC code 732).
      Mailing, reproduction, commercial art and photography, and stenographic services including only the following:
      Commercial art and graphic design (all uses within SIC code 7336).
      Direct mail advertising services (all uses within SIC code 7331).
      Secretarial/court reporting services (all uses within SIC code 7338).
      News syndicates (all uses within SIC code 7383).
      Personnel supply services (all uses within SIC code 736).
   K.   Legal services (all services within SIC code 81).
   L.   Membership organizations, including only the following:
      Business associations (all uses within SIC code 861).
      Political organizations (all uses within SIC code 865).
      Professional membership organizations (all uses within SIC code 862).
   M.   Engineering, accounting, research, management, and related services, including only the following:
      Accounting, auditing, and bookkeeping services (all uses within SIC code 872).
      Commercial economic, sociological, and educational research (all uses within SIC code 8732).
      Engineering, architectural, and surveying services (all uses within SIC code 871).
      Management and public relations services including only the following:
      Business consulting services, not elsewhere classified (all uses within SIC code 8748).
      Management consulting services (all uses within SIC code 8742).
      Management services (all uses within SIC code 8741).
      Public relations services (all uses within SIC code 8743).
   N.   Services not elsewhere classified (all uses within SIC code 89).
   O.   Public administration, including only the following:
      Administration of economic programs, including only the following:
      Administration of general economic programs (all uses within SIC code 961).
      Regulation and administration of transportation programs (all uses within SIC code 962).
      Administration of environmental quality and housing programs (all uses within SIC code 95).
      Administration of human resources programs (all uses within SIC code 94).
      Executive, legislative, and general government, except finance (all uses within SIC code 91).

10-10-4: ACCESSORY USES AND STRUCTURES:

Uses and structures customarily accessory to a permitted use may be allowed. (Ord. 98-36, 10-13-1998)

10-10-5: SPECIAL USES:

Special uses may be allowed based on the provisions of section 10-16-4 of this title and the criteria for the following uses in this section:
   A.   Public utility substations and transmission facilities.
   B.   Roof mounted communication equipment.
   C.   Eating places (SIC code 5812), including only restaurant, coffee shop and similar on site food service. (Ord. 98-36, 10-13-1998)

10-10-6: SITE PLAN REQUIRED:

Site plan approval by the planning and zoning commission shall be required for all proposed developments within the OP district as provided for in chapter 13 of this title. (Ord. 98-36, 10-13-1998)

10-10-7: DIMENSIONAL REGULATIONS:

   A.   Lot Standards:
      1.   Minimum lot size: 20,000 square feet. (Ord. 98-36, 10-13-1998; amd. Ord. 2008-37, 11-25-2008)
      2.   Minimum lot width: 100 feet.
      3.   Minimum lot depth: 150 feet.
   B.   Yards:
      1.   Minimum front yard: 30 feet.
      2.   Minimum side yard: 15 feet.
      3.   Minimum rear yard: 20 feet.
   C.   Maximum Building Coverage: 35 percent.
   D.   Maximum Site Coverage: 70 percent.
   E.   Maximum Building Height: 45 feet.
   F.   Maximum Floor Area Ratio: 0.5.
   G.   Minimum District Size: 5 acres. (Ord. 98-36, 10-13-1998)

10-10-8: SITE DESIGN STANDARDS:

   A.   Landscaping:
      1.   Trees: Trees in the front yard shall be deciduous hardwood trees which are disease resistant, salt tolerant and which will provide a minimum six foot ( 6') clear trunk when installed.
      2.   Screening Required: Screening shall be provided for dumpsters, loading areas, and utility facilities. Screening shall be in the form of walls, landscaping, earth berms or a combination thereof. The minimum height of such screening shall be six feet (6'), although this minimum may be increased if a higher minimum height is deemed necessary by the planning and zoning commission.
      3.   Parking Areas: All parking areas shall be landscaped. A minimum of five percent (5%) of the total parking area shall contain planting areas for landscaping. Interior landscape islands shall be a minimum of six feet (6') in width from face of curb to face of curb and include a minimum of two - two and a half (2-1/2)-inch caliper deciduous shade tree every twenty (20) parking spaces.
      4.   Buffers For Tracts Abutting Residential Areas: Any tract or site abutting a residential zoning district shall provide a buffer yard of twenty-five feet (25'). The buffer area resulting from these setback requirements shall be landscaped and include other screening devices such as fences, berms, etc. as deemed appropriate by the planning and zoning commission.
   B.   Performance Standards:
      1.   All operations shall take place within a fully enclosed building.
      2.   All overnight parking and storage of materials, equipment, commercial and recreational vehicles shall be within a fully enclosed building. (Ord. 98-36, 10-13-1998; amd. Ord. 2023-32, 11-14-2023)
