A.   Purpose And Intent:

      1.   The purpose of this section is to ensure that an adequate, safe and convenient arrangement of pedestrian circulation facilities, roadways, driveways, off-street parking and loading spaces are provided on every site requiring site plan approval. Such roads, pedestrian walks and off-street parking and loading facilities shall be designed as an integral part of an overall site design and shall be properly related to existing and proposed buildings and appropriate landscaping. Parking facilities shall be landscaped and screened to the extent necessary to eliminate unsightliness and monotony of large concentrations of parked cars. Parking facilities shall be designed with careful regard to orderly arrangement, topography, landscaping, and ease of access and shall be developed as an integral part of an overall site design. Any aboveground loading facility shall be screened from public view to the extent necessary to eliminate unsightliness.

      2.   Off-street parking spaces shall be required for all uses in all zoning districts. Off-street loading facilities shall be provided as required by subsection H of this section. Within this chapter, references to parking facilities include parking lots and parking garages.

   B.   Procedure: Every site plan application for the construction or improvement of a parking and/or loading facility shall include therewith a concept landscape plan, drawn to scale, showing any off-street parking or loading facilities and related site improvements and landscaping.

   C.   Increased Or Decreased Parking Demand:

      1.   Increased Parking Demand: When any building, structure or site undergoes a change of use or any increase in the number of dwelling units, floor area, seating capacity or other unit of measurement specified hereinafter as a means for determining required off-street parking or loading facilities, and when such a change or increase would, through application of the provisions of these standards thereto, result in a requirement for greater total off-street parking and/or loading spaces, such off-street parking and/or loading facilities shall be increased to equal or exceed the off- street parking and loading requirements resulting from application of the provisions of these standards to the entire building, structure or site as modified in use or capacity.

      2.   Decreased Parking Demand: When a building, structure or site undergoes a decrease in the number of dwelling units, floor area, seating capacity or other unit of measurement specified hereinafter as a means for determining required off-street parking and loading facilities, or when the application of the standards herein would result in a requirement for fewer total off-street parking and/or loading spaces than are provided on the subject site, the available off-street parking and/or loading facilities may be so reduced accordingly; provided, that existing off-street parking and loading remaining would equal or exceed the off- street parking and loading requirements resulting from application of the provisions of these standards to the entire building, structure or site as modified.

   D.   General Provisions:

      1.   Repair, Service Or Sales Use Of Parking Facilities Prohibited: No required off-street parking or loading facilities shall be utilized for motor vehicle repair work, service, display or sales of any kind, except as expressly permitted elsewhere in this title.

      2.   Use Of Required Parking As Commercial Or Public Lot Prohibited: No area designated as a required parking area in connection with any designated building, structure, site or use shall be operated as a commercial or public parking facility providing parking spaces for the general public.

      3.   Entries And Exits: All entrances and exits to parking and loading areas from a public right of way shall be subject to specific approval by the planning and zoning commission by site plan approval in accordance with this chapter in order to ensure the smooth and safe circulation of vehicles to and from the public street system. The number of entrances and exits shall be limited to one entrance and one exit or one combined entrance and exit per three hundred (300) linear feet of street frontage unless additional entrances and/or exits are deemed necessary by the planning and zoning commission. Except for single-family residential dwellings and duplexes, all parking access shall be designed to prevent the need to back directly onto a public road or right of way.

      4.   Location Of Parking And Loading Spaces: All required off- street parking or loading spaces shall be provided on the same parcel of land occupied by the use or building to which it is appurtenant; provided, however, that where there are, in the judgment of the planning and zoning commission, practical difficulties in satisfying the requirement for parking space and/or if the public safety or convenience would be better served by another location, the planning and zoning commission may authorize an alternative location for any portion of the required parking for a nonresidential use which will adequately serve the public interest, subject to the following conditions:

         a.   Required accessory off-street parking facilities may be provided elsewhere than on the lot on which the principal use served is located and shall not exceed twenty percent (20%) of the total parking required; provided, that the property occupied as parking is in the same possession, either by deed, by easement, or by long-term lease which has a term equal to or exceeding the projected life of the facility occupied by the principal use; and further provided, that the owner shall be bound by covenants filed on record in the office of the county recorder of deeds, requiring the owner and his or her heirs and assigns, as well as subsequent owners, heirs or assigns, to maintain the required number of off-street parking spaces during the existence of such principal use.

         b.   Accessory off-street parking shall be available within a walking distance of not more than five hundred feet (500') measured from the nearest property line of the premises to the nearest part of the accessory parking area.

         c.   Such separated parking space shall be usable without causing unreasonable traffic congestion, detriment to any residential neighborhood or hazard to pedestrians or vehicular traffic.

      5.   Zoning Of Accessory Parking Areas: All accessory off-site parking facilities, whether provided in fulfillment of or in excess of the requirements of this chapter, and whether located on the same or on a different lot from the principal use as provided in subsection D4 of this section, shall be located on nonresidentially zoned property.

      6.   Joint Parking Facilities: Off-street parking facilities for different buildings, structures or uses, or for mixed uses, may be provided and used collectively or jointly in any zoning district in which separate off-street parking facilities for each constituent use would be permitted, subject to the following provisions:

         a.   The total number of spaces so located together is not less than the sum of the separate requirements for each use except as provided by subsections D6c and D6d of this section and subsection G7 of this section, entry reading "Motion Pictures, Multi-plex motion picture theaters".

         b.   A legally sufficient written agreement assuring the perpetual joint usage of said common parking for the combination of uses or buildings is properly drawn and executed by the parties concerned, approved as to form and execution by the village attorney, and filed with and made part of the application for a building permit.

         c.   Up to fifty percent (50%) of the parking spaces required for a theater (unless the theater's required parking spaces are based on the provisions of subsection G7 of this section, entry reading "Motion Pictures, Multi-plex motion picture theaters", or other place of evening entertainment, for a church, or for multi-family dwelling units may be provided and used jointly by banks, offices, retail stores, repair shops, service establishments and similar uses not normally open, used or operated during evening hours if specifically approved by the planning and zoning commission; and provided, however, that written agreement assuring the retention for such purpose shall be properly drawn and executed by the parties concerned, approved as to form and execution by the village attorney, and shall be filed and made part of the application for a building permit. Such approval may, with fifteen (15) days' prior written notice, be rescinded by the village board of trustees, and additional parking shall be obtained by the owners in the event that the village board of trustees determines that such joint use is resulting in a public nuisance or is otherwise adversely affecting the public health, safety or welfare.

         d.   Land uses which do not meet the criteria of subsection D5 of this section but which can clearly demonstrate the ability to successfully provide joint parking facilities to the satisfaction of the planning and zoning commission may be permitted to share up to fifty percent (50%) of their required parking spaces; provided, that written agreement assuring the retention for such purpose shall be properly drawn and executed by the parties concerned, approved as to form and execution by the village attorney, and shall be filed and made part of the application for a building permit. Such approval may, with fifteen (15) days' prior written notice, be rescinded by the village board of trustees, and additional parking shall be obtained by the owners in the event that the village board of trustees determines that such joint use is resulting in a public nuisance or is otherwise adversely affecting the public health, safety or welfare.

   E.   Design And Maintenance Standards:

      1.   Size Of Parking Spaces: The following schedule of parking space and layout standards shall apply to all parking facilities provided in the village in accordance with this chapter. Each parking space shall provide seven feet (7') of vertical clearance. Parallel parking spaces shall have minimum dimensions of eight feet wide by twenty three feet long (8' x 23').

      2.   Reduction In Space Size: The planning and zoning commission may approve the use of continuous concrete curbs as wheel stops and thus measure the size of parking spaces to be two feet (2') less in length than otherwise required. In such instances, the parking layout should allow for the vehicle to overhang the curb by two feet (2'), and such overhang area must be clear of all obstructions (signs, trees, etc.) and may not be regarded as required landscape area or pedestrian circulation space.

      3.   Parking Surface And Drainage: All open off-street parking areas, except those accessory to one- or two-family dwellings, shall be improved with a compacted select rock base, surfaced with an all-weather, dustless material suitably designed for the intended use, to a standard approved by the village. Such material shall not include oil and chip. Parking and loading facilities shall be provided with adequate storm water drainage facilities to prevent damage or inconvenience to abutting property and/or public streets and alleys.

      4.   Pavement Marking: All parking spaces shall be marked by durable painted lines at least four inches (4") wide and extending the length of the space or by curbs or other means to indicate individual spaces. Handicapped parking spaces shall be identified through the use of light blue painted lines (see subsection F3 of this section). Signs or markers located on the surface within a parking facility shall be used as necessary to ensure efficient and safe traffic operation on the facility.

      5.   Lighting: Any off-street parking or loading area used between six o'clock (6:00) P.M. and six o'clock (6:00) A.M. shall contain a system of lighting to provide an adequate standard of at least one foot-candle of illumination over the area of the parking area to be used. All lighting shall be arranged to deflect, shade and focus lights away from adjacent properties, shall be designed so as not to create more than one foot-candle of illumination at any property boundary abutting a residential zoning district and shall comply with all provisions of section 10-13-3 of this chapter. Any land use which utilizes an off-street parking or loading area between six o'clock (6:00) P.M. and six o'clock (6:00) A.M. an average of less than four (4) days per month may be exempted from this requirement by the planning and zoning commission.

      6.   Screening And Landscaping: All parking and loading areas shall be landscaped and provide screening in accordance with the requirements of section 10-12-1 of this title.

      7.   Signs: Parking direction and regulation signs may be provided in accordance with chapter 15 of this title showing the ownership of any parking facility and the permitted use thereof. If the lot is so operated that a charge is made for the use of the parking facilities, the rates for parking shall be legibly shown upon the parking regulation sign.

      8.   Attendant Shelter: A shelter for the use of a parking facility attendant may be maintained on the lot, provided the location, construction and design of same shall be first approved by the Planning and Zoning Commission.

      9.   Maintenance: Any person operating or owning a parking facility shall keep it free, as may be practical, of dust and loose particles and shall promptly remove the snow and ice from the surface of the parking facility. Such person shall also keep all adjacent sidewalks free from dirt, ice, sleet and snow and shall keep the sidewalks in a safe condition for use by pedestrians. All signs, markers or any other methods used to indicate direction of traffic movement and location of parking spaces shall be maintained in a neat and legible condition. Likewise any walls, landscaping, including trees and shrubbery, as well as surfacing and curbing of the parking facility, shall be maintained in good condition throughout its use for parking purposes, and the Zoning Administrator shall have the authority to prohibit the use of the area for parking purposes, after fifteen (15) days' written notice, unless and until proper maintenance, repair or rehabilitation is completed, including the replacement of any landscaping material which may die from time to time, or the failure of the landscape irrigation or surface drainage system within the parking area.

      10.   Recreational Vehicles or Boats: With the exception of travel trailer parks and commercial establishments engaged in the sale of recreational vehicles or boats, recreational vehicles and boats shall be parked to comply with the following regulations:

         a.   Not more than one recreational vehicle or one boat shall be parked on any lot.

         b.   No recreational vehicle or boat shall be used as a dwelling.

         c.   No recreational vehicle or boat shall be used as an office or for any other commercial purposes.

         d.   No recreational vehicle or boat shall be parked in front of the front facade of an existing residence, either in the front yard or driveway, on any lot. Recreational vehicles or boats may be parked in the side and rear yards.

      11.   Paving Of Residential Parking Spaces: The required off-street parking spaces for any residential use shall be paved with concrete, asphaltic concrete or brick. Any parking space constructed or designated after the effective date of this title, and the driveways between such spaces and the street, shall be similarly paved.

      12.   Trailers: the parking of any trailer within any Residential Zones and Uses of the village, shall comply with the following regulations:

         a.   No more than one trailer or recreational vehicle shall be parked on any lot or parcel at any one time.

         b.   No commercial equipment stored on any trailer shall be visible from any public street or right-of-way.

         c.   No trailer shall be parked in front of any existing residence on any lot or parcel, except during the time of actually loading or unloading the trailer. Trailers may be parked for storage only in the side or rear yards.

   F.   Additional Parking Requirements:

      1.   Computing Number Of Required Off-Street Parking Spaces: In computing the number of required off-street parking spaces, the following rules shall apply:

         a.   "Floor area" shall mean the gross leasable area of the entire building of the specific use, excluding any floor or portion thereof used for parking.

         b.   Where fractional spaces result, the parking spaces required shall be the next greater whole number.

         c.   In the case of mixed uses, the parking spaces required shall be computed separately for each use except as provided in subsections D6c and D6d of this section and subsection G7 of this section, entry reading "Motion Pictures, Multi-plex motion picture theaters".

         d.   All required parking shall be available at all times for the use for which the parking is required except as specifically provided by this chapter.

         e.   In the case of bench seating, such as pews in a place of worship, twenty four (24) lineal inches of bench seating shall equate to one seat.

         f.   For residential uses, off-street parking requirements can be met through the use of a garage and/or paved parking spaces located outside of any right-of-way.

         g.   If a specific land use is not included in the list of uses for which parking space requirements are specifically listed, then the required parking for that use shall be determined by using the required parking for the most similar use in its two (2) digit standard industrial classification (SIC) code.

      2.   Parking Garages:

         a.   Required off street parking spaces may be provided within parking garages; provided, that all other provisions of this chapter are met.

         b.   Every part of a parking garage situated above ground level shall comply with the building setback requirements of the specific zoning district in which it is located. Those portions of a parking garage located below ground level may encroach into this setback; provided, that no part of the parking garage extends into a public right of way or crosses any other property line.

         c.   Within parking garages, parking space width shall be measured from the base of structural columns rather than from the center of such columns.

      3.   Parking For Handicapped Persons:

         a.   Americans With Disabilities Act: All applicants for site plan approval for a new or changed development should be aware of the requirements of the Americans with disabilities act (ADA) of 1990, including provisions of the act which were effective as of January 26, 1992.

         b.   Size Of Parking And Access Spaces: Handicapped parking spaces shall be a minimum of eight feet (8') in width, and each space shall have access to an eight foot (8') wide access aisle or a sixteen foot (16') space with an eleven foot (11') wide parking stall and a five foot (5') access space.

         c.   Detectable Warnings On Walking Surfaces: Detectable warnings shall consist of raised truncated domes with a diameter of nominal 0.9 inch (23 mm), a height of nominal 0.2 inch (5 mm) and a center to center spacing of nominal 2.35 inches (60 mm) and shall contrast visually with adjoining surfaces, either light on dark, or dark on light.

         d.   Detectable Warnings At Hazardous Vehicular Areas: If a walk crosses or adjoins a vehicular way, and the walking surfaces are not separated by curbs, railings, or other elements between the pedestrian areas and vehicular areas, the boundary between the areas shall be defined by a continuous detectable warning which is 36 inches (915 mm) wide, complying with subsection F3c of this section.

   G.   Schedule Of Off Street Parking Spaces:

 

   H.   Additional Off Street Loading Requirements:

      1.   Purpose And Intent:

         a.   It is the village's intent to require sufficient off street loading areas and to ensure that such areas are located in a convenient location out of sight of the general public to the extent feasible. Such off street loading areas shall be located at the rear of the building whenever practical.

         b.   Off street loading areas shall be provided for every use identified in subsection H3 of this section. Loading areas which are utilized for the location of trash collection or compaction units shall be provided for and shall be in addition to the loading space requirements provided in subsection H3 of this section.

      2.   Dimensions Of Spaces: Loading spaces shall have minimum dimensions of twelve feet (12') in width by thirty five feet (35') in length with a vertical clearance of at least fourteen feet (14'). In addition, some uses may be required to provide loading zones of at least sixty feet (60') in length to accommodate large tractor-trailers.

      3.   Schedule Of Off Street Loading Spaces:

 

   I.   Bicycle Parking Requirements: The provisions of this subsection shall be known as the BICYCLE PARKING REQUIREMENTS. The purpose of these regulations is to require secure and adequate short term parking for bicycles, thereby promoting alternative transportation, providing additional, more sustainable transportation choices for residents and commuters, and reducing traffic congestion and air pollution. These requirements shall apply to the indicated activities as specified hereinafter.

      1.   Bicycle Parking Required For New Commercial Uses: Bicycle parking shall be required for new facilities. Bicycle parking as prescribed hereafter shall be provided for activities occupying facilities, or portions thereof, which are constructed, established, or moved onto a new lot after the effective date of this bicycle parking requirement, or of a subsequent rezoning or other amendment thereto establishing or increasing bicycle parking for such activities, except to the extent that existing bicycle parking exceeds such requirement for any existing facilities. The required amount of new bicycle parking shall be provided at a minimum of two (2) bicycle parking spaces for each commercial use.

      2.   Standards For Required Bicycle Parking And Types Of Required Bicycle Parking:

         a.   Bicycle Parking: Bicycle parking shall consist of a bicycle rack or racks and is meant to accommodate visitors, customers, messengers, and others expected to park not more than two (2) hours.

      3.   Minimum Specifications For Required Bicycle Parking:

         a.   All bicycle parking facilities shall be dedicated for the exclusive use of bicycle parking.

         b.   All required bicycle parking spaces shall permit the locking of the bicycle frame and one wheel with a U-type lock, support the bicycle in a stable position without damage to wheels, frame, or components, and provide two (2) points of contact with the bicycle's frame.

         c.   Bicycle parking facilities shall be securely anchored so they cannot be easily removed and shall be of sufficient strength and design to resist vandalism and theft.

      4.   Location And Design Of Required Bicycle Parking: Required bicycle parking shall be placed on site(s) as set forth below:

         a.   A bicycle parking space shall be at least two and a half feet (2.5') in width by six feet (6') in length to allow sufficient space between parked bicycles.

         b.   An encroachment permit shall be required from the village to install bicycle parking in the public right of way.

         c.   Bicycle parking facilities shall not impede pedestrian or vehicular circulation.

            (1)   Bicycle parking racks located on sidewalks should maintain a minimum of five and one-half feet (5.5') of unobstructed pedestrian right of way outside the bicycle parking space.

         d.   Bicycle parking facilities are subject to the following standards:

            (1)   Racks shall be located with at least thirty inches (30") in all directions from any vertical obstruction, including, but not limited to, other racks, walls, and landscaping. General food sales and large scale combined retail and grocery sales activities are encouraged to locate racks with a thirty six inch (36") clearance in all directions from any vertical obstruction, including, but not limited to, other racks, walls and landscaping.

            (2)   A minimum of a four foot (4') wide aisle of unobstructed space behind all required bicycle parking shall be provided to allow for adequate bicycle maneuvering.

         e.   Bicycle parking facilities within auto parking facilities shall be protected from damage by cars by a physical barrier such as curbs, wheel stops, poles, bollards, or other similar features capable of preventing automobiles from entering the bicycle facility.

         f.   Bicycle parking facilities shall be located in highly visible well lighted areas. In order to maximize security, whenever possible bicycle parking facilities shall be located in areas highly visible from the street and from the interior of the building they serve (i.e., placed adjacent to windows).

         g.   The location and design of required bicycle parking shall be of a quality, character and color that harmonize with adjoining land uses. Required bicycle parking shall be incorporated whenever possible into building design or street furniture.

         h.   Whenever any required bicycle parking is proposed to be provided on a lot other than the lot containing the activity served, the owner or owners of both lots shall prepare and execute to the satisfaction of the village attorney, and file with the Madison County recorder, an agreement guaranteeing that such facilities will be maintained and reserved for the activity served, for the duration of said activity.

         i.   Bicycle parking shall be placed within fifty feet (50') of the main entrance to the building or commercial use and should be in a well trafficked location visible from the entrance. When the main entrance fronts the sidewalk, the installer shall obtain an encroachment permit from the village to install the bicycle parking in the public right of way. The main building entrance excludes garage entrances, trash room entrances, and other building entrances that are not publicly accessible.

      5.   Minimum Number Of Required Bicycle Parking Spaces Calculation Rules:

         a.   Each commercial establishment shall provide a minimum of two (2) parking spaces as prescribed by this title.

      6.   Automobile Parking Credit: The total number of required off street automobile parking spaces may be reduced at the ratio of one automobile space for each six (6) bicycle spaces provided in excess of the requirements of this chapter. The bicycle parking provided for this automobile parking credit shall include bicycle parking in proportion to the minimum requirements for the given project. The total number of required off street automobile parking spaces cannot be reduced by more than five percent (5%).    A.   Applicability Of Provisions:

      1.   Applicable Zoning Districts: An approved site plan is required in the A-1, RS-10, RT and RM districts for the development or redevelopment of any parcel of land proposed for any land use except single-family dwellings, uses customarily accessory to a single-family dwelling and agricultural uses which do not involve additional impervious surfaces. All proposed developments in the MED, CN, CG, CM, IL and OP districts shall be required to submit a site plan. The purpose of the site plan review procedures is to enable the village to consider potential impacts upon the area in the vicinity of the property, consistency with good planning practices, and to ensure high standards of site and building design for the general welfare of the village and its residents.

      2.   Types Of Site Plans:

         a.   Site plans shall be divided between major and minor site plans.

            (1)   Major site plans shall follow the procedures outlined in this section. A "major site plan" is defined as a plan for the development of a parcel of land that contains no buildings or for which the existing buildings are to be removed and a new building or buildings constructed. In addition, a major site plan shall be required for any development that is adding more than five thousand (5,000) square feet of new impermeable surface to a site. A major site plan must be approved by the planning and zoning commission.

            (2)   "Minor site plans" shall be defined as plans for the expansion, change in use, or redevelopment of a site that already contains a building or buildings and shall not consist of any development which adds more than five thousand (5,000) square feet of new impermeable surface to a site. A minor site plan may be approved by the director of community development if it meets all of the requirements of this title.

         b.   Within this section, references to site plans include requirements for both major and minor site plans. Requirements that deal specifically with major site plans or minor site plans are so indicated.

         c.   The procedure for obtaining approval of a major site plan includes: 1) the filing of an application with the site plan; 2) the review and comments by village departments; 3) review of the site plan and comments from village departments by the planning and zoning commission; and 4) approval of the site plan by the planning and zoning commission.

      3.   Relationship To Other Ordinance Requirements: The requirements, procedures and standards contained in this section are in addition to the requirements, procedures and standards contained in other sections of this title which shall remain applicable to the parcel for which the application is filed. In case of conflict between the general provisions and district regulations of this title with provisions of this section, the more restrictive requirement shall control.

   B.   Application, Review And Approval Of Site Plan:

      1.   Application:

         a.   An applicant shall confer with the director of community development, or the administrator's designee, to become familiar with the village's regulations and requirements affecting the district in which the parcel in question lies and shall obtain copies of all provisions of the village ordinances pertaining to procedures and requirements for site plan approval.

         b.   An application may be made by the owner or by any person with a contractual interest in the property. Written consent of the owner shall be required if the applicant is not the owner. All owners must join if more than one.

         c.   The written application for review and approval of the site plan shall be filed on a form supplied by the director of community development and shall be accompanied by a site plan as described in subsection C of this section. The application shall be signed by the applicant and shall state the name and address of the applicant and of the owner. If the applicant is not the owner, the application shall identify the applicant's specific contractual interest in the property. A fee for reviewing the site plan shall be paid to the village at the time of filing the application.

      2.   Review Of Application:

         a.   Upon receipt of an application completed in satisfactory form, the director of community development shall deliver a copy of the application and accompanying papers, including the site plan, to the appropriate village departments for their review and comments on the impact of the proposed development on health, safety, traffic, public services or facilities and other relevant considerations, in both the area of the project, and other areas of the village which may be affected. Such comments shall be sent to the director of community development and forwarded to the applicant within twenty one (21) days of the receipt of the completed application.

         b.   Within twenty one (21) days from the forwarding of comments to the applicant, the applicant shall advise the director of community development of the applicant's desire to revise the application and site plan based on the village's comments or proceed to a review by the planning and zoning commission if the application is for a major site plan. If the applicant opts to proceed to a review of the major site plan by the planning and zoning commission, the application shall be placed on the agenda of the next available meeting of the commission. If the applicant opts to revise the major site plan, the previously outlined review periods will be repeated.

      3.   Major Site Plan Approval: The planning and zoning commission shall review the major site plan at a regular meeting, and the major site plan shall be approved, disapproved, or approved with conditions. In determining whether to approve, disapprove, or approve the major site plan with conditions, the planning and zoning commission shall consider:

         a.   All relevant information, including the comments of village officials, the major site plan's consistency with good planning practices, its compatibility with adjacent developments and uses, and its effect on the health, safety, morals and general welfare of the residents of the area in the vicinity of the property subject to the major site plan and upon the residents of the village generally.

         b.   The likely effect of the major site plan on vehicular or pedestrian traffic, fire hazards, fire, police and utility services, municipal expenditures, surface water drainage and control facilities and environmental aspects.

      4.   Minor Site Plan Approval, Disapproval And Appeal: The director of community development may approve a minor site plan if the site plan complies with all requirements of this title. If the director of community development denies approval of a minor site plan, including the provision of written comments as to the reason for such denial, the denial may be appealed by the applicant to the planning and zoning commission for review. The planning and zoning commission shall then approve the minor site plan, approve the minor site plan with conditions, or deny the site plan.

      5.   Validity Of Site Plan: Approval of a site plan shall be valid for a period of twelve (12) months from the date of approval by the village. If no building permit is obtained during that period, the approval shall terminate. The planning and zoning commission may grant extensions of time not to exceed twelve (12) months each, upon written request of the applicant for a substantially similar major site plan; provided, that the request is filed prior to the expiration date. The planning and zoning commission may attach new conditions when an extension is granted. If, in the opinion of the planning and zoning commission, the application contains substantial changes to the originally approved plan, a new major site plan review process must occur including the payment of a new application fee. The same procedure shall be followed by the director of community development for minor site plans.

   C.   Content Of Site Plan:

      1.   Contents: A site plan and/or development agreement shall include, but not be limited to, the following:

         a.   The location of the parcel in relation to surrounding uses, buildings, and zoning;

         b.   The location of the parcel in relation to major thoroughfares, and any roadways or drives connecting the parcel to those major thoroughfares;

         c.   The boundaries, dimensions and area of the parcel;

         d.   The proposed use and development of the parcel, including principal and accessory uses;

         e.   The location and size of each existing structure on the parcel;

         f.   The footprint of each proposed building or structure on the parcel;

         g.   The height and number of stories of proposed buildings and structures;

         h.   The amount of land area covered by buildings, structures, drives and parking facilities;

         i.   The form of proposed buildings and structures, including plan and elevation views;

         j.   A concept landscape plan, including a detailed drawing to scale and a corresponding schedule of all plant material to be provided;

         k.   The location, general design, and width of existing and proposed driveways and curb cuts;

         l.   The location, dimensions, and number of proposed parking spaces;

         m.   The location and size of loading areas;

         n.   The location and size of existing and proposed utilities including water, storm sewer, sanitary sewer, gas and electric; and all proposed and existing utility easements as well as right of way;

         o.   The location of refuse collection facilities and related screening;

         p.   The type, size and location of all signs;

         q.   Road ROW dedication may be required and identified on site plan;

         r.   Preliminary grades for entrances and parking areas to be submitted for review;

         s.   If necessary, cross easement access will be required to adjacent properties;

         t.   No overnight parking of tractor trailers or vehicles "for sale" will be allowed on the site. Statement to be placed on the site plan;

         u.   Submit plans for open detention area screening;

         v.   Submit drainage calculations;

         w.   Parking lot lighting plans are to be in conformance with the zoning ordinance and submitted with architectural plans and shown on the site plan;

         x.   Statement that off site road improvement fees may be assessed to the site;

         y.   Construction vehicle parking area is to be identified on the site plan;

         z.   Construction material storage area is to be identified on the site plan;

         aa.   Site plan shall identify all off site driveways and streets adjacent to the proposed site;

         bb.   A digital copy of the site plan, as approved by the village board of trustees, will be provided in AutoCad format;

         cc.   The cover sheet for the site plan shall provide the following information:

            (1)   Name of the proposed development.

            (2)   Name and address of the developer.

            (3)   Name and address of the property owner(s).

            (4)   Name and address of project engineer.

            (5)   Parcel identification number.

            (6)   Accurate metes and bounds or other adequate legal description of the tract.

            (7)   Preparation date.

            (8)   Revision dates.

            (9)   A statement for recording of the site plan by the Madison County recorder.

            (10)   A statement for approval of the village of Glen Carbon as follows:

   CERTIFICATION

         dd.   The location, dimension, and number of proposed bicycle parking spaces.

      2.   Site Plan Drawings: The scale for all drawings shall be no smaller than one inch equals fifty feet (1" = 50'), and the drawings shall contain the project name, street names, a scale, north arrow, and the date drawn.

      3.   Staff Review: The director of community development may forward a copy of the proposed site plan to the village's consulting engineer for review and to appropriate village staff and officials. Comments from the village's consulting engineer will be submitted to the director of community development and included in a staff review report submitted to the planning and zoning commission.

      4.   Building And Development Committee Review: The building and development committee shall consider the site plan application and all required submittals prior to the proposal being considered by the planning and zoning commission.

Recommendations and requirements shall be forwarded to the planning and zoning commission for further review and consideration.

      5.   Planning And Zoning Commission Approval Or Disapproval: After the public meeting, the planning and zoning commission shall, within thirty (30) days, recommend approval or disapprove the site plan application. The planning and zoning commission may grant said approval with conditions to ensure compliance with all village ordinances and administrative procedures. The planning and zoning commission will provide a written recommendation for approval or disapproval and forward said recommendation to the village board of trustees.

      6.   Board Of Trustees Approval Or Disapproval: All site plans must be approved by the board of trustees prior to recording. In reviewing a site plan, the board of trustees shall consider the recommendation for approval or disapproval by the planning and zoning commission. The board of trustees shall review the site plan and approve or disapprove. If the board of trustees approves the site plan, they may attach conditions to such approval necessary to ensure compliance with all village ordinances and administrative procedures. If the board of trustees disapproves a site plan, they shall provide written findings for such disapproval, including areas where the proposed site plan does not conform to the village comprehensive plan, zoning ordinance, subdivision regulations, other applicable village ordinance, or other specific written administrative rules or specifications.

      7.   Director of Community Development Final Review: Subsequent to the approval of the board of trustees, three (3) paper copies of the site plan, and one copy of the site plan on a reproducible Mylar shall be submitted to the director of community development for final review. No final approval shall be endorsed on the site plan until a review has indicated that all requirements of the village board have been met.

      8.   Recording Site Plan:

         a.   The president of the board of trustees will sign the reproducible Mylar original of the site plan and two (2) sepia prints of the site plan. The sepia prints will be returned to the applicant's engineer.

         b.   It shall be the responsibility of the applicant to file the site plan with the county recorder of deeds within ten (10) days of the date of signature. Simultaneously with the filing of the site plan, the village attorney shall record any other legal documents as shall be deemed necessary to be recorded by the village attorney.

   D.   Maintenance Of Constructed Improvements: Buildings, structures, landscaping and other improvements shall be constructed, installed, and maintained in accordance with the site plan as approved by the village board. It shall be the duty of the owner of the property to maintain such improvements. (Ord. 96-21, 9-10-1996; amd. 2001 Code; Ord. 2007-20, 7-10-2007; Ord. 2008-37, 11-25-2008; Ord. 2025-19, 5-27-2025)

   A.   General Standards:

      1.   The light from any luminaire (the light source and its enclosure, including any reflectors or other devices for the control of light, but excluding bracket arms or posts for support or mounting) shall be shaded, shielded or directed to prevent direct light from being cast upon any adjacent property and to prevent glare or other objectionable problems to surrounding areas.

      2.   In residential districts (districts beginning with the letter "R"), lighting fixtures, except traffic signals and lighting for major outdoor recreation facilities, shall not exceed sixteen feet (16') in height, unless specifically permitted by site plan approval by the planning and zoning commission or permitted by special use permit issued by the village board of trustees.

      3.   In nonresidential districts (any district not beginning with the letter "R"), lighting fixtures, except for traffic signals and lighting for major outdoor recreation facilities, shall not exceed twenty four feet (24') in height unless specifically permitted by site plan approval by the planning and zoning commission or permitted by special use permit issued by the village board of trustees. The twenty four foot (24') height limitation shall be reduced to sixteen feet (16') for any lighting fixture within fifty feet (50') of residentially zoned property unless specifically permitted by site plan approval.

      4.   No luminaire shall have any blinking, flashing or fluttering lights or other illuminating device which has a changing light intensity, brightness or color, nor shall any beacon lights be permitted.

      5.   Neither the direct nor reflected light from any luminaire shall create a disabling glare causing traffic hazards to motor vehicle operators on public thoroughfares.

   B.   Major Outdoor Recreation Facilities: Lighting systems and standards for major outdoor recreation facilities as determined by the planning and zoning commission, such as athletic fields or stadiums, shall require approval of a special use permit in accordance with section 10-16-4 of this title.    A.   Sewer System 1 : Whenever public sanitary sewerage is available within two hundred feet (200') of a structure to be used for human occupancy, employment, recreation or other purposes, such structure shall be connected to the public sanitary sewerage.

   B.   Water System: All structures to be used for human occupancy, employment, recreation or other purposes, constructed after the effective date of this title, shall be connected to a public water system. (Ord. 96-21, 9-10-1996)
