CHAPTER 5

AGRICULTURAL DISTRICTS

10-5A-1: PURPOSE:

The purpose of the A-1 agricultural district is to provide areas for farms and closely related agricultural uses as well as uses requiring large amounts of land. It is further intended to provide for residential uses on relatively large tracts of land which may accommodate farm related accessory uses such as the breeding, raising and keeping of one or more varieties of animals. The A-1 district is considered consistent with and designed to implement the provisions of the comprehensive plan for land designated as nonurban lands on the village land use plan map. The A-1 district may also be established in areas of the village designated as low density residential on the land use plan map if the property is currently devoted to agricultural use. 10-5A-2: PERMITTED USES:

The A-1 district is designed to allow considerable latitude in the range of agricultural uses allowed; provided, that the uses are legal and that certain agricultural activities maintain a reasonable setback from adjacent residentially zoned property. Some permitted uses are listed according to the standard industrial classification (SIC) manual published by the office of management and budget, 1987 edition. Three (3) copies of the 1987 SIC manual are on file in the office of the village clerk. If a particular use is not listed or within the same classification code as a listed permitted use, it is not allowed within the A-1 district. Buildings or structures may be erected, altered or used and land may be used for one or more of the following: (Ord. 96-21, 9-10-1996; amd. 2001 Code)
   A.   Agricultural production – crops (all uses within SIC code 01).
   B.   Agricultural production livestock and animal specialties including only the following:
      Animal specialties (all uses within SIC code 027).
      Beef cattle, except feedlots (all uses within SIC code 0211).
      Dairy farms (all uses within SIC code 0241).
      General livestock (all uses within SIC code 0219).
      Poultry and eggs (all uses within SIC code 025).
      Sheep and goats (all uses within SIC code 0214).
   C.   Agricultural services (all uses within SIC code 07).
   D.   Forestry (all uses within SIC code 08).
   E.   Fishing:
      Fishing lakes, including fee fishing or clubs; provided, that no building, parking lot, or other intense use is located nearer than five hundred feet (500') to any dwelling on an adjacent lot or nearby lot.
   F.   Transportation and communication uses including only the following:
      U.S. postal service (all uses within SIC code 43).
   G.   Residential uses.
      Single-family dwellings.
   H.   Institutional uses.
      Cemeteries.
      Places of worship.
   I.   Community service uses.
      Cultural and civic facilities.
      Educational facilities.
      Emergency services.
      Governmental administration buildings.
   J.   Recreational uses.
      Country clubs.
      Golf courses.
      Parks and playgrounds.
   K.   Utility uses.
Minor public and private utilities, including substations, lift stations, water towers and similar uses. (Ord. 96-21, 9-10-1996)

10-5A-3: ACCESSORY USES AND STRUCTURES:

Uses and structures customarily accessory to a permitted use may be allowed. (Ord. 96-21, 9-10-1996)

10-5A-4: SPECIAL USES:

The following uses may be allowed within the A-1 district subject to the criteria established in section 10-16-4 of this title:
   A.   Correctional institutions.
   B.   Airports and airstrips.
   C.   Mining activities.
   D.   Major sports and recreation areas and facilities.
   E.   Major public and private utilities, including water treatment plants, wastewater treatment plants, power generating facilities, transmission towers, and similar uses.
   F.   Residential group homes based on the following criteria:
      1.   The exterior of the structure shall maintain the appearance of a single-family dwelling.
      2.   No proposed residential group home shall be located within six hundred feet (600') of an existing residential group home.
      3.   Other additional reasonable requirements designed to protect the safety and general welfare of adjoining landowners and other residents of the village.
   G.   Communication towers based on the following criteria:
      1.   The height of the tower shall not exceed one hundred feet (100').
      2.   The tower shall be set back from property lines a minimum of one foot (1') for every foot of tower height.
      3.   Owners and operators of every communication tower approved after the effective date of this title shall provide for the collocation of other communications providers on their tower for reasonable compensation.
      4.   Prior to approval of a communication tower by the village board of trustees, the applicant shall document his efforts to locate his antenna on an existing communication tower within the village or in close proximity to the village. Such documentation shall also indicate why collocation on any existing tower is not feasible.
      5.   Additional reasonable requirements designed to protect the safety and general welfare of adjoining landowners and other residents of the village. (Ord. 96-21, 9-10-1996)

10-5A-5: AGRICULTURAL ACTIVITIES REGULATED:

   A.   Livestock: No accessory building used or intended to be used to shelter livestock shall be erected closer than three hundred feet (300') to a dwelling existing on an adjoining lot or nearby lot nor shall it be erected closer than two hundred feet (200') to any residentially zoned property. Fences shall be erected or other means shall be taken to prevent livestock from approaching any spot closer than three hundred feet (300') to any dwelling on an adjoining lot or nearby lot or within two hundred feet (200') of any residentially zoned property.
   B.   Farm Equipment And Commodities: Agricultural equipment or commodities (including, but not limited to, baled crops, fertilizer, pesticides and herbicides) shall not be stored outdoors closer than two hundred feet (200') from any residentially zoned property. Except, however, that such material may be stored in a building located not less than one hundred feet (100') from any residentially zoned property. (Ord. 96-21, 9-10-1996)

10-5A-6: DIMENSIONAL REGULATIONS:

   A.   Lot Standards:
      1.   Minimum Lot Size: 2 acres.
      2.   Minimum Lot Width: 250 feet.
      3.   Minimum Lot Depth: 250 feet.
   B.   Yards:
      1.   Minimum Front Yard: 50 feet.
      2.   Minimum Side Yard: 10 feet.
      3.   Minimum Rear Yard: 50 feet.
   C.   Maximum Building Height: 35 feet.
   D.   Minimum Dwelling Unit Size: 980 square feet.
   E.   Minimum District Size: 5 acres. (Ord. 96-21, 9-10-1996)
