CHAPTER 8

COMMERCIAL DISTRICTS

10-8A-1: PURPOSE:

The purpose of the CN neighborhood commercial district is to provide areas for the development of convenience commercial retail sales and selected service activities at accessible locations in the village. The CN district is further intended to implement the village land use plan for land that is established as a neighborhood commercial area, and may be used in other areas designated as commercial on the land use plan map. The CN district is not intended to allow industrial uses. In addition to the selected services that are permitted uses, other service and retail uses which would not normally be appropriate in the CN district may be allowed as special uses with conditions specified by the village board of trustees to safeguard the public health, safety, morals and welfare. 10-8A-2: PERMITTED USES:

The CN district is designed to allow a selected range of retail and service uses; provided, that the uses are legal and no outdoor storage is conducted except as otherwise provided herein. Permitted uses are listed according to the standard industrial classification (SIC) manual published by the office of management and budget, 1987 edition. Three (3) copies of the 1987 SIC manual are on file in the office of the village clerk. If a particular use is not listed or within the same classification code as a listed permitted use, it is not allowed within the CN district. In addition, any building used primarily for any of the uses listed in this section may have not more than forty percent (40%) of the floor area devoted to storage or incidental assembly of products sold on the premises. Buildings or structures may be erected, altered or used for one or more of the following:
   A.   Transportation and communication uses, including only the following:
      U.S. postal service (all uses within SIC code 43).
   B.   Building materials, hardware and garden supply, including only the following:
      Hardware stores (all uses within SIC code 525).
   C.   Food stores (all uses within SIC code 54).
   D.   Automotive dealers and gasoline service stations, including only the following:
      Auto and home supply stores (all uses within SIC code 553).
      Gasoline service stations (all uses within SIC code 554).
   E.   Apparel and accessory stores (all uses within SIC code 56).
   F.   Eating and drinking places (all uses within SIC code 58, including outdoor restaurants).
   G.   Miscellaneous retail, including only the following:
      Drugstores and proprietary stores (all uses within SIC code 5912).
      Liquor stores (all uses within SIC code 5921).
   H.   Depository institutions, including only the following:
      Commercial banks (all uses within SIC code 602).
      Credit unions (all uses within SIC code 606).
      Savings institutions (all uses within SIC code 603).
   I.   Insurance agents, brokers and service (all uses within SIC code 64).
   J.   Real estate, including only the following:
      Real estate agents and managers (all uses within SIC code 653).
      Title abstract offices (all uses within SIC code 654).
   K.   Personal services, including only the following:
      Barbershops (all uses within SIC code 724).
      Beauty shops (all uses within SIC code 723).
      Computer programming, data processing, and other computer related services (all uses within SIC code 737).
      Dance studios (all uses within SIC code 7911).
      Laundry, cleaning and garment services, including only the following:
      Coin operated laundries and dry cleaning (all uses within SIC code 7215).
      Garment pressing and agents for laundries and dry cleaners (all uses within SIC code 7212).
      Miscellaneous personal services:
      Tax return preparation services (all uses within SIC code 7291).
      Photographic studios, portrait (all uses within SIC code 722).
      Physical fitness facilities (all uses within SIC code 7991) - Establishments primarily engaged in operating reducing and other health clubs, spas and similar facilities featuring exercise and other active physical fitness conditioning, whether or not on a membership basis. Also included in this industry are establishments providing aerobic dance and exercise classes.
      Shoe repair shops and shoeshine parlors (all uses within SIC code 725).
   L.   Health services (all uses within SIC code 80).
   M.   Legal services (all uses within SIC code 81).
   N.   Educational services (all uses within SIC code 82).
   O.   Social services, including only the following:
      Child daycare services (all uses within SIC code 835).
   P.   Museums, art galleries, botanical and zoological gardens (all uses within SIC code 84).
   Q.   Membership organizations, including only the following:
      Business associations (all uses within SIC code 861).
      Civic, social and fraternal associations (all uses within SIC code 864).
      Labor unions and similar labor organizations (all uses within SIC code 863).
      Political organizations (all uses within SIC code 865).
      Professional membership organizations (all uses within SIC code 862).
      Other membership organizations (all uses within SIC code 869).
   R.   Engineering, accounting, research, management, and related services, including only the following:
      Accounting, auditing, and bookkeeping services (all uses within SIC code 872).
      Engineering, architectural, and surveying services (all uses within SIC code 871).
      Management and public relations services, including only the following:
      Business consulting services, not elsewhere classified (all uses within SIC code 8748).
      Management consulting services (all uses within SIC code 8742).
      Management services (all uses within SIC code 8741).
      Public relations services (all uses within SIC code 8743).
      Research, development, and testing services, including only the following:
      Commercial, economic, sociological, and educational research (all uses within SIC code 8732).
   S.   Public administration, including only the following:
      Executive, legislative, and general government, except finance (all uses within SIC code 91).
      Justice, public order and safety, including only the following:
      Courts (all uses within SIC code 921).
      Fire protection (all uses within SIC code 9224).
      Legal counsel and prosecution (all uses within SIC code 9222).
      Police protection (all uses within SIC code 9221).
      Other public order and safety (all uses within SIC code 9229).
   T.   Utility uses:

10-8A-3: ACCESSORY USES AND STRUCTURES:

Uses and structures customarily accessory to a permitted use may be allowed. Residential uses shall be allowed as an accessory use; provided, that such use is not located on the ground floor of any building. (Ord. 96-21, 9-10-1996)

10-8A-4: SPECIAL USES:

Special uses may be allowed based on the provisions of section 10-16-4 of this title and the criteria in this section.
   A.   Planned developments based on the procedures in chapter 11 of this title.
   B.   Places of worship. (Ord. 96-21, 9-10-1996)

10-8A-5: SITE PLAN REQUIRED:

Site plan approval by the planning and zoning commission shall be required for all proposed developments within the CN neighborhood commercial district as provided for in chapter 13 of this title. (Ord. 96-21, 9-10-1996)

10-8A-6: DIMENSIONAL REGULATIONS:

   A.   Lot Standards:
      1.   Minimum lot size: 10,000 square feet.
      2.   Minimum lot width: 100 feet.
      3.   Minimum lot depth: 100 feet.
   B.   Yards:
      1.   Minimum Front Yard: 25 feet.
      2.   Minimum Side Yard: None for lots abutting other commercially zoned properties. If a side yard is provided, however, it shall be at least 10 feet in width. For lots abutting residentially zoned properties, the minimum side yard setback shall be 20 feet.
      3.   Minimum Rear Yard: None, unless the rear of the lot abuts land zoned residential, in which case, there shall be a rear yard of at least 25 feet. If a rear yard is not required but is provided, however, it shall be at least 10 feet.
   C.   Maximum Building Coverage: 40 percent.
   D.   Maximum Building Height: 35 feet or 21/2 stories.
   E.   Minimum District Size: 2 acres.
   F.   Filling Station Pumps: Must be set back 15 feet from any street line, 25 feet from any side or rear lot line, and 50 feet from any residentially zoned land. (Ord. 96-21, 9-10-1996)

10-8B-1: PURPOSE:

The purpose of the CM Main Street commercial district is to provide areas along Main Street for the development of selected retail sales and selected service activities at accessible locations in the village. The CM district is further intended to implement the village comprehensive plan for land that is designated as part of the Main Street mixed use district. The CM district is not intended to allow industrial uses. In addition to the selected uses that are permitted uses, other uses which would not normally be appropriate in the CM district may be allowed as special uses with conditions specified by the village board of trustees to safeguard the public health, safety, morals and welfare.       Reupholstery and furniture repair (all uses within SIC code 764).

   U.   Motion pictures (all uses within SIC code 78).
   V.   Health services (all uses within SIC code 80).

   X.   Educational services (all uses within SIC code 82).
   Y.   Social services, including only the following:

10-8B-4: SPECIAL USES:

10-8B-5: TEMPORARY USES:

   A.   Temporary Outdoor Displays: Temporary outdoor displays of merchandise may be allowed by the director of public works based on the permit process outlined in subsection 10-16-5A of this title.
   B.   Temporary Seasonal Displays And Sales: Temporary seasonal displays and sales may be allowed by the director of public works based on the permit process outlined in subsection 10-16-5B of this title.
   C.   Festivals: Festivals may be allowed by the director of public works based on the permit process outlined in subsection 10-16-5C of this title. (Ord. 96-21, 9-10-1996)

10-8B-6: SITE PLAN REQUIRED:

   A.   Approval: Site plan approval by the planning and zoning commission shall be required for all proposed developments within the CM Main Street commercial district as provided for in chapter 13 of this title. (Ord. 96-21, 9-10-1996; amd. Ord. 2008-37, 11-25-2008)
   B.   Main Street District:
      1.   Introduction: The Main Street district includes that portion of Glen Carbon which is included in the Main Street plan (dated June 1995, as amended) and which is zoned CM Main Street commercial district. In order to preserve and protect the historic character of the entire Main Street district and to encourage redevelopment consistent with the Main Street plan, the regulations of this subsection are imposed in addition to those of the other zoning districts in this part of the village.
      2.   Purpose And Intent: The purpose of this subsection is to preserve and protect the historic character of the Main Street district. The character of the village is directly linked to the economic, social, historical and cultural health and well being of the community. This subsection, therefore, establishes procedures to maintain the historic character of the village and obtain the following objectives:
         a.   To maintain and enhance the distinctive village imprint and the character of historic buildings, landmarks and areas in the village.
         b.   To safeguard the heritage of the village by preserving areas, places, sites, buildings, structures, objects and works of art which reflect elements of the village's cultural, social, economic, political or architectural heritage.
         c.   To afford the widest possible scope of continuing vitality through private renewal and architectural creativity within appropriate controls and standards.
      3.   Approval Of New Buildings: The planning and zoning commission shall review and approve the design of all new buildings within the Main Street district. This approval shall be based on the criteria in subsection B4 of this section.
      4.   New Structures:
         a.   Design Requirements:
            (1)   New buildings shall be similar in size, scale, mass and architectural style as the surrounding structures.
            (2)   New buildings shall have exterior material of painted wood, material that simulates painted wood, brick, stucco, or stone masonry. Windows shall be similar to those of adjacent structures.
            (3)   Overall building height to width ratios, chimney construction, roof pitch and other pertinent data, as deemed important to the overall building appearance, to assure reasonable adherence to the structures adjacent shall be considered in the design of any new or replacement structure.
         b.   Design Prohibitions:
            (1)   No new building shall have vinyl siding and no remodeled, enlarged, or diminished building shall have an exterior material of metal, concrete, concrete block, glass block, or unpainted wood; provided, that this shall not prohibit use of siding which simulates painted wood in appearance and which does not reflect light to an extent of more than one hundred ten percent (110%) of a painted wood surface.
            (2)   The scale and proportion of enlargements or extensions of existing buildings shall not result in a substantial change to the form, design or composition associated with the original building and its particular architectural style.
      5.   Appeals:
         a.   Within thirty (30) days of any Glen Carbon Planning and Zoning Commission decision, any affected party may appeal the decision to the Board of Trustees by filing notice thereof with the Village Clerk.
         b.   The Board of Trustees shall schedule a public hearing within forty five (45) days of the date the appeal is received. At the public hearing, the Board of Trustees shall hear all interested parties. Within thirty (30) days of the public hearing, the Board of Trustees shall pass a resolution either confirming, rejecting, or amending the decision of the Planning and Zoning Commission. The Village Clerk shall notify the owner of any property involved of the Board of Trustees' action by regular first class mail. (Ord. 2008-37, 11-25-2008)

10-8B-7: DIMENSIONAL REGULATIONS:

   A.   Lot Standards:
      1.   Minimum lot size: 10,000 square feet.
      2.   Minimum lot width: 100 feet.

   B.   Yards:
      1.   Minimum front yard: None, unless an easement exists, then at least a five foot (5') buffer must be maintained from the easement.
      2.   Minimum side yard: None, unless the side of the lot abuts land zoned residential, in which case, there shall be a side yard of at least ten feet (10'). If a side yard is not required but is provided, however, it shall be at least ten feet (10') in width.
      3.   Minimum rear yard: None, unless the rear of the lot abuts land zoned residential, in which case, there shall be a rear yard of at least twenty five feet (25').    C.   Maximum Building Coverage: 40 percent.
   D.   Maximum Building Height: 45 feet.

The purpose of the CG general commercial district is to provide areas for the development of general retail sales and selected service activities at accessible locations in the village. The CG district is further intended to implement the village land use plan for land that is designated as commercial and is not located in the downtown area. The CG district is not intended to allow industrial uses. In addition to the selected retail and service uses that are permitted uses, other service and retail uses which would not normally be appropriate in the CG district may be allowed as special uses with conditions specified by the village board of trustees to safeguard the public health, safety, morals and welfare. 10-8C-2: PERMITTED USES:

The CG district is designed to allow considerable latitude in the range of retail uses allowed; provided, that the uses are legal and no outdoor storage is conducted except as otherwise provided herein. Permitted uses are listed according to the standard industrial classification (SIC) manual published by the office of management and budget, 1987 edition. Three (3) copies of the 1987 SIC manual are on file in the office of the village clerk. If a particular use is not listed or within the same classification code as a listed permitted use, it is not allowed within the CG district. In addition, any building used primarily for any of the uses listed in this section may have not more than forty percent (40%) of the floor area devoted to storage or incidental assembly of products sold on the premises.       Animal specialty services, except veterinary (SIC code 0752), including only the following:
      Boarding kennels.
      Dog grooming.
      Veterinary services (all uses within SIC code 0742).
   B.   Transportation and communication uses, including only the following:
      Communication (all uses within SIC code 48, except communication towers).
      Local and suburban transit and interurban highway passenger transportation (all uses within SIC code 41).
      U.S. postal service (all uses within SIC code 43).
   C.   Building materials, hardware and garden supply, including only the following:
      Hardware stores (all uses within SIC code 525).
      Lumber and other building materials dealers (SIC code 5211), including only the following:
      Doors, retail.
      Fencing dealers, retail.
      Flooring, wood, retail.
      Garage doors, retail.
      Lumber and building material dealers, retail.
      Lumber and planing mill product dealers, retail.
      Millwork and lumber dealers, retail.
      Paneling, retail.
      Storm windows and sash, wood or metal, retail.
      Paint, glass and wallpaper stores (all uses within SIC code 523).

   D.   General merchandise stores (all uses within SIC code 53).

10-8C-3: ACCESSORY USES AND STRUCTURES:

Uses and structures customarily accessory to a permitted use may be allowed. Residential uses shall be allowed as an accessory use; provided, that such use is not located on the ground floor of any building. (Ord. 96-21, 9-10-1996)

10-8C-4: SPECIAL USES:

Special uses may be allowed based on the provisions of section 10-16-4 of this title and the criteria in this section.
   A.   Planned developments based on the procedures in chapter 11 of this title.
   B.   Used vehicle sales (all uses within SIC code 552) based on the following criteria:
      1.   Shall be located on a site of at least one acre.
      2.   All vehicles shall be in proper running order.
      3.   Additional criteria necessary to protect the public health, safety and welfare as determined by the village board of trustees.
   C.   Pawnshops (classified under SIC code 5932), check cashing agencies (classified under SIC code 6099) and personal credit institutions (all uses within SIC code 614) based on the following criteria:
      1.   All property lines of the lot on which the business is located shall be at least three hundred feet (300') from the nearest property line of any church, synagogue or similar place of worship, any school, or any residentially zoned property.
      2.   All property lines of the lot on which the business is located shall be at least one thousand feet (1,000') from the nearest property line of any other use classified within SIC code 6099 or SIC code 614, or any pawnshop, including such businesses or pawnshops located outside of the village limits.
      3.   The establishment shall not be open for business between the hours of eight o'clock (8:00) P.M. and seven o'clock (7:00) A.M.
      4.   The establishment shall have an interior space for patrons to transact business and shall have no drive-up or walk-up window.
      5.   No bars, heavy mesh screens or similar material shall be allowed on the exterior of the building, and no such material located on the interior of the building shall be visible from outside the building.
      6.   Additional criteria necessary to protect the public health, safety and welfare as determined by the village board of trustees.
   D.   Automotive repair shops (all uses within SIC code 753) and automotive services, except repair (all uses within SIC code 7549) based on the following criteria:
      1.   Shall be located on a site of at least ten thousand (10,000) square feet.
      2.   All vehicles shall be stored inside a building or within an area screened from the view of the street and surrounding properties by landscaping, fencing or a combination of materials that provides an opaque screen at least six feet (6') in height.
      3.   Additional criteria necessary to protect the public health, safety and welfare as determined by the village board of trustees.
   E.   General warehousing and storage (SIC code 4225), including only mini-warehouses and self-service storage facilities, based on the following criteria:
      1.   There shall be a minimum of one parking space for each employee.
      2.   No gasolines, flammables, explosives or other dangerous materials may be stored, and no motor vehicles may be stored inside a storage building egress to the storage facilities.
      3.   Such facility may contain a surfaced lot for the outside storage of motor vehicles, trailers, and watercraft as an accessory use. Motor vehicles, trailers, and watercraft include boats, boat trailers, camping trailers, materials trailers, and recreational vehicles, and automobiles and light trucks of less than ten thousand (10,000) pounds gross weight. All such vehicles shall be registered and in operating condition, and shall be screened from the view of adjoining properties. No derelict vehicles shall be allowed. No repair, maintenance, and/or upgrading of motor vehicles, trailers, or watercraft shall be permitted on-site.
      4.   All storage facilities shall be separated by walls and ceilings.
      5.   There shall be a minimum of twenty four feet (24') between buildings for purposes of ingress and egress to storage facilities.
      6.   Each individual storage facility shall not exceed a width of twelve feet (12'), a length of thirty feet (30') and a height of nine feet (9').
      7.   The storage facilities shall be screened from streets and surrounding residential properties.
      8.   Additional reasonable requirements, including, but not limited to, accessways, billing locations, hours of operation, and an on-site resident manager, may be imposed for the protection of adjoining landowners.
   F.   Communication towers based on the following criteria:
      1.   The height of the tower shall not exceed one hundred feet (100').
      2.   The tower shall be set back from property lines a minimum of one foot (1') for every foot of tower height.
      3.   Owners and operators of every communication tower approved after the effective date of this title shall provide for the collocation of other communications providers on their tower for reasonable compensation.
      4.   Prior to approval of a communication tower by the Village Board of Trustees, the applicant shall document his efforts to locate his antenna on an existing communication tower within the Village or in close proximity to the Village. Such documentation shall also indicate why collocation on any existing tower is not feasible.
      5.   Additional reasonable requirements designed to protect the safety and general welfare of adjoining landowners and other residents of the Village.
   G.   Automobile service stations: The intent of this subsection is to delineate requirements for submittal of a special use permit and allowable services and activities under SIC code 5541 "Gasoline Service Stations" which contains the following uses.
      1.   5541 gasoline service stations: Gasoline service stations primarily engaged in selling gasoline and lubricating oils. These establishments frequently sell other merchandise, such as tires, batteries, and other automobile parts, or perform minor repair work. Gasoline stations combined with other activities, such as grocery stores, convenience stores, or carwashes, are classified according to the primary activity.
         Automobile service stations - retail.
         Filling stations, gasoline - retail.
         Gasoline and oil - retail.
         Marine service stations - retail.
         Service stations, gasoline - retail.
         Truck stops - retail.
   The above listed uses shall be required a special use permit and shall provide additional information as required below for consideration.
         a.   A written statement on the site plan and written letter to the Village Board of Trustees that under no circumstances shall overnight or daily truck parking be allowed for more than two (2) hours. And only in designated parking spaces not to exceed two (2) spaces designated for semi parking which shall be a minimum of five hundred feet (500') from any residentially zoned property.
         b.   Signage detailed on the site plan and a statement regarding maintaining signage that will read "NO OVERNIGHT PARKING ON PREMISES".
         c.   A statement on the site plan that no weigh scales exist and written confirmation in letter form that weigh scales will not be installed at any time unless receiving specific permission by the Planning and Zoning Commission and confirmed by the Village Board of Trustees. 10-8C-5: TEMPORARY USES:

   A.   Temporary Outdoor Displays: Temporary outdoor displays of merchandise may be allowed by the Director of Public Works based on the permit process outlined in subsection 10-16-5A of this title.
   B.   Temporary Seasonal Displays And Sales: Temporary seasonal displays and sales may be allowed by the Director of Public Works based on the permit process outlined in subsection 10-16-5B of this title.
   C.   Festivals: Festivals may be allowed by the Director of Public Works based on the permit process outlined in subsection 10-16-5C of this title. (Ord. 96-21, 9-10-1996)

10-8C-6: SITE PLAN REQUIRED:

Site plan approval by the Planning and Zoning Commission shall be required for all proposed developments within the CG General Commercial District as provided for in chapter 13 of this title. (Ord. 96-21, 9-10-1996)

10-8C-7: DIMENSIONAL REGULATIONS:

   A.   Lot Standards:
      1.   Minimum lot size: 10,000 square feet.
      2.   Minimum lot width: 100 feet.
      3.   Minimum lot depth: 100 feet.
   B.   Yards:
      1.   Minimum Front Yard: 25 feet.
      2.   Minimum Side Yard: None, unless the side of the lot abuts land zoned residential, in which case, there shall be a side yard of at least ten feet (10'). If a side yard is not required but is provided, however, it shall be at least ten feet (10') in width.
      3.   Minimum Rear Yard: None, unless the rear of the lot abuts land zoned residential, in which case, there shall be a rear yard of at least twenty five feet (25'). If a rear yard is not required but is provided, however, it shall be at least ten feet (10') in depth.
   C.   Maximum Building Coverage: 40 percent.
   D.   Maximum Building Height: 45 feet.
   E.   Minimum District Size: 5 acres.
   F.   Filling Station Pumps: Must be set back fifteen feet (15') from any street line, twenty five feet (25') from any side or rear lot line, and fifty feet (50') from any residentially zoned land. (Ord. 96-21, 9-10-1996)
