ARTICLE XVI
Performance Standards
§ 230-73 Certification required.

Before the issuance of any construction or occupancy permit for use in the D Industrial District, the applicant shall submit a certification by a professionally qualified person, firm or corporation that the proposed use will comply with the following standards.
§ 230-74 Fire and explosion hazards.
All activities shall be carried on only in structures which conform to the standards of the National Board of Fire Underwriters or the Borough Building Code or Fire Ordinance, whichever is more restrictive. All operations shall be carried on and explosive raw materials, fuels, liquids and finished products shall be stored in accordance with the standards of the Board of Fire Underwriters. Every building shall be equipped with automatic sprinklers which conform to the standards of the National Board of Fire Underwriters.
§ 230-75 Radioactivity.
Any activity which emits radioactivity which would violate any federal or state health and safety regulations shall be prohibited.
§ 230-76 Smoke.
There shall be no emission at any point from any chimney or otherwise of visible grey smoke of a shade darker than No. 1 on the Ringelmann Smoke Chart as published by the United States Bureau of Mines. (Powers Micro-Ringelmann Chart, McGraw Hill Publishing Co. 1954 may be used.) These provisions shall also apply to visible smoke of a different color but with an equivalent apparent opacity.
§ 230-77 Fly ash, fumes, gases, dust and odors.
There shall be no emission of any fly ash, fumes, gas, dust or odors beyond the boundary of the property occupied by such use.
§ 230-78 Vibration.
There shall be no vibration beyond the immediate site on which the use is conducted.
§ 230-79 Noise.

Noise emissions shall comply with the provisions of Borough Code Chapter 146, entitled "Noise," for standards, certification and enforcement.
§ 230-80 Liquid or solid waste.
A.
No industrial operation shall discharge industrial wastes of any kind into any reservoir pool or lake. The discharge of untreated industrial wastes into a stream is prohibited. All methods of sewage and industrial waste treatment and disposal shall be approved by the Borough and New Jersey State Health Departments. Effluent from a treatment plant shall at all times comply with the following standards:
(1)
Maximum five-day biochemical oxygen demand: five parts per million.
(2)
Maximum quantity of effluent: 10% of the minimum daily stream flow.
(3)
Maximum five-day biochemical oxygen demand after dilution, BOD of effluent multiplied by quantity of effluent divided by quantity of stream flow: 0.25 parts per million.
(4)
Maximum total solids: 5,000 parts per million.
(5)
Maximum phenol: 0.01 parts per million.
B.
No effluent shall contain any other acids, oils, dust, toxic metals, corrosive or other toxic substance in solution or suspension which would create odors, discolor, poison or otherwise pollute the stream in any way. In addition, no industrial use shall discharge into any public sanitary sewer system quantities of water beyond the capacity of such sewer system. The amount of effluent permitted shall be determined by the Borough Engineer.
§ 230-81 Glare.
There shall be no direct or sky-reflected glare exceeding 0.05 footcandle measurable beyond the property line of the lot occupied by such use. This regulation shall not apply to lights used at the entrance or exit of service drives.
§ 230-82 Outdoor storage.
Outdoor storage shall be prohibited. However, the storage of merchandise in connection with businesses permitted in § 230-70 shall be allowed in an open, exposed section of the building, subject to the following conditions:
A.
Only one wall of the building may be open, with the other three walls enclosed.
B.
The other three walls and the roof shall be structurally a part of the building.
C.
The open section may fall only upon a side or rear yard, but shall not face upon a public street.
D.
The open section shall be constructed with movable curtain walls which shall be closed at all times when the business is not in operation. The curtain walls shall be of wood or metal construction. The foregoing shall be provided to maintain property values, and before any building permit is issued in the industrial district, final plans and specifications shall be submitted to the Planning Board for approval.
