Zoning Permits

§ 230-94.1 Definition.

As used in this article, the following terms shall have the associated meanings:
ZONING PERMIT
A document signed by the Zoning Officer which:
A. 
Is required by this chapter as a condition precedent to the commencement of a use or the erection, construction, reconstruction, alteration, conversion, expansion or installation of a structure or building; and
B. 
Acknowledges that such use, structure or building complies with the provisions of the Municipal Zoning Ordinance or variance therefrom duly authorized by a municipal agency pursuant to N.J.S.A. 40:55D-60 and 40:55D-70 of the Municipal Land Use Law.

§ 230-94.2 Application; Zoning Officer responsibility.

Pursuant to Code § 4-41B(3), the Zoning Officer shall review and process applications for zoning permits. The Zoning Officer is hereby authorized to prepare application forms for zoning permits.

§ 230-94.3 Issuance of permit.

The Zoning Officer shall issue a zoning permit within 10 business days from the date of application. Failure to issue requested permit within said 10 business days will be considered an approval.

§ 230-94.4 Zoning permit required for construction permit; conditions.

Where new construction is proposed, no construction permit shall be issued unless a zoning permit covering the use and location of the proposed building and structure has first been obtained. Where applicable, issuance of a zoning permit may be conditioned upon payment of any taxes or assessment for local improvements which are due or delinquent on the property for which any application is made.

§ 230-94.5 Zoning permit required for certificate of occupancy.

No certificate of occupancy shall be issued until a zoning permit is issued.
