The provisions of this chapter and the enforcement thereof shall be liberally construed in favor of the Borough, as provided by the Constitution of the State of New Jersey (1947), Article IV, Section 7, Paragraph 11.

In the interpretation and application of this chapter, the provisions hereof shall be held and construed to be the minimum requirements for the promotion of public health, safety, preservation of land values and general welfare.

This chapter shall be enforced by the Code Enforcement Official of the Borough, except that the Police Department of the Borough shall also have concurrent authority to enforce the provisions and requirements as contained in § 230-18, Garages in residential districts.

It shall be the duty of the Police Department to enforce the provisions of this chapter for signs posted in violation of Article VIII herein. It shall be the duty of the Code Enforcement Officer to enforce the provisions of this chapter for signs on private property.

The Code Enforcement Official shall in no case, except under a written order of the Board of Adjustment or the Borough Council, issue any permit for the erection or structural alteration of any building or grant any occupancy permit for any building where the proposed erection, structural alteration or use thereof would be in violation of any provisions of this chapter.

Any person who shall violate the terms and provisions of this chapter shall, upon conviction thereof, be subject to any combination of the following: a fine not exceeding $2,000, imprisonment not to exceed 90 days or a period of community service not exceeding 90 days. Each day upon which a violation continues shall constitute a separate offense.

In addition to the remedies provided for in this section, should an owner, operator or occupant of any premises fail to comply with any order and/or directive of the Code Enforcement Official within 10 days after notice of such violation, the Code Enforcement Official may cause such condition to be remedied. In such case, the Code Enforcement Official may cause such remediation by retaining the services of a contractor, in accordance with applicable laws, and the cost of such remediation shall be paid by the Borough. The expenses incurred by the Borough shall become a charge or lien on such lands and shall be added to and become and form a part of the taxes to be assessed and levied upon such lands and shall bear interest at the same rate as taxes and shall be collected and enforced in the same manner.
