Amendments
§ 230-103 Procedure.
The regulations, limitations and restrictions of this chapter may from time to time be amended, changed, modified or repealed, and the boundaries of the districts hereby established may be changed by an ordinance adopted by the Borough Council; but no amendment for change shall become effective unless the ordinance proposing the amendment or change shall first have been submitted to the Planning Board for approval, disapproval or suggestions. The Planning Board shall have a reasonable time, but not less than 30 days, for consideration and report. In the case of an unfavorable report by the Planning Board, the amendment shall not become effective, except by a favorable vote of 2/3 of the Borough Council.
§ 230-104 Protests by owners upon proposed amendments.
In the case of a protest against such proposed change signed by the owners of 20% or more either of the area of the lots or land included in such proposed change or of the lots or land in the rear thereof extending 100 feet therefrom or of the lots or land on either side thereof or directly opposite thereto extending 100 feet therefrom, exclusive of street space, such change shall not become effective except by the favorable vote of 2/3 of all the members of the Borough Council.
§ 230-105 Authority of Planning Board.
A.
The Planning Board may fix the minimum sizes of lots and establish building lines which are either consistent with or in excess of those established by this chapter.
B.
In approving any subdivision plat within its jurisdiction, the Planning Board may either confirm the zoning regulations of the land subdivided or make recommendations for their reasonable change to the Borough Council. The owners of the land shown upon the plat may submit with the plat a proposed building plan indicating lots where different types of dwellings or stores are proposed to be built. The building plan shall indicate for each lot or proposed building unit the maximum density of population, the maximum height of building and the minimum yard and open space requirements.[1]
