18.38.005 - Applicability.

This chapter applies within legacy use zones and planned unit developments (PUDs), except as otherwise provided in the PUD official development plan.

18.38.010 - Fences permitted.

Except as otherwise provided in this chapter, fences located entirely on a property shall be permitted.

18.38.020 - Fencing materials and design.

(1)

All privacy fences shall be constructed to orient any exposed structural framework to the interior of the fenced property;

(2)

All fences, perimeter walls, or retaining walls that are visible from public rights-of-way must be made from traditional fence or wall materials such as:

(a)

Fence materials:

1.

Wood, vinyl, or composite wood (in picket, shadowbox, or post-and-rail formats); or

2.

Metal (chain-link fencing or aluminum or wrought iron decorative fencing).

(b)

Perimeter and retaining wall materials:

1.

Stacked stone;

2.

Tinted split-face concrete masonry units;

3.

Brick; or

4.

Stucco-finished block.

(3)

For fences, perimeter walls, or retaining walls, the director may approve materials that are comparable to the materials listed in subsection (2), above.

Barbed wire, razor wire, and electric fences are prohibited, except as specifically permitted in a PUD official development plan, or as required by the city as a condition of approval of a special use permit.

18.38.030 - Protection of sight distance areas.

Fences located within a sight distance area for a street, driveway, alley, or intersection shall conform with the requirements for such sight distance areas contained in the city's street, sidewalk, and drainage specifications manual.

18.38.040 - Maximum height.

(1)

The maximum height offences in the M-1 and M-2 zone districts shall be ten feet.

(2)

The maximum height of fences in the PUD district shall be as listed in the official development plan or, if none is listed, in the most similar zone district.

(3)

The maximum height offences in all other zone districts shall be eight feet, unless a taller fence is required by the city as a condition of approval of a site development plan submitted pursuant to chapter 18.40.

18.38.045 - Temporary fencing.

(1)

Temporary fencing utilized for the purposes of screening construction shall not exceed eight feet in height and shall be opaque.

(2)

Temporary fencing used to provide temporary security in response to a demonstrated need (e.g., to secure a damaged building) may be approved by the director. The type and height of the fencing shall correspond to the demonstrated need.

(3)

Temporary fencing utilized shall be removed after not more than 18 months, except in cases where the city approves a longer term for temporary fencing (e.g. in a construction staging plan), in order to protect public safety and provide security.

18.38.050 - Building permit required.

(1)

No fence greater than six feet in height shall be constructed until a building permit for said fence has been issued by the city. Issuance of a separate building permit shall not be required when adequate information is included in the building permit application for a building project that includes the proposed fence.

(2)

No fence located in the required front setback for a property shall be constructed until a building permit for said fence has been issued by the city. Issuance of a separate building permit shall not be required when adequate information is included in the building permit application for a building project that includes the proposed fence.
