56 - COMMUNITY LANDMARKS PROGRAM
(1)
The city council hereby enacts this community landmarks chapter in accordance with its home rule authority. City council finds that the designation of community landmarks is consistent with the policies of the City of Golden Comprehensive Plan, and will further the health, safety, and welfare of the community, property owners, and residents. City council desires to establish a procedure and standards for designating certain landmarks of community importance, that do not qualify for other types of landmark designation.
(2)
The designation of a community landmark under this chapter is intended to convey community appreciation of such landmarks of community importance such as memorials to organizations, groups or persons that have provided service to the community or significant community events. This designation is not intended to legally restrict the use or alteration of such properties.

As used within this ordinance, except where otherwise specifically defined, or unless the context otherwise requires, the following terms, phrases, words and their derivations shall have the following meanings:
Community landmark means a structure, monument, or site which commemorates an event, series of events, person, or organization of significant importance to the Golden community.

The planning commission will evaluate and determine the merit of proposed community landmarks, as defined in section 18.56.020, for designation under this chapter. The following criteria shall be used in this determination:
(1)
For purposes of designating community landmarks, the phrase "significant importance to the Golden community" relates to a building, monument, structure, object, site or area that meets one or more of the following criteria:
(a)
Commemorates an event or series of events that has interest or value, or which has affected the development, heritage, or cultural characteristics of the city, the State of Colorado or the nation;
(b)
Is identified with a person or group of persons, organization, or branch of the local, State of Colorado or United States government that has had influence on the development, heritage and cultural characteristics of the city, the State of Colorado or the nation;
(c)
Has character, interest or value as part of the development, heritage or cultural characteristics of the city, the State of Colorado or the nation;
(d)
Is the site of a recent or historic event that has interest, value and which has affected the development, heritage, or cultural characteristics of the city, the State of Colorado or the nation;
(e)
Exemplifies the cultural, political, economic, social or historical heritage of the community;
(f)
Promotes the general welfare and civic pride of the present and future inhabitants of the community.

An applicant aggrieved by the decision of the planning commission on designation under this chapter may, within 15 days of the date of the decision thereon, apply to the city council for review of said decision by filing a request with the city clerk. The city council shall, within 30 days of the date of the city council meeting at which the appeal is presented, based upon the record of the planning commission hearing alone, decide to uphold, deny, or modify the decision of the planning commission.
