ARTICLE III

- ADMINISTRATION AND ENFORCEMENT

Sec. 22-300. - Violations.

A.

Any violation of the concept plan and/or final development plan or any other phase or plan adopted as part of the amendment to the development code shall constitute a violation of the development code. Any person or legal entity violating any provision of this ordinance, or who shall violate or fail to comply with any order made hereunder; or who shall continue to work upon any structure after having received written notice from the administrator to cease work, shall be guilty of a misdemeanor and punishable by a fine not to exceed five hundred dollars ($500.00) per violation. Each day such violation shall be permitted to exist shall constitute a separate offense. Notice of violation shall be sufficient if directed to such owner, the agent of the owner, or the contractor and/or left at his known place of residence or place of business.

Sec. 22-301. - Appeal.

A.

An applicant may appeal the findings and recommendations of the commissions or administrator, as applicable, by filing an objection in writing to the city council within five (5) days of receipt of the commissions' or administrator's recommendations. The city council shall grant or deny the appeal, and the council's decision shall be final. If the city council grants the appeal, the council shall submit a notice to the commissions or administrator stating reasons for its grant of the appeal.
