ARTICLE XVIII

ADOPTION AND PURPOSES

Sec. 32-1211. - Purpose.

The purpose of this chapter is to establish standards, procedures and minimum requirements, consistent with the comprehensive plan, which regulate and control the planning and subdivision of lands; the use, bulk, design, and location of land and buildings; the creation and administration of zoning districts; and the general development of real estate in the unincorporated areas of the county.

Sec. 32-1231. - Implementation.

The purpose of this chapter is to implement the county's comprehensive plan, which strives to protect the public health, safety and welfare of the present and future inhabitants of the county by:

(1)

Classifying the unincorporated area of the county into districts according to the use of land and buildings; the intensity of such use, including bulk and height; and use of surrounding open space.

(2)

Implementing the minimum water supply watershed protection development rules as formulated and approved by the state general assembly and the state environmental management commission.

(3)

Controlling the intensity of development in areas of sensitive natural resources or natural features in order to reduce environmental impacts.

(4)

Minimizing flood losses caused by the cumulative effect of obstructions in floodplains causing increases in flood heights and velocities, and by the occupancy in flood hazard areas by uses vulnerable to floods or hazardous to other lands that are inadequately elevated, floodproofed or otherwise unprotected from flood damages.

(5)

Managing and regulating the growth of the county, concentrating development in areas where adequate sewage and water facilities, roads, and schools now exist or can be provided.

(6)

Protecting the tax base by facilitating cost-effective development within the county.

(7)

Conserving the values of property throughout the county.

(8)

Protecting landowners from adverse impacts of adjoining developments.

Sec. 32-1232. - Severability.

If any division, section, paragraph, clause, provision or portion of this chapter is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this chapter shall not be affected. If any application of this chapter to a particular structure, land or water is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not be applicable to any other structure, land or water not specifically included in the judgment.

Sec. 32-1233. - Repealer.

This chapter shall specifically repeal the February 1989 Granville County Zoning Ordinance, including all changes since 1989; the October 18, 1993, Granville County Watershed Protection Ordinance, including all changes since 1993; the January 4, 1989, Granville County Mobile Home Park Ordinance, including all changes since 1989; and the August 17, 1987, Granville County Subdivision Ordinance, including all changes since 1987; and all other ordinances or parts of ordinances in conflict with the provisions of this chapter. Applicability of this chapter shall be in accordance with section 32-1234.

Sec. 32-1234. - Savings clause.

(a)

Anything to the contrary notwithstanding, no provision of this chapter is intended, nor may any provision be construed to, affect in any way a right or interest, public or private:

(1)

Now vested or accrued, in whole or part, the validity of which might be sustained or preserved by reference to a provision of an ordinance repealed by this chapter; or

(2)

Derived from, or which might be sustained or preserved and relies upon action taken before September 15, 1999, pursuant to or within the scope of a provision of any ordinance repealed by this chapter.

(b)

Further, no action or proceeding of any nature pending after September 15, 1999, is abated or otherwise affected by adoption of this chapter.
