165.16 “R-3

MULTIFAMILY RESIDENTIAL DISTRICT.

This district is intended for medium-density residential areas of the City now developed with one-family, two-family, multifamily and large scale multifamily residential development and where residential development is likely to occur.
   1.   Permitted Uses. A building or premises shall be used only for the following purposes:
      A.   Any use permitted in the “R-2” district.
      B.   Multiple dwellings.
      C.   Boarding or lodging houses, tourist homes.
      D.   Funeral homes.
      E.   Office of an architect, engineer, lawyer, dentist, doctor, or other established and recognized profession.
      F.   Hospital, clinic, and similar uses.
      G.   Condominiums, row dwellings
      H.   Large scale residential development.
      I.   Beauty parlors, provided they are operated in the residence by members of the family residing in the dwelling and are limited to one chair.
      J.   Photography and video production business, which may include the operation of tuxedo rental, wedding accessories and apparel, and picture framing so long as such uses are ancillary or accessory uses to the primary business of professional photography and video production.
      K.   Crematory in association with a funeral home.

   2.   Accessory Uses.
      A.   Any accessory use permitted in the “R-2” district.
      B.   Storage garages, where the lot is occupied by multiple dwellings, hospital, or institutional building.
      C.   Fences. When fences are erected or constructed for row dwellings, said fence shall be centered on the lot line and shall be erected or constructed of the same material so that the appearance of the fence is the same on either side. Said fence shall not exceed six (6) feet in height and shall be erected in the rear yard only.
   3.   Interior Living Space. The minimum ground floor area shall be not less than 700 square feet in one and one and a half story dwellings, and shall be the area included within the outside lines of the exterior walls of the main structure at the ground floor level. The minimum square feet of floor area within each dwelling unit of an apartment, garden apartment, terrace, or multiple dwelling building designed for two or more families shall be 400 square feet. The minimum square feet of ground floor area of a two-story dwelling shall be 550 square feet.
      A.   A multiple-family dwelling building may contain efficiency dwelling units as provided for in the Building Code as adopted by the City. At least 60% of the dwelling units in a multiple-family dwelling building must be standard size apartments as defined in this section.
      B.   Condominiums, defined as a multifamily residence, except that the units within a condominium may be sold to individuals with the owner retaining ownership of the building, common corridors, surrounding ground and accessory buildings.
      C.   Row dwellings, defined as a row of two or more (but not more than ten) attached dwellings located on a single lot or in a common frontage of a number of adjoining lots, which comprise a continuous structure divided into separate dwellings by one or more unpierced party or lot line wall extending from the ground upward to, or through, the roof deck. The entire structure shall be considered as a single building with respect to side yard requirements. If a parcel of land containing, or proposed to contain, row dwellings is divided into lots in such a manner to provide separate lots for separate row dwellings, the party wall shall be centered on the appropriate lot lines.
   4.   Bulk Regulations. The following minimum requirements shall be observed:
      A.   Lot Area: Single-family dwellings -7,000 square feet; two-family dwellings -9,000 square feet; each unit over two -2,000 square feet. Exception: if the lot is located within the boundaries of the 2013 Central Grinnell Urban Revitalization area then the lot area can be decreased by 10 percent from the minimum requirements, all other bulk regulations shall be met.

      B.   Lot Width: At street line –35 feet; at building line –70 feet, except that the lot width at the building line may be reduced by 25% for a lot where the extension of the side lot lines intersects with an interior angle of twenty degrees (20º) or more and the lot does have a width of 70 feet at some point between the minimum front yard line and the minimum rear yard line established by this chapter. Row dwelling/dwelling unit – 20 feet.
      C.   Front Yard: 25 feet.
      D.   Side Yard: 8 feet for one story; 10 feet for two stories, 12 feet for three stories; 14 feet for four stories. Row dwelling/building – 12 feet for non- interior units.
      E.   Rear Yard. 35 feet.
      F.   Maximum Height: Four stories or 50 feet. Row dwelling/building – three habitable stories or 35 feet in height.
      G.   Minimum Building Width: Any building containing dwelling units must be a minimum of 24 feet in building width.
