VIOLATIONS, VALIDITY, AND ADOPTION
A violation of any provision of this ordinance is hereby declared to be a misdemeanor and, upon conviction thereof, shall be punished as provided by law.
In case any building or structure is, or is proposed to be, erected, constructed, reconstructed, altered, converted, or maintained, or any building, structure or land is or is proposed to be used in violation of this ordinance, the director, city attorney, or other appropriate authority of the city or any adjacent or neighboring property owner who would be specially damaged by such violation may, in addition to other remedies, institute injunction, mandamus, or other appropriate action or proceeding to prevent such unlawful erection, construction, reconstruction, alteration, conversion, maintenance, or use; or to correct or abate such violation, or to prevent the occupancy of said building, structure, or land.
Each and every day such unlawful erection, construction, reconstruction, alteration, conversion, maintenance or use continues shall be deemed a separate offense.
Failure to rectify the violation within thirty (30) days after receiving written notice from the director that a violation has occurred may result in the imposition of a city fine of five hundred dollars ($500.00) per day for each building, structure, or alteration found to be in violation of this ordinance.
Should any section, clause, or provision of this ordinance be declared by a court of competent jurisdiction to be unconstitutional or invalid, this judgment shall not effect the validity of this ordinance as a whole or any part other than the part judged invalid.
Whenever the provisions of any other city ordinance or state statute require more restrictive standards than are required by the regulations and provisions of this ordinance, the provisions of such other ordinance or statute shall govern.
This ordinance shall take effect from and after the effective date of its passage and adoption by the mayor and city council.
