ARTICLE II

RESIDENTIAL DISTRICTS

Sec. 2.000.- Statement of intent.

The residential districts established by this ordinance are designed to promote and protect public health, safety, comfort, convenience, prosperity, and other aspects of the general welfare. These general goals include, among others, the following specific purposes:

a.

To provide sufficient space in appropriate locations for residential development to meet the housing needs of the city's present and expected future population, with due allowance for the need for a choice of sites and building types;

b.

To protect residential areas, as far as possible, against heavy traffic and against through traffic of all kinds;

c.

To protect residential areas against congestion, by regulating the density of population and the bulk of buildings in relation to the land around them and to one another, and by providing for off-street parking spaces;

d.

To provide appropriate space for those public and private educational, recreational, health, and similar facilities which serve the needs of the nearby residents, which generally perform their own activities more effectively in a residential environment, and which do not create objectionable influences;

e.

To promote the most desirable use of land and direction of building development in accord with a well-considered plan, to promote stability of residential development, to protect the character of the district and its particular suitability for particular uses, and to conserve the value of residential land and buildings.

Sec. 2.020. - R-1 Residential District.

2.021.

Permitted uses. In the R-1 District, the following uses are permitted as a matter of right:

a.

One (1) single-family detached or one (1) two-family dwelling per lot.

b.

One (1) mobile home per lot subject to the provisions in Article VI, section 6.070 of this ordinance.

c.

Public and private parks and open space but excluding commercial facilities.

d.

Public elementary and high schools, or private schools with a curriculum the same as ordinarily offered in public elementary and high schools, and having no rooms regularly used for housing and sleeping.

2.022.

Accessory uses. In the R-1 District, the following accessory uses are permitted:

a.

Customary home occupations as permitted in this ordinance (See Article VI, section 6.030 of this ordinance).

b.

The keeping of not more than two (2) nontransient roomers or boarders by a resident family.

c.

Buildings or structures customarily accessory and incidental to a permitted use including garages, storage sheds, barns and green houses.

d.

Private recreational facilities, such as swimming pools, basketball courts, and tennis courts.

e.

The raising of garden crops, vineyard crops, fruits or plants incidental to the residential use of the land.

2.023.

Conditional uses. The following uses may be permitted in the R-1 District by the board of zoning appeals subject to the provisions of Article VII of this ordinance.

a.

Public utility uses.

b.

Assembly uses.

c.

Art galleries or museums.

d.

Cemeteries.

e.

Childcare centers.

f.

Hospitals, mental health facilities and nursing homes.

g.

Rooming houses.

h.

Bed & breakfast.

i.

Broadcasting towers and stations.

j.

Agricultural uses as provided in Article VII, section 7.000 of this ordinance.

2.024.

Development standards. The following minimum standards shall apply to all uses within the R-1 District including single-family detached and two-family dwellings:

Sec. 2.030. - R-2 Residential District.

2.031.

Permitted uses. In the R-2 District, the following uses are permitted as a matter of right:

a.

One (1) single-family detached or one (1) two-family dwelling per lot.

b.

Public and private parks and open space, but excluding commercial facilities.

c.

Public elementary and high schools, or private schools with a curriculum the same as ordinarily offered in public elementary and high schools, including dormitories.

2.032.

Accessory uses. In the R-2 District, the following accessory uses are permitted:

a.

Customary home occupations as permitted in this ordinance (See Article VI, section 6.030 of this ordinance).

b.

The keeping of not more than two (2) nontransient roomers or boarders by a resident family.

c.

Buildings or structures customarily accessory and incidental to a permitted use including garages, storage sheds, barns and greenhouses.

2.034.

Sec. 2.040. - R-3 Residential District.

2.041.

Permitted uses. In the R-3 District, the following uses are permitted as a matter of right:

One (1) single-family detached or one (1) two-family dwelling per lot

b.

c.

2.042.

2.044.

Sec. 2.050. - R-C1.

2.051.

Permitted uses. In the R-C1 District, the following uses are permitted as a matter of right:

a.

One (1) single-family detached or one (1) two-family dwelling per lot.

b.

Public and private parks and open space, but excluding commercial facilities.

c.

Public elementary and high schools, or private schools with a curriculum the same as ordinarily offered in public elementary and high schools, including dormitories.

2.052.

Accessory uses. In the R-C1 District, the following accessory uses are permitted:

a.

Customary home occupations as permitted in this ordinance (See Article VI, section 6.030 of this ordinance).

b.

The keeping of not more than two (2) nontransient roomers or boarders by a resident family.

c.

Buildings or structures customarily accessory and incidental to a permitted use including garages, storage sheds, barns and greenhouses.

2.053.

Conditional uses. The following uses may be permitted in the R-C1 District by the board of zoning appeals (See Article VII of this ordinance):

Cemeteries.

e.

Childcare centers.

f.

Hospitals, mental health facilities and nursing homes.

g.

Broadcasting towers and stations.

2.054.

R-C1 development standards. The following minimum standards shall apply:

Sec. 2.060. - R-C2.

2.061.

Purpose. This district is established to provide for the development of a variety of housing types including single-family detached and single-family attached dwellings units at a density not greater than ten (10) dwelling units per acre (DU/AC).

2.062.

Permitted uses. The following uses are permitted in the R-C2 District:

a.

All permitted uses within the R-C1 District.

b.

Single-family attached dwellings as defined in section 1.050, definitions.

2.063.

Accessory uses. In the R-C2 District, the following accessory uses are permitted.

a.

Customary home occupations as permitted in this ordinance (See Article VI, section 6.030 of this ordinance).

b.

The keeping of not more than two (2) nontransient roomers or boarders by a resident family.

c.

Buildings or structures customarily accessory and incidental to a permitted use including garages, storage sheds, barns and greenhouses.

d.

Private recreational facilities, such as swimming pools, basketball courts and tennis courts.

e.

Raising of garden crops, vineyard crops, fruits or plants incidental to the residential use of the land.

2.064.

Conditional uses. The following uses may be permitted in the R-C2 District by the board of zoning appeals (See Article VII of this ordinance):

a.

Public utility uses.

b.

Assembly uses.

c.

Art galleries or museums.

d.

Cemeteries.

e.

Childcare centers.

f.

Hospitals, mental health facilities and nursing homes.

g.

Broadcasting towers and stations.

2.065.

R-C2 development standards. The following minimum standards shall apply:

2.066.

Open space requirement. Not less than twenty-five (25) percent of the development shall be maintained as permanent open space. Developments containing three (3) or more dwellings within a single-family attached dwelling are subject to the standards stated within this section. Parking and other paved surfaces, except patios and courtyards, shall not count toward this open space requirement.

2.067.

Application for approval. All applications for development or a change of zoning to an R-C2 District shall be accompanied by the following:

a.

A plat of the land to be included in the total development showing all rights-of-way and easements effecting the property to be rezoned to an R-C2 classification.

b.

A plat of the lots and the boundaries thereof along with the square footage contained in each lot and the location and rights-of-way of proposed streets.

c.

The location of buildings and the number of stories contained in each.

d.

The preliminary location of water supply, sanitary and storm sewer systems.

e.

The location of all curbcuts, driving lanes and parking areas.

f.

The location and type of all common areas (pedestrian walkways, open spaces, recreational uses) including a statement of the method to be used to insure continued maintenance of such areas.

g.

The location and height of all walls, fences and screen plantings.

h.

A tabulation of the total area, number of dwelling units, and overall density per acre.

Individual detached single-family dwellings not part of a common development are not subject to application requirements within this section.

2.068.

Revision of plans after final approval. Any request to change an approved development plan which effects the intent and character of the development, the density or land use pattern, the location or dimension of streets, or similar changes, shall be approved by the city planning commission. A request for revision of the development plan shall be supported by a written statement of why the revisions are necessary or desirable.

2.069.

Compliance with subdivision regulations. The development shall comply with the pertinent requirements of the subdivision regulations for the city.

Sec. 2.070. - R-HD.

2.071.

Purpose. The R-HD District is established to provide areas for high density residential development in a variety of dwelling unit types including but not limited to single-family attached dwellings and multiple-family dwellings.

2.072.

Permitted uses. The following uses are permitted in the R-HD District:

a.

All permitted uses within the R-C2 District

b.

Multi-family dwellings including apartments as defined in section 1.050, definitions.

2.073.

Accessory uses. In the R-HD District, the following accessory uses are permitted.

a.

Customary home occupations as permitted in this ordinance (See Article VI, section 6.030 of this ordinance).

b.

The keeping of not more than two (2) nontransient roomers or boarders by a resident family.

c.

Buildings or structures customarily accessory and incidental to a permitted use including garages, storage sheds, barns and greenhouses.

d.

Private recreational facilities, such as swimming pools, basketball courts and tennis courts.

e.

Raising of garden crops, vineyard crops, fruits or plants incidental to the residential use of the land.

2.074.

Conditional uses. The following uses may be permitted in the R-HD District by the board of zoning appeals (See Article VII of this ordinance):

a.

Public utility uses.

Assembly uses.

c.

Art galleries or museums.

d.

Cemeteries.

e.

Childcare centers.

f.

Hospitals, mental health facilities and nursing homes.

g.

Broadcasting towers and stations.

2.075.

2.076.

Setbacks. All single-family attached and multiple-family dwelling buildings are subject to the minimum rear and side setbacks within in table 2.075. Rear and side setback standards are only applicable to property lines. The required side setback for single-family attached dwelling buildings is only required for exterior dwelling units. Required buffers within section 2.079, buffering, can be located within the required rear and side setbacks for all multiple-family dwelling buildings.

2.077.

Building separation. A minimum of twenty (20) feet is required between buildings.

2.078.

Open space requirement. Not less than twenty-five (25) percent of the development shall be maintained as permanent open space. Developments containing three (3) or more dwellings within a single-family attached or multiple-family dwelling are subject to the standards stated within this section. Parking and other paved surfaces, except patios and courtyards, shall not count toward this open space requirement.

2.079.

Buffering. A ten (10) foot perimeter buffer shall be provided for multiple-family dwellings as defined in section 1.050. The perimeter buffer may be counted towards no more than fifty (50) percent of the required open space percentage. Perimeter buffers begin at the common property line, immediately abutting the adjacent property. Perimeter buffers shall be provided at the common property lines including rear and side lot lines. These buffers may also allow pedestrian paths and access for utilities and vehicles within the buffers. All buffers shall be platted as separate tracts to be owned and maintained by the Homeowner's Association, Property Owner's Association, or similar entity. Perimeter buffers for multiple-family dwellings shall adhere to the following standards:

1.

Ten (10) foot width;

2.

Three (3) trees per every 100 linear feet;

3.

One (1) understory tree per 100 linear feet;

4.

Fifty (50) shrubs per every 100 linear feet;

5.

Six (6) foot fence.

2.080.

Alternative buffer plan. At the discretion of the planning commission, alternate buffering plans, plant material, planting methods, or landscape design may be used where unreasonable or impractical situations would result from application of buffering requirements, or where necessary to protect existing vegetation, or where a more creative plan is proposed which substantially complies with the intent of these requirements. Buffering requirements may be reduced if existing trees or other types of existing vegetation are preserved. Alternative plans, materials, or methods may be justified from natural conditions such as streams, natural rock formations, topography, and other physical conditions related to the site. Lot configuration and the presence and location of utility easements may justify an alternative buffering plan.

2.081.
