ARTICLE IV

INDUSTRIAL DISTRICT

Sec. 4.000.- Statement of intent.

The industrial district established in this ordinance is designed to promote and protect public health, safety, and general welfare. These general goals include, among others, the following specific purposes:

a.

To provide sufficient space, in appropriate locations, to meet the needs of the city's expected future economy for all types of manufacturing and related activities, with due allowance for the need for a choice of sites.

b.

To provide, as far as possible, that such space will be available for use for manufacturing and related activities, and to protect residences by separating them from manufacturing activities and by prohibiting the uses of such space for new residential development.

c.

To encourage manufacturing development which is free from danger of fire, explosions, toxic and noxious matter, radiation, and other hazards, and from offensive noise, vibration, smoke, dust and other particulate matter, odorous matter, heat, humidity, glare, and other objectionable influences, by permitting such development in areas where this ordinance restricts the emission of such nuisances, without regard to the industrial products and processes involved.

d.

To protect adjacent residential and commercial areas, and to protect the labor force in other establishments engaged in less offensive types of manufacturing and related activities, by restricting those manufacturing activities which involve danger of fire, explosions, toxic and noxious matter, radiation and other hazards, or create offensive noise, vibration, smoke and other particulate matter, odorous matter, heat, humidity, glare, and other objectionable influences, to those limited areas which are appropriate therefor.

e.

To protect manufacturing and related development against congestion, as far as is possible and appropriate in each area, by limiting the bulk of buildings in relation to the land around them and to one another, and by providing space off public streets for parking and loading facilities associated with such activities.

f.

To promote the most desirable use of land and direction of building development in accord with a well-considered plan, to promote stability of manufacturing and related development, to strengthen the economic base of the city, to protect the character of the district and its peculiar suitability for particular uses, to conserve the value of land and buildings, and to protect the city's tax revenues. This district also supports employment, research/laboratory and workforce training uses.

Sec. 4.010. - Uses in the Industrial District.

No building or premises shall be used, and no building or group of buildings, or part of a building or structure, shall be erected, constructed, enlarged, altered, arranged or designed to be used, in whole or in part, except for one or more of the uses set forth in Article V of this ordinance. Only those uses specifically listed as being permitted in a specific district shall be permitted in that district, except that of a caretaker or watchman and his family may reside in a dwelling unit on the premises where he is employed.

Sec. 4.020. - Schedule of standards in the Industrial District.

The following table is presented only for the convenience of the user of this ordinance. All standards listed in this table are stated in more detail elsewhere in this article as well as in other sections of this ordinance, and final information must be secured by the user from these other sources.

Sec. 4.040. - M - Industrial District.

This district is established to provide areas for manufacturing, assembling, fabricating, warehousing and related activities, generally known as industrial uses. The Industrial District designation is the letter "M". These uses generate some emissions and have some adverse effects on surrounding properties and are not compatible with primary commercial, institutional, and residential uses.

4.041.

Permitted uses. In the Industrial District, uses permitted as a matter of right shall be as identified in Article V of this ordinance.

4.042.

Accessory uses. In the Industrial District, the following accessory uses are permitted:

a.

Any accessory building or use customarily incidental to a permitted use, in the opinion of the director, may be permitted.

4.043.

Conditional uses. The following uses may be permitted in the Industrial District by the board of zoning appeals (See Article VII of this ordinance):

a.

Any conditional use identified in Article V of this ordinance.

b.

Similar uses which are, in the opinion of the board of zoning appeals, of the same general character as those uses listed in Article V of this ordinance as conditional uses in the M-2 District.

4.044.

Intensity of use. In the Industrial District, the following standards shall apply:

a.

Every lot shall have a minimum area of one (1) acre.

b.

The maximum impervious surface coverage for lots shall be eighty (80) percent.

c.

The minimum lot frontage for all uses shall be one hundred (100) feet.

d.

The minimum lot width at the building line shall be one hundred (100) feet.

4.045.

Building line setbacks. The minimum required setbacks for all buildings and structures from abutting street rights-of-way and from side and rear property lines shall be as follows:

a.

The minimum front building line setback from all abutting street rights-of-way shall be seventy-five (75) feet.

b.

The minimum building line setback from each side property line shall be thirty (30) feet.

c.

The minimum building line setback from the rear property line shall be thirty (30) feet.

4.046.

Height restrictions. No building or structure shall exceed forty (40) feet in height except as exempted in Article VI of this ordinance.
