ARTICLE 6

- BUSINESS DISTRICTS

Sec. 6-1.- OI Office-Institutional District.

A.

The Office-Institutional district is intended to encourage development of suitable business, institutions, and professional enterprises of a character and density deemed compatible with the primary purpose of this district.

B.

Lot standards:

C.

Building placement.

Minimum Setbacks

B Side 15 feet

D.

Maximum height: Six stories.

Sec. 6-2. - C-1 Neighborhood Commercial District.

A.

This district is intended to provide locations for limited retail and service uses to satisfy the common and frequent needs of nearby residents of nearby residential neighborhoods.

B.

Lot standards:

B Minimum lot width 60 feet *

D.

Maximum height: 30 feet.

E.

Maximum building footprint: No building footprint may exceed 15,000 square feet.

Sec. 6-3. - C-2 General Commercial District.

A.

Purpose. This district is intended to provide locations for a wide variety of retail and service uses and wholesale establishments to satisfy the common and frequent needs of residents in large sections of the City and of the traveling public.

B.

Lot standards:

C.

Building placement.

C Side street 30 feet
D Rear 20 feet

 

D.

Maximum height: 40 feet.

E.

Applicability. This district shall only be located on parcels that are located entirely or partially within 1,000 linear feet (as measured in a straight line from the portion of the lot closest to the right-of-way) of a route under the jurisdiction of the State of Georgia Department of Transportation.

Sec. 6-4. - C-3 Heavy Commercial District.

A.

Purpose. This district is intended to provide distinct areas for commercial activities which provide products and services that require locations along major roads, due to the need to transport and display heavy bulk materials, generate heavy traffic, and which provide services that would not be appropriately located in areas providing neighborhood or general commercial retail and service activities as permitted in C-1 and C-2 districts.

D.

E.

Applicability. This district shall only be located on parcels that are located entirely or partially within 1,000 linear feet (as measured in a straight line from the portion of the lot closest to the right-of-way) of a route under the jurisdiction of the State of Georgia Department of Transportation.

Sec. 6-5. - M-1 Light Industrial District.

A.

Purpose. This district is to provide for light industrial uses, none of which shall cause injurious or obnoxious noise, vibrations, smoke, gas, fumes, odor, dust, fire hazard, or other objectionable conditions to nearby areas, not shall they generate hazardous wastes.

B.

E.

Applicability. This district shall only be located on parcels that abut an arterial street or within industrial parks having access to such a street.

Sec. 6-6. - M-2 Heavy Industrial District.

Purpose. This district provides for the broadest range of industrial operations permitted in the City. It is the district for location of those industries which have not reached a technical stage which renders them free of all nuisance factors.

C.

Maximum height: 75 feet.

Required buffer: 50 feet on all sides (see Section 3-16).

E.

Applicability. This district shall only be located on parcels that abut an arterial street or within industrial parks having access to such a street.

Sec. 6-7. - Allowed Uses.

A.

In order to regulate a variety of similar uses, use categorizes have been established for principal uses. Principal and accessory uses allowed by district are shown in the table below. All uses are subject to all applicable requirements of this Ordinance.

1.

Permitted Use (P). Indicates a use is permitted in the respective district.

2.

Conditional Use (CU). Indicates a use may be permitted in the respective district only where approved by the City Council.

3.

Use Not Permitted. A "-" in a cell indicates that a use is not permitted in the respective district.

B.

A use not specifically listed is prohibited unless the Zoning Administrator determines the use to be part of a use category as described below. If a proposed use is not listed in a use category, but is similar to a listed use, the Zoning Administrator may consider the proposed use part of that use category. When determining whether a proposed use is similar to a listed use, the Zoning Administrator must consider the following criteria:

1.

Actual or projected characteristics of the proposed use.

2.

Amount of site area or floor area and equipment devoted to the proposed use.

3.

Sales volume.

4.

Type of customer.

5.

Number of employees.

6.

Hours of operation.

7.

Building and site arrangement.

8.

Types of vehicles used and their parking requirements.

9.

Number of vehicle trips generated.

10.

How the proposed use is advertised.

11.

Likely impact on surrounding properties.

12.

Whether the activity is likely to be found independent of the other activities on the site.

C.

Where a use not listed is found by the Zoning Administrator not to be similar to any other permitted use, the use is only permitted following a text amendment per Section 12-7.
