- RESIDENCE DISTRICTS
The regulations for residence districts are designed to conserve established residential areas and to promote the efficient use and orderly development of vacant land designated and regulations imposed for various types of residential development in order that the village can plan ahead for public services and facilities such as schools, parks, streets, utilities, fire and police protection, and the eventual rehabilitation of structures.
Unless otherwise provided in the regulation of this ordinance, the following provisions shall apply to all residence districts:
5.2(1) Home occupations. In all residence districts, a home occupation shall be permitted provided:
5.2(1)(a) It is conducted entirely within the dwelling and only by immediate members of the family residing in the dwelling, and when such home occupation is incidental and secondary to the use for dwelling purposes. No employees outside the immediate family shall be allowed.
5.2(1)(b) It is not conducted from a detached or attached accessory building nor does it require internal or external alteration, or involve construction features not customary in a dwelling, and the entrance to the space devoted to such occupation shall be from within the dwelling, and not more than 15 percent of the total floor area of the dwelling (including a basement or cellar) shall be devoted to such home occupation.
5.2(1)(c) There are no vehicles, signs, display or activity that will indicate from the exterior of a dwelling that it is being used in part for any purpose other than that of a dwelling.
5.2(1)(d) No mechanical equipment is used except that which is customarily used for purely domestic or household purposes.
5.2(1)(e) Stock in trade, including that which is produced on the premises, shall not require receipt or delivery of merchandise, goods or equipment other than by United States letter carrier mail, similar parcel delivery service, or by private passenger automobile.
5.2(1)(f) There is no perceptible noises, odor, smoke, electrical interference or vibration emanating from the structure in which the home occupation is conducted.
5.2(1)(g) The address of the dwelling must not be contained in any advertisement or telephone listing for the occupation.
5.3(1) Permitted uses. In accordance with regulations set forth in article IV, section 4.8.
5.3(2) Special uses. In accordance with regulations set forth in article IV, section 4.8.
5.3(3) Lot area:
5.3(3)(a) Single-family detached dwellings: Not less than 8,600 square feet.
5.3(3)(b) Non-residential uses: Not less than 17,200 square feet except as may be otherwise required in this ordinance.
5.3(4) Lot width:
5.3(4)(a) Single-family detached dwellings: Not less than 50 feet.
5.3(4)(b) Non-residential uses: Not less than 100 feet.
5.3(5) Building height:
5.3(5)(a) Single-family detached dwellings: Not more than 35 feet.
5.3(5)(b) Public buildings, churches, and schools, and other uses: Not more than 45 feet, provided the yards are in compliance with paragraph 5.3(8) of this section.
5.3(6) Floor area ratio:
5.3(6)(a) Single-family detached dwellings: Not applicable.
5.3(6)(b) Non-residential uses: Not to exceed 0.25.
5.3(7) Intensity of use. No use, including its accessory buildings and structures but excluding walks, patios and drives, shall occupy in excess of 35 percent of a lot. Walks, patios and drives may cover no more than 20 percent of the lot.
5.3(8) Yards:
5.3(8)(a) Front yard:
5.3(8)(a)(i) The front yard shall not be less than 30 feet in depth except as otherwise provided herein.
5.3(8)(a)(ii) Corner lots must contain a front yard on each side of the lot facing a street, provided, that the buildable width is not reduced to less than 25 feet and the yard adjoining the side street is not less than 20 feet.
5.3(8)(a)(iii) No accessory building or garage shall project beyond the front yard line.
5.3(8)(a)(iv) A front yard shall be provided on both streets of lots with double frontage.
5.3(8)(b) Side yards:
5.3(8)(b)(i) There shall be two side yards required, with a combined width of not less than 15 feet.
5.3(8)(b)(ii) Neither of the required side yards shall be less than five feet.
5.3(8)(c) Rear yard. There shall be a required rear yard of not less than 20 feet or 20 percent of lot depth, whichever is less.
5.3(8)(d) Buildings in excess of 35 feet. For structures in excess of 35 feet in height, each yard required shall be increased by one foot for each one feet that the structure exceeds 35 feet in height.
5.3(8)(e) Accessory uses. Yard requirements for accessory uses shall be in accordance with the standards set forth in article III, section 3.10.
5.4(1) Permitted uses. In accordance with regulations set forth in article IV, section 4.8.
5.4(2) Special uses. In accordance with regulations set forth in article IV, section 4.8.
5.4(3) Lot area:
5.4(3)(a) Single-family detached dwellings: Not less than 6,200 square feet.
5.4(3)(b) Non-residential uses: As in R-1 district.
5.4(4) Lot width. As in the R-1 district.
5.4(5) Building height. As in the R-1 district.
5.4(6) Floor area ratio. As in the R-1 district.
5.4(7) Intensity of use. As in the R-1 district.
5.4(8) Yards. As in the R-1 district.
5.5(1) Permitted uses. In accordance with the schedule of uses in section 4.8.
5.5(2) Special uses. In accordance with the schedule of uses in section 4.8.
5.5(3) Maximum density. No more than 12 dwelling units per acre are permitted.
5.5(4) Minimum lot area.
5.5(4)(a) Single-family detached and two-family dwellings: 6,200 square feet.
5.5(4)(b) Townhouse and multiple-family dwellings: 3,630 square feet per dwelling unit.
5.5(4)(c) Non-residential uses: As in the R-1 district.
5.5(5) Lot width.
5.5(5)(a) Single-family detached and two-family dwellings, a lot width of 50 feet is required.
5.5(5)(b) Townhouses, a lot width of 20 feet per dwelling unit is required.
5.5(5)(c) Multiple-family dwellings, a lot width of 60 feet is required.
5.5(5)(d) For non-residential uses, as in the R-1 district.
5.5(6) Building height. As in the R-1 district.
5.5(7) Floor area ratio:
5.5(7)(a) Single-family detached, two-family dwellings and townhouses: Not applicable.
5.5(7)(b) Multiple-family dwellings and non-residential permitted and special uses: Not more than 0.4.
5.5(8) Yards:
5.5(8)(a) For single-family detached, two-family dwellings and townhouses:
5.5(8)(a)(i) A front yard is required and shall be not less than 25 feet in depth.
5.5(8)(a)(ii) Single-family detached and two-family dwellings are required to have two side yards not less than ten feet wide each, provided that where a side yard adjoins a street, it shall be at least 25 feet in width. End unit townhouses are required to have a side yard no less than ten feet wide, provided that where a side yard adjoins a street, it shall be at least 25 feet in width. These side yard requirements apply provided that the buildable width is not reduced to less than 25 feet.
5.5(8)(a)(iii) A rear yard is required and shall be not less than 20 feet in depth.
5.5(8)(b) For multiple-family dwellings:
5.5(8)(b)(i) A front yard is required and shall be not less than 20 feet in depth.
5.5(8)(b)(ii) Two side yards are required and shall not be less than ten feet in width, provided that where a side yard adjoins a street, it shall be at least 25 feet in width.
5.5(8)(b)(iii) A rear yard is required and shall be at least 20 feet in depth.
5.5(8)(c) For non-residential uses: As in the R-1 district.
5.5(9) Spacing between structures. When two or more residential structures are on a lot or on contiguous lots comprising a unified development under the same ownership or control, the distance between the structure walls shall be as follows:
5.5(9)(a) When the front wall of a structure faces the front wall or rear wall of the nearest structure, the distance between the two structure walls shall be not less than 40 feet.
5.5(9)(b) When the rear wall of a structure faces the rear wall of the nearest structure, the distance between the two structure walls shall be not less than 30 feet.
5.5(9)(c) When the side wall of a structure faces the front or rear wall of the nearest structure, the distance between the two structure walls shall be not less than 30 feet, except when the side wall contains more than two windows on a floor that are not from bathrooms or storage rooms, such distance between structures shall be not less than 40 feet, or 50 feet if a main entrance doorway is in such side walls.
5.5(9)(d) When the side wall of a structure faces the side wall of the nearest structure, the distance between the two structure walls shall be not less than 20 feet, except when the facing side walls of either of such structures contain more than two windows on a floor that are not from bathrooms or storage rooms, such distance between the two structures shall be not less than 40 feet, or 50 feet if a main entrance doorway is in such side wall.
5.5(9)(e) A wall of a structure forming the end of a court shall be not less than ten feet from the nearest wall of a structure forming the sides of the court and a structure forming the end of the court may be attached to one or both of the structures forming the sides of the court, provided the distance between facing walls of the structures forming the sides of the court is not less than the applicable requirements as set forth above.
5.5(9)(f) Where structures are not parallel to each other the required spacing shall be measured at the midpoint of the distance along which they face each other; however, the spacing between the structures at the narrowest point shall, in no event be less than two-thirds of the required distance.
5.6(1) Permitted uses. In accordance with regulations set forth in article IV, section 4.8.
5.6(2) Special uses. In accordance with regulations set forth in article IV, section 4.8.
5.6(3) Maximum density. No more than 16 dwelling units per acre are permitted.
5.6(4) Minimum lot area.
5.6(4)(a) Single-family detached and two-family dwellings: 6,200 square feet.
5.6(4)(b) Townhouse and multiple-family dwellings: 2,725 square feet per dwelling unit.
5.6(4)(c) Non-residential uses: As in the R-1 district.
5.6(5) Lot width. As in the R-3 district.
5.6(6) Usable open space:
5.6(6)(a) On sites having a net land area of up to 99,999 square feet, there shall be 200 square feet usable open space for each dwelling unit.
5.6(6)(b) On sites having net land area of 100,000 to 153,999 square feet, there shall be 200 square feet of usable open space for each dwelling unit for the first 100 units, and 400 square feet of usable open space per unit thereafter.
5.6(6)(c) On sites having a net land area of 154,000 square feet or more, there shall be 400 square feet of usable open space for each dwelling unit for the first 150 units, and 600 square feet of usable open space per unit thereafter.
5.6(7) Floor area ratio. Multiple-family dwellings, and non-residential permitted and special uses: Not more than 0.6.
5.6(8) Building height. Building height shall not exceed 45 feet except as otherwise allowed in section 11.11 [11.10] on planned developments.
5.6(9) Yards. No building shall be erected or enlarged unless the following yards are provided: Front, side and rear yards are required and shall not be less than 25 feet in depth. Two feet of additional yard depth will be required for every foot of height in excess of 35 feet, provided the required yards shall not exceed 100 feet in depth.
5.6(10) Spacing between structures. As in the R-3 district.
5.6(11) Off-street parking and loading. Off-street parking and loading shall be in accordance with the provisions of article VIII, except:
5.6(11)(a) On sites having a net land area of 100,000 to 153,999 square feet, one-half of all required parking spaces shall be located inside the structure or underground.
5.6(11)(b) On sites having a net land area greater than 154,000 square feet, all required parking spaces in excess of the first 150 shall be located inside the structure or underground.
5.6(12) Landscaping requirements. All front yards shall be sodded and all areas not used for parking and driveways shall be landscaped. All open off-street parking areas and driveways will be screened from adjoining residential lots as provided by article VIII.
