ARTICLE VI

BUSINESS DISTRICT

6.1.- General provisions.

6.1(1) Dwelling units. Dwelling units and lodging rooms existing on the effective date of this ordinance are permitted as specified in section 4.8.

6.1(2) Enclosure of operations. All business, servicing, or processing shall be conducted within a completely enclosed building except:

6.1(2)(a) Off-street parking and loading.

6.1(2)(b) Drive-in type operations and open sales lots as provided for in this ordinance.

6.1(2)(c) Other temporary uses if associated with a permanent allowable use as listed under section 4.8 and if approved by the village board.

6.1(3) Performance standards. All activities shall conform with the performance standards established for the M-1 office and restricted industrial district, and in every case shall be applied at the boundaries of the lot on which such activities take place.

6.1(4) Parking limitations. Parking of trucks and commercial vehicles when accessory to the conduct of a permitted use shall be limited to automobile tow trucks and delivery vehicles having not over 1½ tons capacity, except for customers and pick-up or delivery services during normal business hours. No other commercial vehicles may be parked in any business district.

6.1(5) Scope of operations:

6.1(5)(a) All business establishments shall be primarily retail trade or service establishments dealing directly with consumers. All goods produced on the premises shall be sold on the premises where produced except for specific uses in the district, where processing, and fabricating or wholesale sales are permitted.

6.1(5)(b) Unless otherwise permitted herein for specified uses, goods sold shall consist solely of new merchandise.

6.1(6) Lighting. All outdoor lighting shall be of the diffused mercury vapor type or equivalent and shall be so located, or shielded, as not to shine into or upon adjoining residential property.

6.2. - B-1 general business district.

6.2(1) Permitted uses. In accordance with the regulations set forth in section 4.8, provided that dwelling units shall require a minimum lot area of 2,500 square feet per dwelling unit in addition to the minimum lot area for the commercial use.

6.2(2) Special uses. In accordance with the regulations set forth in section 4.8.

6.2(3) Floor area ratio. For all uses - 0.6, except as to lots located on a given side of any street between two intersecting streets where at least two thirds of the total of such lots are improved with buildings adaptable to commercial use, in which case the floor area ratio may be equal to the established floor area ratio of an improved adjacent lot.

6.2(4) Building height. Not more than 35 feet.

6.2(5) Yards:

6.2(5)(a) Front: No front yard is required except when adjacent to a residential front yard, the front yard requirements of the adjoining district shall apply in full; if there is an intervening alley, 50 percent of the requirement shall apply. Where a front yard is established on adjacent properties, said established front yard shall be adhered to.

6.2(5)(b) Side: No side yard is required except that if a yard is provided it shall not be less than five feet in width, and that when the adjoining property is in a residential district there shall be a side yard adjoining said residential property which shall not be less than five feet in width.

6.2(5)(c) Rear: There shall be a rear yard of not less than ten percent of the depth of the lot, provided, however, that the rear yard need not exceed ten feet in depth. No rear yard is required when the rear lot line of business property is contiguous to an open and improved public alley.

6.2(6) Building coverage. No building with its accessory structure shall cover in excess of 60 percent of the area of the lot, except as to lots located on a given side of any street between two intersecting streets where at least two thirds of the total of such lots are improved with buildings adaptable to commercial use, in which case the percentage of coverage may be equal to the established use of an improved adjacent lot.

6.2(7) Landscaping requirements. All yards, and other areas not used for parking and driveways shall be landscaped. All off-street parking areas and driveways will be screened from adjoining residential lots as provided by article VIII, subsection 8.4(10)(d), off-street parking regulations.

6.3. - B-2 planned shopping center district.

6.3(1) Permitted uses. In accordance with regulations set forth in article IV, section 4.8.

6.3(2) Special uses. In accordance with regulations set forth in article IV, section 4.8.

6.3(3) Floor area ratio. For all uses - 0.9.

6.3(4) Building height. Not more than 60 feet.

6.3(5) Minimum lot size. A B-2 planned shopping center district shall be comprised of a contiguous area of not less than seven acres.

6.3(6) Yards:

6.3(6)(a) No buildings shall be built or maintained within 25 feet of any property line adjacent to a limited access expressway, or within 50 feet of a street other than a limited access highway or within 100 feet of a lot line in a residence district.

6.3(6)(b) The area extending from the yard line to within 15 feet of the street right-of-way may be occupied by drives, vehicular parking, sidewalks, landscaping, and similar facilities; and all areas between the street right-of-way line and yard line which are not occupied by such facilities, including the 15 feet adjoining the street, shall be appropriately landscaped.

6.3(7) Building coverage. No building with its accessory structures shall cover in excess of 60 percent of the area of the lot.

6.3(8) Landscaping requirements. All yards, and other areas not used for parking and driveways shall be landscaped. All off-street parking areas and driveways will be screened from adjoining residential lots as provided by article VIII, section 8.4(10)(d), off-street parking regulations.
