ARTICLE 1

- GENERAL PROVISIONS

Sec. 16-1-1.- Title.

(A)

This ordinance shall be known and may be cited as:

(1)

"Unified Development Ordinance,"

(2)

"UDO," and

(3)

"This chapter."

Sec. 16-1-2. - Purposes, Interpretation, and Jurisdiction.

(A)

Purposes. This UDO is enacted for the purposes of:

(1)

Promoting the health, safety, peace, morals, comfort, convenience, prosperity, order, and general welfare,

(2)

Reducing danger and congestion of public transportation,

(3)

Providing adequate light and air, public utilities, facilities and service, and other public requirements,

(4)

Promoting productive and enjoyable harmony between man and his environment; to achieve a balance between population and resource use which will permit high standards of living and a wide sharing of amenities,

(5)

Preventing overcrowding of land and undue encroachment thereon,

(6)

Promoting efforts which will prevent or eliminate damage to the environment and biosphere,

(7)

Stimulating and assuring for all citizens safe, healthful, productive, and aesthetically and culturally pleasing surroundings,

(8)

Encouraging the residential, commercial, and industrial growth of the community as well as the most appropriate use of land, and

(9)

Encouraging the development of the community in accordance with the Jenks Comprehensive Plan, and as amended.

(B)

Interpretation.

(1)

Validity of Other Laws. Where this UDO imposes a greater restriction upon the use of buildings, structures, or land or upon height or bulk of buildings or structures or requires larger open space or yards than are imposed by other ordinances, laws, or regulations, the provisions of this UDO shall govern. However, nothing in this UDO shall be construed to prevent the enforcement of other ordinances, laws, or regulations which prescribe more restrictive limitations.

(2)

Severability. In case any portion of this UDO shall be invalid or unconstitutional, as declared by a court of competent jurisdiction, the remainder of the code shall not thereby be invalid but shall remain in full force and effect.

(3)

Definition. For the purpose of this UDO certain terms and words are to be used and interpreted as defined in article 11, Definitions, of this UDO.

(4)

Tense.

(a)

Words used in the present tense shall include the future tense.

(b)

Words in the singular include the plural and words in the plural number include the singular, except where the natural construction of the writing indicates otherwise.

(c)

The words "shall" and "will" are mandatory.

(C)

Jurisdiction.

(1)

Territorial Jurisdiction. This UDO shall be in full force and effect and shall apply to all lands within the incorporated limits of the City of Jenks, Oklahoma.

(2)

Annexed Territory. When any territory shall be brought into the jurisdiction of the City of Jenks, Oklahoma, by annexation or otherwise, such territory shall be deemed to be in an AG Agriculture District. This provision shall not operate to preclude subsequent zoning of such property by amendment in the manner set forth in section 16-9-13.

(3)

Property owned, leased, or operated by the City of Jenks, Oklahoma, or any other public or governmental body or agency shall be subject to the terms of this UDO.
