§ 38-9.5

Violations and Penalties.

a. 
Complaints of Violations. Any person may file a complaint if there is any reason to believe a violation of this chapter exists regarding a violation of the building code, certificate of occupancy requirements, zoning permit requirements or conditions of site plan, subdivision or variance approvals. All such complaints must be in writing and shall be filed with the Construction Official, who shall properly record such complaint and immediately investigate.
b. 
Procedures for Abatement of Violations. A violation of any of these terms of this chapter shall be abated within five days, or within as reasonable a time as may be determined, after written notice has been served, either by mail or personal service.
c. 
Penalties. Any person, firm or corporation violating any provision of this chapter, shall upon conviction be subject to a fine of not less than $100 nor more than $1,000 for each offense or imprisonment not exceeding 90 days or both, in the discretion of the Court imposing sentence pursuant to N.J.S.A. 40:49-5. Each day that a violation occurs or is committed shall constitute a separate offense. The imposition of the penalties herein prescribed shall not preclude the Town of Kearny from instituting an appropriate action or proceeding to prevent an unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, or to restrain, correct or abate a violation, or to prevent the occupancy of a building or structure or premises, or to prevent an illegal act, conduct, business or use in or about any premises.
