MF MULTI-FAMILY RESIDENTIAL DISTRICT

Sec. 157.200 - General purpose and description.

The Multi-Family Residential District is intended to provide for medium to higher density residential development. This district functions as a buffer or transition between major streets, non-residential areas or higher density residential areas and lower density residential areas. Density in this district shall not exceed 15 units per gross acre. Buildings are restricted to no more than two stories in height.

Sec. 157.201 - Permitted uses.

A building or premise shall be used only for the following purposes:

(1)

Three or more single-family attached dwelling units; provided that, no more than six dwelling units are attached per level or floor in one continuous row or group;

(2)

A multi-family group:

a.

A multi-family dwelling must have a minimum living area as follows:

1.

One bedroom or studio: 550 square feet;

2.

Two bedroom: 700 square feet; and

3.

Three bedroom: 900 square feet.

b.

The maximum number of occupants in a multi-family unit is two occupants per bedroom. Other state, federal or local codes/ordinances or laws may apply.

c.

Each multi-family building must be at least ten feet from other buildings or dwellings.

d.

The rear setback must be at least 20 feet.

e.

The garage or carport must have a setback of at least 15 feet in the front or ten feet in the rear.

Every multi-family dwelling project shall have a minimum of 15 percent of the land for green space/playground area which includes the following specifications:

a.

Area must be a minimum of 60 percent wide as it is long;

b.

Must be an open area free of sidewalks, portable buildings, lakes or bogs;

c.

Each five acres or portion of five acres requires a separate playground;

d.

Dedicated paved public roads must be subtracted from total lot size before figuring green space/playground area; and

e.

The green space/playground area must be a minimum of 75 percent grass with any remaining space covered with a permeable material.

Sec. 157.202 - Permitted specific uses.

The following specific uses shall be permitted when granted in accordance with sections 157.365 and 157.366: uses as listed in section 157.330.

Sec. 157.204 - Parking regulations.

Three off-street parking spaces shall be provided per unit. Also see the city's parking ordinance.

Sec. 157.205 - Refuse facilities.

(a)

Every dwelling unit in a multi-family complex shall be located within 250 feet of a refuse facility; measured along the designated pedestrian and vehicular travel way. There shall be available at all times at least six cubic yards of refuse container per 30 multi-family dwelling units. For complexes with less than 30 units, no less than four cubic yards of refuse container shall be provided.

(b)

Each refuse facility shall be screened for view on three sides from persons standing at ground level on the site or immediately adjoining property, by an opaque fence or wall of wood or masonry not less than six feet or more than eight feet in height or by an enclosure within a building.

(c)

Refuse containers shall be provided and maintained in a manner to satisfy city public health and sanitary regulations.

(d)

Each refuse facility shall be located so as to provide safe and convenient pickup by refuse collection agencies.

Sec. 157.206 - Screening fence.

(a)

Border fencing of wood or masonry of not less than six feet in height shall be installed by the builder at the time of construction of any multi-family complex, along the property line on any perimeter not abutting a public street or right-of-way.

(b)

This fence shall be maintained throughout the existence of the multi-family complex by the owner of the complex.

Sec. 157.207 - Special fire protection requirements.

Whenever densities of greater than ten units per acre are present, each building in the development shall, at the time of the construction and thereafter, be operated in accordance with currently applicable Building and Fire Safety Codes.
