C-1 COMMERCIAL DISTRICT—OFFICE, LIGHT RETAIL AND NEIGHBORHOOD SERVICES

Sec. 157.220 - General purpose and description.

(a)

The Commercial District C-1 is intended for small, neighborhood-oriented office and shopping facilities which retain and preserve a neighborhood service character. The C-1 District is established to accommodate the daily and frequent needs of the neighborhood and to some extent, the community.

(b)

The following regulations shall be applicable to all uses in the district:

(1)

The business shall be conducted wholly within an enclosed building;

(2)

Required yards shall not be used for display, sale or storage of merchandise or for the storage of vehicles, equipment, containers or waste material;

(3)

All merchandise shall be sold at retail on the premises;

(4)

Such use shall not be objectionable because of odor, excessive light, smoke, dust, noise, vibration or similar nuisance;

(5)

a.

Signs are limited to one flat, 16 square foot, wall mounted sign per business.

b.

Signs with internal lighting, neon signs and similar signs are not allowed.

c.

No sign or lighting under this chapter shall be authorized whereby such sign or lighting by reason of placement, lack of shielding, noise generation or character of operation would be adverse to the normal sensibilities of a person residing on adjacent property or would interfere with the reasonable use, enjoyment or right of privacy on his or her property. Specifically:

1.

The noise level of signs and lighting fixtures, when measured within the adjacent dwelling unit, shall not be greater than the noise levels of equipment customarily in operation in the home including air conditioning and refrigerators;

2.

Flashing signs and intermittent lighting of signs or areas shall not be permitted; and

3.

No light shall be focused toward an adjacent property.

(c)

Adequate off-street parking must be provided as stated in section 157.224; except that, parking shall be permitted only at the side or rear of the building.

(d)

The overall effect of the building and landscaping shall be such that it blends with the aesthetic nature of the neighborhood. Using this standard, the Planning and Zoning Commission shall approve the site plan.

(e)

Height and area regulations. In District C-1, the height of buildings and the minimum dimensions of the lots and yards shall be the same as mandated in Appendix A.

Sec. 157.221 - Permitted uses.

A building or premise shall be used only for the following purposes:

(1)

Variety or boutique stores of not greater than 5,000 square feet floor space; and

(2)

Other uses as listed in section 157.330.

Sec. 157.222 - Permitted specific uses.

The following specific uses shall be permitted in the C-1 District, when granted in accordance with sections 157.365 and 157.366: other uses as listed in section 157.330.
