Killingworth, CT Zoning Ordinance

The purpose of this regulation is to protect the quality of groundwater through control of those activities that contribute pollutants to aquifers designated as existing or potential sources of public water supply.

For the purpose of this regulation, the following terms shall have the meaning given herein:

AQUIFER

A geologic unit capable of yielding usable amounts of water.

HAZARDOUS MATERIAL

Material or chemicals which may pose a present or potential hazard to human health or the environment when improperly stored, transported or disposed of or otherwise managed, including without exception hazardous waste identified and listed in accordance with Section 3001 of the Resource Conservation and Recovery Act of 1976.

PRIMARY RECHARGE AREA

That area immediately overlying the stratified drift aquifer and adjacent areas of stratified drift that may not have sufficient thickness to be part of the aquifer. The boundary of the primary recharge area is the contact between stratified drift and adjacent till or bedrock.

SECONDARY RECHARGE AREA

The land adjacent to the primary recharge area from which groundwater moved down gradient into the aquifer.

The boundaries of the Hammonasset River Aquifer Protection Zone, comprising primary and secondary recharge areas of aquifers designated as existing or potential sources of public water supply, are based on data established by the United States Geological Survey. Such boundaries are shown on a map prepared by the Soil Conservation Service of the United States Department of Agriculture and titled "Aquifer Recharge Area."

Use regulations. Within a designated Hammonasset River Aquifer Protection Zone, no land shall be used and no structures erected, constructed, reconstructed, altered or used except in conformance with these regulations and all other requirements of the applicable zone. All uses which are permitted in the existing land use zones are also permitted in an aquifer protection zone with the following exceptions, restrictions and requirements.

Uses prohibited. The following uses are prohibited:

(1)

Disposal of solid waste in sanitary landfills or dumps.

(2)

Disposal or storage of hazardous materials.

(3)

Septic lagoons and community sewer facilities.

(4)

Road salt storage sites.

Underground fuel oil storage tanks. Underground fuel oil storage tanks and piping shall be designed in conformance with the rules and regulations of the State Fire Marshal as authorized under §§ 29-319 through 29-323 of the Connecticut General Statutes. The Building Official shall inspect the fuel storage facilities prior to backfilling to ensure prevention of leakage.
