ARTICLE XXIV
Historical and Archaeological Features Preservation Plan
§ 500-142 Plan required.
In order to preserve archaeological and historic sites in the Town of Killingworth, the applicant shall submit a plan for the protection of historical, archaeological, and other unusual features shown under § 500-151D(8). The plan shall describe procedures to identify, protect, preserve or properly remove the features. A plan shall also be submitted should any of the features in § 500-151D(8) be uncovered during work or construction.
§ 500-143 Contents of plan.
The plan shall be undertaken by the applicant and should include the following:
A.
Identification of any historical, archaeological, and other unusual features shown under § 500-151D(8);
B.
An evaluation of the impact of the development on the subject sites and features; and
C.
A description of measures to be taken to mitigate any adverse impact of the development on the site and to protect and preserve the sites and features. These measures may include inclusion of the site in land dedicated to open space; conservation easements; locating roads, buildings, excavations or other improvements so as to minimize impact on sites; restoration of historic structures; or proper removal to an appropriate location.
§ 500-144 Requirements for approval.
Where it is found that the project will adversely impact a historically or archaeologically sensitive area or feature, the Commission shall not approve the project unless:
A.
Provision has been made by the applicant for a more intensive site investigation to be conducted by qualified professionals, such as a professional archaeologist or professional historian approved by the Commission; and/or
B.
The proposed project has been otherwise revised or modified to protect historic and archaeological sites and to mitigate adverse impacts.
