TITLE XV

OFF-STREET PARKING AND OFF-STREET LOADING

Section 1. - Scope of regulations.

The off-street parking and off-street loading provision of this ordinance shall apply as follows:

A.

Accessory off-street parking and off-street loading facilities shall be provided as required by the regulations of this title for all buildings and structures erected and all uses of land established in each district after the effective date of this ordinance. However, where a building permit has been issued prior to the effective date of this ordinance, and provided that construction is begun within six months of such effective date and diligently prosecuted to completion, parking, and loading facilities in the amounts required for this issuance of said building permit may be provided in lieu of any different amounts required by this ordinance.

B.

When the intensity of use of any building, structure or premises shall be increased through the addition of dwelling units, gross floor area, seating capacity or other units of measurement in the amount specified herein requiring parking or loading facilities, such additional parking and loading facilities as required herein shall be provided.

C.

Whenever the existing use of a building or structure shall hereafter be changed to a new use, parking or loading facilities shall be provided as required for such new use. However, if the said building or structure were erected prior to the effective date of this ordinance, additional parking or loading facilities are mandatory only in the amount by which the requirements for the new use would exceed those for the existing use, if the latter were subject to the parking and loading provisions of this ordinance.

Section 2. - Existing parking facilities.

Accessory off-street parking facilities in existence on October 9, 1973, and located on the same lot as the building or use served shall not hereafter be reduced below the current parking facilities in existence.

Section 3. - Permanency of spaces provided.

Any parking or loading space in existence on October 9, 1973, which is used or intended to be used in connection with any building, structure or use, or any space designed and intended to comply with the requirements of this ordinance for any such building or structure erected after October 9, 1973, shall hereafter be maintained in conformance with the provision of this ordinance so long as said building or structure remains, unless the owner provides in another location an equivalent number of spaces in conformance with the provisions of this ordinance. The plan commission shall at all times be furnished proof in writing of permanence of the parking area provided in compliance with this ordinance.

Section 4. - Off-street parking.

Off-street parking facilities for motor vehicles shall be provided in accordance with the additional regulations set forth hereinafter:

A.

Use. Accessory off-street parking facilities required as accessory to uses listed herein, shall be solely for the parking of passenger automobiles of patrons, occupants or employees. (When bus transportation is provided for patrons, occupants or employees of a specific establishment, additional open or enclosed off-street parking spaces for each bus to be parked on the premises shall be provided in accordance with regulations herein.)

B.

Collective provision. Off-street parking facilities for separate uses may be provided collectively if the total number of parking spaces provided is not less than the sum of the required parking spaces for the individual uses unless otherwise authorized by the board of zoning appeals.

C.

Plans for the layout of off-street parking shall be in accordance with the following minimum requirements:

All maneuvering lane widths shall permit one-way traffic movement, with the exception of the 90 degree pattern where two-way movement may be permitted.

D.

Enclosed areas. Enclosed parking spaces shall have a vertical clearance of at least seven feet.

E.

Access. Each required off-street parking space shall open directly upon an aisle or driveway of such width and design as to provide safe and efficient means of vehicular access to such parking space. All off-street parking facilities shall be designed with the appropriate means of vehicular access to a street or alley in a manner which will not interfere with traffic movement. Access ways and parking spaces may be used for off-street parking only in the A agriculture, RR rural residential, R-1 residential and R-2 residential districts. No driveway across public property at the right-of-way line shall exceed a width of 28 feet.

F.

In yards. Off-street parking spaces, open to the sky, may be located in any yard except a front yard except as provided for in subsection E above. Enclosed buildings and carports containing off-street parking spaces shall be subject to applicable yard requirements.

G.

Design and maintenance.

1.

Accessory parking spaces may be open to the sky or enclosed in a building.

2.

Surfacing. All open off-street parking spaces and access drives serving more than four parking spaces in all districts except A, R-R, R-1 and R-2 districts shall be concrete or asphalt surface. All materials and method of installation of any surfacing shall meet city standards as approved by the City of Knox engineer.

3.

Screening, landscaping and barriers. All open off-street parking areas containing more than four parking spaces, located less than 40 feet from the nearest property line of a lot in a residential district, shall be effectively screened by a fence, or densely planted compact hedge from adjoining properties. There shall be installed a substantial barrier on or adjacent to the lot line along all open off-street parking spaces and such barrier shall be so located that no portion of any vehicle parked on the lot shall extend over the lot line.

4.

Lighting. All lighting used to illuminate off-street parking areas shall be directed away from residential properties in such a way as not to create a nuisance.

5.

Overnight parking prohibited. Overnight parking of vehicles, including trailers, is prohibited in the commercial district unless approved by the board of zoning appeals.

6.

Use of parking areas for permitted principal use activities. No portion of the parking area necessary to meet the terms of this ordinance may be used for activities allowed as permitted principal uses in the district.

H.

Location. All parking spaces required to serve buildings or uses erected or established after the effective date of this ordinance shall be located on the same lot as the building or use served. Buildings or uses in any district except single-family and two-family dwellings existing on the effective date of this ordinance which are subsequently altered or enlarged so as to require the provision of parking spaces under this ordinance and new uses established in any commercial district may be served by parking facilities located on land other than the lot on which the building or use served is located, provided such facilities are within reasonable walking distance of a main entrance to the use served.

I.

Employee parking. Parking spaces required on an employee basis shall be based on the maximum number of employees on duty or residing, or both, on the premises at any time.

J.

Required spaces. The minimum number of off-street parking spaces accessory to designated uses shall be provided as follows:

1.

Dwelling and lodging uses.

A.

Motels, bed and breakfast operations, boarding or rooming houses: Two parking spaces plus one parking space for each lodging room. In lieu of the required two parking spaces for permanent living units (such as a bed and breakfast operation), one parking space is required for each living unit plus one parking space for each lodging room.

B.

Hotels and apartment hotels: One parking space for each separate lodging room and one parking space for each dwelling unit.

C.

Multiple-family dwellings: One and one-half parking spaces for each dwelling unit.

D.

Single-family dwellings: Two parking spaces for each dwelling unit.

E.

Two-family dwellings: One and one-half parking spaces per dwelling unit.

2.

School, institution, auditorium, or other places of assembly uses.

A.

Churches: One parking space for each three seats used for the principal church service.

B.

Colleges, junior colleges, and universities: One parking space for each six students, based upon the maximum number of students that can be accommodated in accordance with design capacity.

C.

Nursing homes, and other care facilities: One parking space for each three beds plus one parking space for each employee working on-premises.

D.

Gymnasiums, stadiums, and grandstands: One parking space for each three seats.

E.

Hospitals: One parking space for each two hospital beds, plus one parking space for each employee working on premises, plus one parking space for each doctor assigned to the staff.

F.

Libraries and museums: One parking space for each 800 square feet of floor area.

G.

Medical and dental clinics: Three parking spaces for each examining and treatment room plus one parking space for each doctor and employee in the building.

H.

Meeting halls, convention halls and exhibition halls: The number of parking spaces equal to 50 percent of the maximum number of people that can be accommodated in accordance with such design capacity.

I.

Private clubs and lodges: One parking space for each lodging room and one parking space for each three seats in accordance with design seating capacity of the main meeting room.

J.

Schools - commercial or trade; and music, dance, or business: One parking space for each five students, based on the maximum number of students that can be accommodated in accordance with such design capacity, plus one parking space for each employee working on-premises.

K.

Schools, public or private high schools: One parking space for each two students based on the maximum number of students that can be accommodated in accordance with such design capacity of the building, plus one parking space for each employee working on-premises.

L.

School auditoriums and other uses: One parking space for each person working on-premises, and one additional parking space for each three seats.

M.

Schools, public or private - including nursery, elementary or junior high: One parking space for each employee working on premises.

3.

Recreational uses—Commercial or noncommercial.

A.

Bowling alleys: Seven parking spaces for each lane plus such additional spaces as may be required herein for affiliated uses such as restaurants and the like.

B.

Gymnasiums, health clubs, swimming pools, skating rinks, and dance halls, commercial: The number of parking spaces equal to 50 percent of the maximum number of people that can be accommodated in accordance with such design capacity.

C.

Parks, recreation areas or community centers - private, semipublic, or public: One parking space for each two employees, plus spaces in adequate number as determined by the plan commission to serve the visiting public.

4.

Commercial and manufacturing uses.

A.

All business, commercial and service establishments, except those specified hereafter: One parking space for each 250 square feet of floor area.

B.

Car washes: One parking space for each two employees, plus one space for the owner or manager, and in addition, reservoir parking spaces to accommodate vehicles awaiting entrance to the car wash equal in number to seven times the maximum capacity of the car wash. Parking spaces and reservoir parking areas shall be approved by the plan commission as part of the site plan and such areas shall be marked on the pavement of the car wash facility. Maximum capacity, in this instance, shall mean the greatest possible number of automobiles undergoing some phase of laundering at the same time.

C.

Automobile service and repair facilities: One parking space for each employee, plus two for each service stall.

D.

Banks: One parking space for each 400 square feet of floor area.

E.

Business, professional and public administration or service office buildings: One parking space for each two persons employed based upon the designed maximum employee capacity of the building.

F.

Cartage, express, parcel delivery and freight terminal establishments: One parking space for each employee employed on the premises, and 1½ parking space(s) for each vehicle maintained on the premises.

G.

Drive-up/in businesses and other commercial establishments: Reservoir parking spaces equal in number to 15 percent of the number of vehicle spaces used for serving customers.

H.

Establishments handling the sale and consumption on the premises of food and refreshment: One parking space for each 150 square feet of floor area.

I.

Furniture and appliance stores, sales, wholesale stores, stores for repair of household equipment or furniture: One parking space for each 400 square feet of floor area.

J.

Motor vehicle sales facilities: One parking space for each ten vehicles displayed for sale plus one parking space for each person working on the premises.

K.

Manufacturing establishments and establishments engaged in production, processing, assembly, disassembly, cleaning, servicing, testing or repairing of materials, goods or products: One parking space for each two employees or one parking space for each 1,200 square feet of floor area - whichever requires the greater number of parking spaces.

L.

Theaters: One parking space for each four seats up to 400 seats, plus one parking space for each six seats over 400.

M.

Theaters (automobile drive-in): Reservoir parking spaces equal in number to ten percent of the vehicle capacity of the theater.

N.

Undertaking establishments and funeral parlors: The number of parking spaces equal to 50 percent of the maximum number of people that can be accommodated in accordance with such design capacity.

O.

Warehouse, storage, wholesale and mail order establishments: One parking space for each employee and one parking space for each vehicle maintained on the premises.

5.

Miscellaneous uses.

A.

Planned unit developments: The number of parking spaces in accordance with the required space for each individual use.

B.

Public utility and public service uses: One parking space for each two employees, plus spaces in adequate number as determined by the plan commission to serve the visiting public.

6.

Other uses. Parking spaces for other permitted or special uses not listed above shall be provided in accordance with requirements designated by the plan commission.

Section 5. - Off-street loading.

A.

Location. All required loading spaces shall be located on the same lot as the use served. All motor vehicle loading spaces which abut a residential district in intervening alley separating a residential district from a commercial or manufacturing district shall be screened therefrom. No permitted or required loading space shall be located within 40 feet of the nearest point of intersection of any two streets. No loading space shall be located in the required front or side yard, and any loading space located in a required rear yard shall be open to the sky.

B.

Requirements for location. All loading docks shall be designed with appropriate means of vehicular access to a street or alley in a manner which will not interfere with traffic movement.

C.

Design. All loading docks shall be designed with an appropriate means of vehicular access to a street or alley in a manner which will not interfere with traffic movement.

D.

Area. Unless otherwise specified, a required off-street loading space shall be at least 12 feet in width by at least 50 feet in length, exclusive of aisle and maneuvering space, and enclosed loading spaces shall have a vertical clearance of at least 14 feet.

E.

Access. Each required off-street loading space shall be designed with appropriate means of vehicular access to a street or alley in a manner which will not interfere with traffic movement.

F.

Surfacing and drainage. All open off-street loading spaces shall be improved with water drainage facilities and pavement surfacing in accordance with City of Knox specifications, as approved by the city engineer.

G.

Repair and service. No motor vehicle repair work or service of any kind shall be permitted in conjunction with loading facilities.

H.

Utilization. Space allocated to any off-street loading space shall not, while so allocated, be used to satisfy the space requirements for any off-street parking facilities or portions thereof.

I.

Minimum facilities. Uses for which off-street loading facilities are required herein but which are located in buildings of less floor area than the minimum prescribed for such required facilities, shall be provided with adequate receiving facilities, accessible by motor vehicle, off any adjacent alley, service drive or open space on the same lot.

J.

Off-street loading space requirements. On the same premises with every building, structure or part thereof, hereafter erected, established or enlarged and occupied in the M-1 or M-2 industrial (manufacturing) districts involving the receipt or distribution by vehicles of material or merchandise, there shall be provided and maintained adequate space for standing, loading, and unloading in order to avoid undue interference with public use of streets or alleys.

One loading space shall be required for every 20,000 square feet or fraction thereof in excess of 3,000 square feet of floor area. These requirements may, upon appeal, be increased, modified or waived by the board of zoning appeals where the conditions or circumstances justify such action.
