LAND USE CATEGORY B-1 No Minimum yard or lot areas shall be required in the B-1 District except as follows:
a. When existing buildings located on each side of a proposed new building have established a building line, the new building shall conform to that line.
b. When lots in this District are adjacent to and adjoining a Residential District, those lots shall have a minimum yard of 10 feet on the side or sides adjacent to the Residential District.

Section 29-51. - O-1 District designated.

To add to this article a new section designated as Section 18-21-10 to be known as O-1 District-Office.

The permitted uses of said District shall be as follows: Offices of health service practitioners including physicians, surgeons, dentists, dental surgeons, osteopathic physicians, chiropractors, and other licensed health service practitioners; attorneys' offices; accounting, auditing and bookkeeping offices; engineering and architectural offices; banking, financial institutions, real estate and insurance offices; cosmetologists, single-family residence; governmental building (excluding garage and storage); business sign and incidental or accessory sign as defined in the ordinance from which this section was derived.

Said district shall have the following conditional uses: (1) Personal care homes; (2) public utility stations; and (3) veterinary clinics for small pet animals with no outdoor kennels permitted.

These regulations shall apply to property within the O-1 District. There shall be no outward change to a primary structure unless expanded using the same period architectural design as the existing structure. If the primary structure is damaged or destroyed, it must be rebuilt to a similar exterior architectural design as the pre-existing structure or the building structure removed and the lot cleaned up within ninety (90) days. Primary structures within this District may not exist in disrepair for more than ninety (90) days. The exterior architectural design of any structure built on a lot that has been vacant for more than twelve (12) months shall be similar to the exterior residential architectural design of other primary structures located in the O-1 District.

The front yard setback area must remain a yard (i.e., no parking lot or accessory uses). All existing trees of trunk size eight (8) inches (measured at five (5) feet height from ground level) and larger shall be protected and shall not be removed unless approved by the Zoning Board of Appeals unless the tree is determined to be dead or dying by the Building Official.

Pylon or monument business signs are the only types of signage allowed and only one (1) sign is permitted per lot. The sign shall be a maximum of forty (40) square feet in size with a maximum height of six (6) feet including the frame. The sign must cover all businesses located on the lot. The sign may be internally lit or have spot/flood lighting directed at the sign only. There shall be no signs with flashing lights, blinking lights, rotating lights, scrolling lights or any other lights. Additionally, there shall be no portable signs. All signs shall be maintained in good condition by the owner of the property. All other signs are prohibited. All signs must be approved and permitted by the City. No signs may obstruct the vision of street traffic as determined by the City law enforcement or code enforcement personnel.

Accessory uses or buildings are allowed only in the side and rear yards and no combustible structure shall be located within ten (10) feet of the primary structure, and shall be at least three (3) feet from the property line.

The lot criteria for the O-1 District are as follows:

(a)

Area square feet—8,000.

(b)

Width—75 feet.

(c)

The maximum lot coverage as a percent of total lot shall be forty (40) percent for all purposes except single-family dwellings, with single-family dwellings to be twenty-five (25) percent maximum. The maximum building height (stories) shall be two and one-half (2½) stories.

The minimum yard dimensions are as follows:

(a)

Front yard—35 feet along each street frontage.

(b)

Side yard—10 feet.

(c)

Rear yard—35 feet.

The hereinafter described property is hereby rezoned from R-1 District to O-1 District, to-wit:

Those portions of the lots presently zoned R-1, which are outlined in red on the map which is attached hereto, which front on each side of North Main Street located between Hendrix Street and an extension of the same in a westerly direction on the north and Park Street and an extension of same in an easterly direction on the south, the same being outlined in red on a copy of the zoning map which is attached hereto and incorporated herein by reference.

The hereinafter described property is hereby rezoned from R-2 District to O-1 District and the official zoning map of said city shall be changed accordingly, to-wit:

Those portions of the lots presently zoned R-2, which are outlined in green on the map which is attached, hereto which front on each side of North Main Street which lie north of Hammond Street and South of Hendrix Street and an extension of same in a westerly direction, said property being outlined in green on a copy of the zoning map which is attached hereto and incorporated herein by reference.

Section 29-52. - UGC District designated.

To add to this article a new section designated as Section 29-52 to be known as UGC District-Urban General Commercial.

The permitted uses of said District shall be as follows: Multi-family dwellings; Offices; Retail (less than five thousand (5,000) square feet); Churches; Hotel; Dwellings, Upstairs; Public Schools; and Restaurants.

Said district shall have the following conditional uses: (1) Farmer's Market; (2) Retail (more than five thousand (5,000) square feet); and (3) Auto-Oriented uses, which are uses heavily influenced by and primarily dependent on the automobile for viability, including, but not limited to the following examples: Gas Stations, Service Stations, Convenience Stores, Drive-Throughs, Drive-Ins, Auto Dealerships, Auto Repair/Detailing Shops, wrecker services, car storage, and Car Washes.

A mixture of permitted and/or conditional uses can be combined in a single building.

These regulations shall apply to property within the UGC District:

(1)

Sidewalks shall be provided along all street frontages.

(2}

Loading areas, material handling areas, and waste containers shall be located, screened or enclosed so that they are not visible from streets, sidewalks and other public areas. The design of such facilities shall be approved by the Building Official.

(3)

A buffer requirement of no less than twenty (20) feet shall apply only where adjacent properties are zoned R-1 or R-2. No other buffer shall be required.

(4)

Primary pedestrian entrance must face primary street.

(5)

New Construction must have a zero (0) foot min and max setback for primary building on the primary street.

The lot criteria for the UGC District is as follows:

(a)

Area square feet—none.

(b)

Width—twenty-five (25) feet.

(c)

The maximum lot coverage as a percent of total lot shall be fifty (50) percent.

(d)

The maximum building height (stories) shall be three (3) stories, except for Hotels which may be four (4) stories.

(e)

The lot criteria specified in this Section shall apply to all uses, unless otherwise specified, except for Churches and Farmer's Markets which are not subject to the above-stated lot criteria.

The minimum yard dimensions are as follows:

(a)

Front yard-zero feet minimum and maximum.

(b)

Side yard-zero feet minimum unless the adjacent property is zoned as R-1 or R-2, in which case a minimum buffer of twenty (20) feet is required.

(c)

Rear yard-zero feet minimum unless the adjacent property is zoned as R-1 or R-2, in which case a minimum buffer of twenty (20) feet is required.
