ARTICLE VII

ADMINISTRATION, ENFORCEMENT AND PENALTIES

Section 29-70.- Enforcement officer.

The provisions of this Chapter shall be administered and enforced by the Building Inspector. This official shall have the right to enter upon any premises at any reasonable time for the purpose of making inspections of buildings on premises necessary to carry out his duties in the enforcement of this Chapter.

If the Building Inspector shall find that any of the provisions of this Chapter area [are] being violated, he shall notify in writing the person responsible for such violations, indicating the nature of the violation and ordering the action necessary to correct it. He shall order discontinuance of illegal use of land, buildings, or structures; removal of illegal buildings or structures or of additions, alterations, or structural changes thereto; discontinuance of any illegal work being done; or shall take any other action authorized by this Chapter to ensure compliance with or to prevent violation of its provisions.

Section 29-71. - Building permits.

It shall be unlawful to commence the excavation for or the construction of any building or other structure, or to store building materials or erect temporary field offices, or to commence the moving, alteration, or repair (except repairs consisting only of painting or wallpapering) of a principal building until the Building Inspector has issued for such work a building permit including a statement that the plans and intended use of such structure in all respects conform with the provisions of this Chapter. Application for a building permit shall be made to the Building Inspector on forms provided for that purpose.

Section 29-72. - Application for building permits.

It shall be unlawful for the Building Inspector to issue a building permit for any excavation or construction until he has inspected the required information on such excavation or construction. The applicant shall submit two copies of a dimensioned sketch or scale plan signed by the owner or his authorized agent indicating the shape, size, and location of the lot to be built upon, the shape, size, use and location of the buildings to be erected, demolished, altered, or moved, and of any existing buildings on the lot, the number of dwelling units the buildings [building] is designed to accommodate, if any, setback lines of the buildings on adjoining lots, and such other information concerning the lot or adjoining lots as may be essential for determining whether the provisions of this Chapter are being observed.

Section 29-73. - Time limitations for building permits.

Any building permit issued shall become invalid unless the work authorized by it shall have been commenced within six (6) months of its date of issue, or if the work authorized by it is suspended or abandoned for a period of six (6) months.

Section 29-74. - Certificate of occupancy required.

No land or building or other structure or part thereof hereafter erected, moved, or altered in its use shall be used or occupied until stating that such land or building or part thereof is found to be in conformity with the provisions of this Chapter.

Within three (3) days after the owner of [or] his agent has notified the Building Inspector that a building or premises or part thereof is ready for occupancy or use, it shall be the duty of the Building Inspector to make a final inspection thereof, and to issue a Certificate of Occupancy if the building and premises are found to conform with the provisions of this Chapter; or if such certificate is refused, to state the refusal in writing with the cause.

Section 29-75. - Penalties for violation.

Any person, firm, or corporation violating any provision of this Chapter shall be guilty of a misdemeanor, and upon conviction shall be punished for each offense according to law. Each day such violation continues shall be deemed a separate offense.

Section 29-76. - Remedies.

In case any building is erected, constructed, reconstructed, altered, repaired, converted, or maintained, or any building or land is used in violation of this Chapter, the Building Inspector or any other appropriate city authority or any adjacent or neighboring property owner who would be damaged by such violation, in addition to other remedies, may institute an injunction, mandamus, or other appropriate action in proceeding to prevent the violation in the case of each such building or use of land.
