SEPARATION DISTANCE REQUIREMENTS FOR CERTAIN NEW DEVELOPMENTS IN THE AGRICULTURAL AREAS AS DELINEATED ON THE LINN COUNTY LAND USE MAP

   upon Chapter 65 of the state

2. The purpose of applying these
   distance separations is to ensure
   that existing animal confinement
   operations are not negatively
   impacted and to address the
   incompatibility and health issues
   of non-agricultural development
   in proximity to animal feeding
   operations.

3. These distance separation
   requirements do not apply to
   pre-existing residential
   structures already located
   within the proposed
   development area or for legal
   lots of record.

4. Distance separations will be
   calculated based on the nearest
   points of the edge of the
   proposed development area
   and the lagoon, manure
   storage facility or confinement
   building etc.

5. These distance requirements
   do not apply to animal feeding
   operation structures which
   store manure exclusively in a
   dry form. For example, many
   poultry operations produce dry
   manure.
