CHAPTER 13

OFF STREET PARKING

5-13-1: GENERAL:

The Village’s regulations relating to off street parking are listed below. When this Ordinance refers to Off Street Parking, it is referring to this Chapter. (Ord. 2021-4931, 11-15-2021)

5-13-2: PURPOSES:

   (A)   The regulations of this Chapter are intended to:
      1.   Ensure provision of off-street motor vehicle parking facilities, bicycle parking and other transportation circulation facilities in rough proportion to the generalized demands of different land uses.
      2.   Avoid the negative impacts associated with spillover parking into adjacent areas.
      3.   Avoid the negative environmental and visual impacts that can result from unnecessarily large parking and vehicular use areas.
      4.   Protect the public health, safety and general welfare.
      5.   Enhance safety and convenience for non-motorized travel.
      6.   Providing flexible methods of responding to the transportation and access demands of various land uses in different areas of the Village. (Ord. 2021-4931, 11-15-2021)

5-13-3: SCOPE AND APPLICABILITY:

The provisions of this Chapter shall apply as follows.
   (A)   General. Unless otherwise stated, the regulations of this Chapter apply to all zoning districts and all uses.
   (B)   Scope of Regulations:
      1.   The regulations of this Chapter apply to all buildings and structures erected and all uses of land established after the effective date of this Zoning Ordinance.
      2.   Increase in Intensity of Use: When the intensity of use of any building, structure, or parcel of land is increased by the addition of dwelling units, gross floor area, design capacity, employees, or other units of measurement specified herein for required off street parking facilities, off street parking shall be provided for such increase in intensity of use. In the case of increase in intensity of use, additional spaces are required only to serve the enlarged or expanded area, not the entire building or use. In other words, there is no requirement to address lawfully existing parking space deficits.
      3.   Decrease in Intensity of Use: When the intensity of use of any building, structure, or parcel of land is decreased by the reduction of dwelling units, gross floor area, design capacity, employees, or other units of measurement specified herein for required off street parking facilities, and further, when the decrease would result in a requirement for fewer total off street parking spaces, off street parking facilities may be reduced accordingly, provided that existing off street parking facilities shall be so decreased only when the facilities remaining will at least equal or exceed the off street parking requirements resulting from application of the standards of this Chapter to the use of the entire building, structure, or parcel of land as modified.
      4.   Change of Use: Whenever the existing use of a building, structure, or parcel of land is hereafter changed to a new use, off street parking facilities as required herein shall be provided for such new use.
   (C)   Time of Construction of Off Street Parking Facilities:
      1.   Off street parking facilities, as required by this Chapter, shall be constructed at the time of erection, establishment, alteration, or enlargement of the building, structure, or use of land they are required to serve. Occupancy or use shall not be established until the required parking facilities have been installed. (Ord. 2021-4931, 11-15-2021)

5-13-4: CALCULATION OF REQUIRED PARKING:

The following rules apply when calculating the required number of off-street parking spaces:
   (A)   Multiple Uses:
      1.   Unless otherwise expressly allowed in accordance with the shared parking regulations of this Chapter, lots containing more than one use must provide parking in an amount equal to the sum total of the requirements for all uses that occupy the lot.
   (B)   Fractions
      1.   When measurements of the number of required spaces result in a fractional number, any fraction of less than one-half (0.5) is rounded down to the next whole number, and any fraction of one-half (0.5) or more is rounded up to the next whole number.
   (C)   Area Measurements
      1.   Unless otherwise expressly stated, all area-based (square footage) parking standards must be computed based on the sum of the gross floor area of a building devoted to a use requiring off-street parking.
      2.   The following areas shall not be included in the sum of gross floor area for the purpose of calculating off-street parking requirements:
         (a)   Floor space devoted primarily to the housing of mechanical or electrical equipment.
         (b)   Elevator shafts and stairwells,
         (c)   Commercial kitchen areas, ramps, aisles, and maneuvering space devoted to off-street parking or loading facilities.
         (d)   Basement floor space used exclusively for storage activities.
         (e)   Storage areas, or areas used for incidental repair, processing or packaging of merchandise.
         (f)   Show windows.
         (g)   Toilet or rest room areas.
         (h)    Dressing rooms, fitting or alteration rooms.
   (D)   Occupancy Based Standards
      1.   For the purpose of computing off-street parking requirements based on occupancy, calculations must be based on the occupant load factor established by the Village’s adopted building codes.
   (E)   Seating Based Standards
      1.   A seat is the space intended for a single individual. In places where patrons or spectators occupy benches, pews, or other similar seating arrangements, each 20 linear inches of such seating is counted as one seat. In places without fixed seating, each 8 square feet of seating floor area is counted as one seat.
   (F).   Employees
      1.   For the purpose of computing requirements based on number of employees, calculations shall be based on the average number of persons working on any single shift.
   (G)   Unlisted Uses
      1.   Upon receiving an application for a use not specifically listed in the off-street parking schedule, the Zoning Administrator is authorized to apply the off-street parking ratio specified for the listed use that is deemed most similar to the proposed use or to establish a minimum off-street parking requirement for the proposed use in accordance this Chapter.
   (H)   Establishment of Other Parking Ratios
      1.   The Zoning Administrator is authorized to establish required minimum off street parking ratios in those instances where authority to establish a requirement is expressly granted. Such ratios may be established on the basis of a similar use/parking determination, on parking data provided by the applicant, or information otherwise available to the Zoning Administrator.
         (a)   Parking data and studies must include estimates of parking demand based on reliable data collected from comparable uses or on external data from credible research organizations (e.g., Institute of Transportation Engineers (ITE) or American Planning Association (APA)).
      2.   Comparability will be determined by density, scale, bulk, area, type of activity and location. Parking studies must document the source of all data used to develop recommended requirements.
   (I)   Accessible Parking for People With Disabilities:
      1.   Parking provided in accordance with Illinois Accessibility Code shall count towards the total number of parking spaces required. (Ord. 2021-4931, 11-15-2021; amd. Ord. 2023-5042, 12-18-2023)

5-13-5: SCHEDULE OF OFF STREET PARKING REQUIREMENTS:

   (A)   Minimum Requirements: Except as otherwise expressly stated, off-street parking spaces must be provided in accordance with the following table:
RESIDENTIAL
Detached House
2 parking spaces per each dwelling unit; plus .25 guest parking spaces per each dwelling unit within a duplex, townhouse, or multi-unit building located within a development.
Duplex
Reductions to the required off-street guest parking spaces shall be considered on a case-by-case basis, The Zoning Administrator is authorized to administratively grant a 25% reduction, if warranted by the following:
Townhouse
a. Provision of off-street parking per unit which exceeds the 2 spaces per unit required by Code; or
Multi-Unit
b. Other unique characteristics of the development which warrant a reduced level of guest parking.

5-13-6: PARKING EXEMPTIONS AND CREDITS:

   (A)   On-Street Parking
      1.   In the B-3A zoning district, nonresidential uses may count on-street parking spaces on public street rights-of-way abutting the subject property towards satisfying off-street parking requirements. One off-street parking space credit may be taken for each on-street parking space which is directly contiguous to and which lies wholly within the frontage of the lot lines of the use. In calculating credit for on-street parking, all fractional spaces are rounded down.
   (B)   B-3A (Central Retail Core) District
      1.   Minimum off-street parking requirements do not apply in the B-3A zoning district, except as follows:
         (a)   All household living uses and medical offices are required to comply with the minimum off-street parking requirements as regulated by this Chapter.
         (b)   Any nonresidential uses requiring a special use permit may be required to provide off-street parking as a condition of approval.
   (C)   Shared Parking
      1.   General
         (a)   Shared parking refers to the practice of 2 or more users who have need for parking at different times voluntarily agreeing to make use of the same motor vehicle parking spaces.
      2.   Approval
         (a)   The Zoning Administrator is authorized to approve shared parking arrangements among property owners who propose shared parking.
      3.   Eligibility
         (a)   Shared parking may be approved for nonresidential uses that have different periods of parking demand.
         (b)   Required residential parking and accessible parking spaces may not be shared, provided that this provision is not intended to prohibit shared driveways serving such uses.
      4.   Agreement
         (a)   An agreement providing for the shared use of parking areas, executed by the parties involved, must be filed with the Zoning Administrator in a form approved by the Village Attorney and recorded with the DuPage County Recorder of Deeds.
         (b)   Shared parking agreements are binding upon applicants, their successors and assigns. Amendments to parking agreements require Zoning Administrator approval, based on whether the proposed amendment complies with all applicable zoning ordinance provisions.
         (c)   Off-site parking privileges remain in effect only as long as the agreement, binding on all parties, remains in force. If an off-site parking agreement lapses or is no longer valid, then parking must be provided as otherwise required by this Chapter. (Ord. 2021-4931, 11-15-2021)

5-13-7: BICYCLE PARKING:

   (A)   Spaces Required
      1.   Bicycle parking spaces shall be provided in an amount equal to not less than 5% of the required number of motor vehicle parking spaces.
   (B)   Location
      1.   Required bicycle parking must be located in highly visible areas that do not interfere with pedestrian movements.
      2.   At least 50% of required bicycle parking spaces must be located within 100 feet of a customer entrance, with the remainder located no more than 300 feet from any entrance.
      3.   Bicycle parking must be located on the subject lot, unless an encroachment license agreement has been approved by the Village to allow private bicycle parking facilities to be located in the right-of-way.
      4.   Public bicycle parking spaces may be credited toward meeting bicycle parking requirements if such bicycle parking spaces comply with the location requirements of this paragraph.
   (C)   Design
All required short-term and long-term bicycle parking spaces must:
      1.   Consist of bike racks or lockers that are anchored so that they cannot be easily removed;
      2.   Resistant to rust, corrosion, hammers, and saws;
      3.   Allow both the bicycle frame and the wheels to be locked with the bicycle in an upright position;
      4.   Be designed so as not to cause damage to the bicycle;
      5.   Facilitate easy locking without interference from or to adjacent bicycles. (Ord. 2021-4931, 11-15-2021)

5-13-8: OFF STREET PARKING FACILITIES:

   (A)   Design
      1.   Off street parking facilities are subject to the following dimensional requirements, except as required by Illinois Accessibility Code:

Note:   Dimensions shall be measured from the centerline of the stripe delineating the space.
      2.   Compact Cars. Off street parking facilities may be designed to allow up to a maximum of 10% of the total number of required off street parking spaces to be utilized by compact cars. Compact car off street parking spaces shall not be less than 8 feet by 16 feet.
      3.   Striping. In all parking facilities, striping consisting of parallel lines, four inches in width, must be provided for each parking space. Striping must be yellow or white.
      4.   Material. All parking facilities must be surfaced with concrete, asphalt, or other hard dustless surface. Gravel parking facilities are prohibited.
   (B)   Location
      1.   All off street parking spaces shall be located on the same lot as the building, structure or use of land served. Off street parking spaces may also be located on a lot abutting the lot on which the building, structure or use of land served is located, provided that said spaces are also within three hundred (300) feet walking distance of such building, structure, or use of land. Off-street parking spaces separated by a right-of-way shall not be included in this calculation. All off street parking spaces shall be located in the same zoning district as the building, structure, or use of land served. All off street parking spaces required to serve a detached house, duplex, or townhouse shall be located on the same lot as the residence.
   (C)   Setbacks of Off Street Parking Facilities
      1.   Off street parking facilities abutting a residential use shall be setback 10 feet from the common property line.
         (a)   Exceptions
            (1)   Off street parking facility setback requirements do not apply to off street parking facilities provided for detached houses, duplexes, or townhouses.
            (2)   Off street parking facilities in the O-R zoning district shall comply with the building setback requirements established in Chapter 4 of this Zoning Ordinance.
   (D)   Collective Off Street Parking Facilities
      1.   Off street parking facilities for separate uses may be provided collectively if the total number of spaces so provided is not less than the sum of the separate requirements governing the number of accessory off street spaces required in relation to the use served.
   (E)   Prohibited Use
      1.   Off-street parking spaces shall not be used for sale, repair, dismantling, or servicing of any vehicles, equipment, materials, or supplies. (Ord. 2021-4931, 11-15-2021; amd. Ord. 2023-5042, 12-18-2023)

5-13-9: OFF STREET LOADING:

   (A)   Required
      1.   Off-street vehicle loading and unloading areas must be provided for any new proposed public/civic, commercial or industrial use or expansion of such a use that would result in a building with a floor area of 20,000 square feet or more.
      2.   Off-street vehicle loading and unloading areas must be provided for any building containing 50 or more dwelling units.
   (B)   Location and Design
The following location and design regulations apply to all off-street loading facilities regardless of whether they are required to be provided by this Chapter.
      1.   Off-street loading facilities must be located on the same lot as the use served.
      2.   All loading areas adjacent to residential zoning districts must be screened from view of the residential zoning district.
      3.   Loading spaces shall not be located in a location which is visible from a public right-of-way.
      4.   All loading docks must have opaque doors which are to remain fully closed when loading operations are not underway.
      5.   Loading areas and access drives must be paved and maintained with concrete, asphalt, or similar material of sufficient thickness and consistency to support anticipated traffic volumes and weights.
      6.   Each off-street loading space must be designed to provide a safe means of vehicular access to a street or alley in a manner that will least interfere with traffic movement, as approved by the Zoning Administrator.
   (C)   Prohibited Use
      1.   Off-street loading facilities shall not be used for sale, repair, dismantling, or servicing of any vehicles, equipment, materials, or supplies. (Ord. 2021-4931, 11-15-2021)

5-13-10: LIMIT ON NUMBER OF MOTOR VEHICLES PARKED IN RESIDENTIAL DISTRICTS:

   (A)   No more than five vehicles owned or controlled by the owner or occupant of a dwelling unit shall be parked outside of an enclosed building in the R-1 R-2, R-3, and R-4 zoning districts. All motor vehicles parked outside of an enclosed building in these districts must be parked on a constructed driveway.
   (B)   No more than one commercial vehicle with a gross weight of no more than 8,000 pounds owned or controlled by the owner or occupant of a dwelling unit shall be parked outside of an enclosed building in the R-1, R-2, R-3, and R-4 zoning districts. All commercial vehicles parked outside of an enclosed building in these districts must be parked on a constructed driveway.
   (C)   No more than one recreational vehicle owned or controlled by the owner or occupant of the subject property shall be parked outside in the R-1, R-2, R-3, and R-4 zoning districts.
      1.   Recreational vehicles shall not be located in the required front street or side street setback of a property if they exceed 25 feet in length.
      2.   Recreational vehicles shall not be located closer than five feet to any rear property line and three feet to any side property line.
      3.   Recreational vehicles shall not block the public right of way and shall be set back at least three feet from any sidewalk and five feet from any street.
      4.   Prohibited Uses: No recreational vehicle shall be used for living purposes or to conduct business.
      5.   Notwithstanding anything in this section to the contrary, any recreational vehicle may be parked in a driveway on a residential lot two times per month for a period not to exceed 96 hours for the purpose of loading, unloading, maintenance or repairs of said vehicle. All major repairs shall be within an enclosed garage in residential areas. “Major repairs” shall be defined as repair work on a vehicle that needs a complete overhaul or substantial replacement of parts.
   (D)   The provisions of this chapter are cumulative. Recreational vehicles and commercial vehicles count towards the total vehicle limitation of five. (Ord. 2021-4931, 11-15-2021)
