CHAPTER 19

ADMINISTRATION AND ENFORCEMENT

5-19-1: VILLAGE BOARD:

The Village Board is responsible for establishing the regulations and procedures of this Zoning Ordinance, for confirming appointments to the Planning and Zoning Commission, and carrying out those specific decision-making duties assigned by this Zoning Ordinance. (Ord. 2021-4931, 11-15-2021)

5-19-2: PLANNING AND ZONING COMMISSION:

The Planning and Zoning Commission has those powers and duties expressly identified in this Zoning Ordinance and in Title 2 of the Lisle Village Code. (Ord. 2021-4931, 11-15-2021)

5-19-3: ZONING ADMINISTRATOR:

   (A)   General Powers and Duties
The Zoning Administrator has primary responsibility for administration of this Zoning Ordinance, including the following general powers and duties:
      1.   Authority to Enter. Where it is necessary to conduct an inspection to enforce provisions of this Zoning Ordinance, or where the Zoning Administrator has reasonable cause to believe that there exists in a structure or upon property a condition that is contrary to or in violation of this Zoning Ordinance, the Zoning Administrator or Village employee charged with the enforcement of this Zoning Ordinance is authorized to enter the structure or property at reasonable times to inspect or to perform the duties imposed by this Zoning Ordinance, provided that if such structure or property be occupied that credentials be presented to the occupant and entry be requested. If such structure or property is unoccupied, the Zoning Administrator shall first make a reasonable effort to locate the owner or other person having charge or control of the structure or property and request entry.
      2.   Ordering discontinuance of any illegal use of land or structures;
      3.   Ordering removal of illegal structures and additions or alterations thereto;
      4.   Ordering discontinuation of work being done in violation of this Zoning Ordinance;
      5.   Receiving and processing all applications for permits and development approvals under this Zoning Ordinance;
      6.   Providing technical assistance and support to the Village Board, staff, boards and commissions; and
      7.   Exercising other powers and performing other duties as specified or necessarily implied by the provisions of this Zoning Ordinance.
   (B)   Promulgation of Administrative Rules
The Zoning Administrator is authorized to render interpretations of this Zoning Ordinance and to adopt policies and procedures in order to clarify the application of provisions of this Zoning Ordinance. Such interpretations, policies, and procedures shall be compliant with the intent and purpose of this Zoning Ordinance. Such policies and procedures shall not have the effect of waiving requirements specifically provided for in this Zoning Ordinance. (Ord. 2021-4931, 11-15-2021)

5-19-4: VILLAGE CLERK:

The Village Clerk is responsible for:
   (A)   Maintaining copies of this Zoning Ordinance and signed ordinances with all attachments for reference by the public; and
   (B)   For receiving protest petitions and forwarding them to the Village Attorney for legal review and appropriate action. (Ord. 2021-4931, 11-15-2021)

5-19-5: VIOLATIONS, PENALTIES, AND ENFORCEMENT:

   (A)   Responsibility for enforcement. The Zoning Administrator has the primary responsibility of enforcing this Zoning Ordinance.
   (B)   Unless otherwise expressly allowed by this Zoning Ordinance, state law, or federal law, any violation of a provision of this Zoning Ordinance-including but not limited to all of the following- may be subject to the remedies and penalties provided for in this Zoning Ordinance and as established by Title 1, Chapter 20, of the Lisle Village Code.
      1.   To use land or structures in any way not consistent with the requirements of this Zoning Ordinance;
      2.   To erect a structure in any way not consistent with the requirements of this Zoning Ordinance;
      3.   To install or use a sign in any way not consistent with the requirements of this Zoning Ordinance;
      4.   To fail to maintain a sign in a safe, presentable, and good structural condition, including the failure to replace defective parts, painting, repainting, cleaning, and other acts required for sound maintenance and appearance of a sign;
      5.   To fail to remove any sign that advertises a business no longer conducted on the premises;
      6.   To engage in the use of a structure or land, the use or installation of a sign, or any other activity requiring one or more permits or approvals under this Zoning Ordinance without obtaining such required permits or approvals;
      7.   To engage in the use of a structure or land, the use or installation of a sign, or any other activity requiring one or more permits or approvals under this Zoning Ordinance in any way inconsistent with any such permit or approval or any conditions imposed on the permit or approval;
      8.   To violate the terms of any permit or approval granted under this Zoning Ordinance or any condition imposed on the permit or approval;
      9.   To obscure, obstruct or destroy any notice required to be posted or otherwise given under this Zoning Ordinance;
      10.   To violate any lawful order issued by any person or entity under this Zoning Ordinance; or
      11.   To continue any violation after receipt of notice of a violation.
   (C)   Continuing Violations
Each day that a violation remains uncorrected after receiving notice of the violation from the Village constitutes a separate violation of this Zoning Ordinance.
   (D)   Remedies and Enforcement Powers
The Village has all remedies and enforcement powers allowed by Illinois law, including the following:
      1.   Stop Work
With or without revoking permits, the Zoning Administrator may stop work on any structure on any land on which there is an uncorrected violation of a provision of this Zoning Ordinance or of a permit or other form of authorization issued under this Zoning Ordinance.
      2.   Injunctive Relief
The Village may seek an injunction or other equitable relief in court to stop any violation of this Zoning Ordinance or of a permit, certificate or other form of authorization granted under this Zoning Ordinance.
      3.   Confiscation of Signs on Public Property
Any temporary (not installed on concrete pier, footing, or foundation) sign installed or placed on public property, except in compliance with the regulations of this Zoning Ordinance is subject to confiscation. In addition to other remedies and penalties of this Chapter, the Village has the right to recover from the sign owner or person who placed the sign, the full costs of sign removal.
      4.   Abatement
The Village may seek a court order in the nature of mandamus, abatement, injunction or other action or proceeding to abate or remove a violation or to otherwise restore the premises in question to the condition in which they existed prior to the violation.
      5.   Cumulative Remedies
The remedies and enforcement powers established in this Zoning Ordinance are cumulative, and the Village may exercise them in any combination or order.
   (E)   Enforcement Procedures
      1.   Non-Emergency Matters
In the case of violations of this Zoning Ordinance that do not constitute an emergency or require immediate attention, the Zoning Administrator must give notice of the nature of the violation to the property owner or to any other person who is party to the agreement, or to any applicant for any relevant permit, after which the persons receiving notice have 21 days to correct the violation before further enforcement action may be taken. Notice must be given in person, by US Mail, or by posting notice on the premises. Notices of violation must state the nature of the violation and the time period for compliance and may state the corrective steps necessary and the nature of subsequent penalties and enforcement actions should the situation not be corrected.
