B2 CENTRAL

SHOPPING DISTRICT

§ 155.330 PURPOSE.

   The B2 Business District regulations are designed to accommodate prime retail trade activities of village wide and regional significance, located primarily within the core of the village’s downtown area. Regulations provide for a wide variety of related shopper type business establishments along with personal service and other complementary uses, characteristic of major shopping centers.

§ 155.331 PERMITTED USES.

   Permitted uses in the B2 Central Shopping District are:
   (A)   Any of the permitted uses in the B1 District;
   (B)   Art galleries;
   (C)   Automobile accessory stores when there are no driveways across the street or sidewalk into the principal or accessory building;
   (D)   Book and stationery stores;
   (E)   Business machine sales and service;
   (F)   China and glassware stores;
   (G)   Coin shops;
   (H)   Currency exchanges;
   (I)   Department stores;
   (J)   Dry goods stores;
   (K)   Fraternal, philanthropic and eleemosynary institutions;
   (L)   Frozen food stores, including locker rental in conjunction therewith;
   (M)   Furrier shops, including the incidental storage and conditioning of furs;
   (N)   Hotels, including dining and meeting rooms;
   (O)   Laboratories, medical, dental or optical;
   (P)   Libraries, public or private;
   (Q)   Mail order service stores;
   (R)   Office supply stores;
   (S)   Pawnshops;
   (T)   Picture framing;
   (U)   Radio and television broadcasting studios;
   (V)   Residential structures existing on the effective date of the ordinance codified in this chapter;
   (W)   Taverns;
   (X)   Ticket agencies and travel bureaus;
   (Y)   Tobacco shops;
   (Z)   Vending machines when located within an enclosed building; and
   (AA)   Accessory uses customarily incidental to the above permitted uses, including but not limited to the following: off-street parking; off-street loading; and awnings and marquees, as regulated by this chapter.

§ 155.332 CONDITIONAL PERMITTED USES.

   Conditional permitted uses in the B2 District are:
   (A)   Other uses similar to permitted uses in this district;
   (B)   Any of the conditional permitted uses in the B1 District;
   (C)   Automobile sales establishments only for authorized new passenger automobile sales agencies and accessory open sales lots and public garage, provided vehicular access to open sales lot and public garage is from an alley or service drive at the rear lot line;
   (D)   Catering establishments when located above the ground floor;
   (E)   Churches, temples and synagogues;
   (F)   Clubs or lodges, private, fraternal or religious when located above the first floor;
   (G)   Convents, monasteries, rectories or parsonages, as accessory to churches, temples and synagogues;
   (H)   Garages, storage or off-street parking lots or structures, commercial or municipal;
   (I)   Home center, retail lumberyards;
   (J)   Meeting halls when located above the ground floor;
   (K)   Newspaper offices and printing and publishing;
   (L)   Restaurants, including live entertainment and dancing;
   (M)   Restricted production and repair, limited to the following: needlework; clothing, such as custom manufacturing and alterations; jewelry from precious metals; watches; dentures; and optical lenses, when located above the ground floor;
   (N)   Schools, commercial or trade, including those teaching music, dancing, business, commercial, or technical subjects when operations do not involve danger of fire and explosion, and objectionable noise, vibration, smoke, dust, odor, glare, heat or other similar influences; and
   (O)   Adult-use cannabis dispensing organization; except that the number of adult-use cannabis dispensing organizations shall be limited to one within the corporate limits of the village. No on-premises consumption of cannabis shall be allowed for any adult-use cannabis dispensing organization;
   (P)   Medical cannabis dispensing organization; except that the number of medical cannabis dispensing organizations shall be limited to one within the corporate limits of the village; and
   (Q)   Accessory uses customarily incidental to the above conditional permitted uses, including but not limited to the following:
      (1)   Off-street parking;
      (2)   Off-street loading;
      (3)   Drive-in facilities; and
      (4)   Awnings and marquees are regulated by this chapter.

§ 155.333 BUILDING HEIGHT.

   There are no height limitations in the B2 District.

§ 155.334 FLOOR AREA RATIO.

   Floor area ratio in the B2 District shall not exceed 2.5, except where public open areas as described in this chapter are provided on the lot in excess of 10% of the area of the lot, the floor area ratio may be increased by 0.5 for each additional 5% of the lot reserved as public open area.

§ 155.335 YARDS AND OTHER OPEN AREAS.

   Yards and other open area requirements shall be:
   (A)   Front. No yard requirements;
   (B)   Side. No yard requirements; except if a yard is provided, it shall not be less than five feet in width;
   (C)   Rear. No yard requirements; except where the rear lot line adjoins a residence district, a rear yard not less than 25 feet in depth shall be provided, and be maintained as landscaped area; and
   (D)   Open areas. An area equivalent to 10% of the area of the lot shall be maintained as public open area. Such open area shall:
      (1)   Have frontage on all or a part of a lot line adjoining a street, but not less than ten feet along such frontage;
      (2)   Be unobstructed from the ground to the sky, except an open area having a depth of not greater than 25 feet in back of the lot line adjoining a street may be unobstructed from the ground to not less than the height of the floor of the second story of the building; and
      (3)   Be paved for pedestrian use or landscaped.

§ 155.336 AWNINGS, MARQUEES AND SIGNS.

   Awnings, marquees and signs shall be permitted and regulated as set forth in the B1 zoning regulations, and said regulations are hereby incorporated in total by reference.

§ 155.337 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading shall be in accordance with the regulations set forth in this chapter.
