§ 155.673 PLANNING AND ZONING BOARD; MEMBERSHIP; TERM.
The Village President shall appoint a Planning and Zoning Board consisting of seven members which shall be confirmed by a majority vote of the members of the Village Board present and voting thereon. The members appointed shall serve respectively for the following terms: one for one year, one for two years, one for three years, two for four years and two for five years. The successor to each member so appointed shall serve for a term of five years. One of the members so appointed shall be named as Chairperson at the time of his or her appointment by the Village President, and in case of vacancy, the Mayor shall designate a Chairperson who shall be confirmed by a majority vote of the Village Board present and voting thereon. The Village Board shall have the power to remove any member of the Planning and Zoning Board for cause by a majority vote of the members of the Village Board present and voting thereon. Vacancies on the Planning and Zoning Board shall be filled for the unexpired term of the member whose place has become vacant in the manner provided in this section for the appointment of such new member.
§ 155.674 PLANNING AND ZONING BOARD; JURISDICTION.
The Planning and Zoning Board is vested with the following jurisdiction and authority:
(A) To hear and decide an appeal from any order, requirements, decision or determination made by the Zoning Officer or other authorized official of the village having jurisdiction under this chapter;
(B) To hear application for variations from the terms provided in this chapter in the manner and subject to the standards set forth in this chapter;
(C) To hear and decide upon all matters referred to it or upon which it is required to pass under this chapter in accordance with applicable state statutes;
(D) Submit a recommendation to the Village Board on all requests for variations, zoning amendments and conditional permitted uses;
(E) Receive copies of all applications for amendments and for conditional permitted uses and hold public hearings thereon; and
(F) Initiate, direct and review, from time to time, a study of the provisions of the text and the map comprising this chapter, and make reports of its recommendations to the Village Board not less frequently than annually.

All meetings of the Planning and Zoning Board shall be held at the call of the Chairperson and at such times and places within the village as the Planning and Zoning Board may determine. All testimony by witnesses at any hearing provided for in this chapter shall be given under oath. The Chairperson, or in his or her absence, the acting Chairperson, may administer oaths and compel the attendance of witnesses. All meetings of the Planning and Zoning Board shall be open to the public. The Planning and Zoning Board shall keep minutes of its proceedings, showing the vote of each member upon every question, or if absent or failing to vote, indicating such fact, and shall also keep records of its examinations and other official actions. A majority of a quorum of the Planning and Zoning Board shall be necessary to reverse any order, requirement, decision or determination of the Zoning Officer to decide in favor of the application on any matter on which it is authorized by this chapter to render a decision. Every rule, regulation, every amendment or repeal thereof, and every order, requirement, decision or determination of the Planning and Zoning Board shall immediately be filed in the office of the Planning and Zoning Board and shall be a public record. In the performance of its duties, the Planning and Zoning Board may incur such expenditures as shall be authorized by the Village Board.
