B4 COMMERCIAL-RECREATION

DISTRICT

§ 155.370 PURPOSE; INTENT.

   The B4 Commercial-Recreation District regulations are intended to provide for the orderly, compatible development and operations of buildings and structures and the uses thereof or the uses of land where no buildings are involved for such specialized uses as will provide for maximum utilization of the recreation potential of lands adjoining suitable natural features.

§ 155.371 PERMITTED USES.

   Permitted uses in the B4 Commercial-Recreation District shall be as follows:
   (A)   Agriculture, provided on a tract of land not less than 20 acres in area;
   (B)   Clubs, lodges and fraternities which may have outdoor recreation facilities for boating, swimming, tennis, golf, skiing, fishing and similar activities; provided that buildings, other than detached buildings containing only dwelling units or lodging rooms, are not located nearer than 100 feet from a lot line; and further provided that the principal activity is not one carried on as a business;
   (C)   Clubhouses and facilities for equestrian sports; provided that buildings and seating facilities for spectators are not nearer than 100 feet from a lot line;
   (D)   Golf driving ranges, provided the clubhouse and maintenance buildings are located not less than 100 feet from a lot line and artificial lighting for night play installation is approved by the Village Board after receiving the recommendation of the Planning and Zoning Board;
   (E)   Hotels and motels;
   (F)   Resorts, which may contain the following uses set forth below:
      (1)   Dwelling units and lodging rooms for guests and employees of the resort;
      (2)   Indoor recreation facilities for use only by guests of the resort when located in the principal building or detached recreation building or clubhouse as follows: swimming pools, ice skating rinks, tennis courts, gymnasiums, theaters, bowling alleys and other indoor recreation facilities as approved by the Village Board after receiving the recommendation of the Planning and Zoning Board; and
      (3)   Outdoor recreation facilities, boating, swimming, fishing, ice skating, skiing, basketball, softball, volleyball, tennis courts, golf courses (standard, par 3, pitch and putt or miniature), theaters and other outdoor recreation facilities as approved by the Village Board after receiving the recommendation of the Planning and Zoning Board.
   (G)   Parks and playgrounds, public, including recreation building, bathing beaches and piers, and boat landing facilities;
   (H)   Riding academies, provided buildings for shelter of horses are located not less than 200 feet from a lot line;
   (I)   Schools, public, elementary, junior high or high; and
   (J)   Accessory uses including off-street parking and off-street loading and when accessory to hotels, motels, clubhouses, resorts and lodges and located within the principal buildings, such uses as restaurants with cocktail lounges, gift shops, beauty parlors and barbershops.

§ 155.372 CONDITIONAL PERMITTED USES.

   Conditional permitted uses in the B4 District shall be as follows:
   (A)   Amusement establishments, bowling alleys, billiard parlors, gymnasiums, swimming pools, ice skating rinks, miniature or pitch and putt golf courses, and clubs and recreation centers containing one or more of the above uses and other recreation uses as approved by the Village Board after receiving the recommendation of the Planning and Zoning Board;
   (B)   Marinas, private or semipublic, not less than 100 feet of frontage on a river or lake and including boat storage and incidental service facilities and clubhouses or recreation buildings which may include accessory uses as set forth herein under accessory uses to permitted uses in this district, on a lot not less than 40,000 square feet in area;
   (C)   Parks and playgrounds, private or semipublic, including recreation buildings, bathing beaching and piers on a tract of land not less than ten acres in area; and
   (D)   Schools, boarding or lodging, nursery, elementary, junior high or high on a tract of land not less than five acres in area for nursery, eight acres for elementary and 25 acres for junior high and high schools.

§ 155.373 LOT AREA.

   Except as may herein otherwise be required for a specific permitted or conditional permitted use, lot area shall not be less than five acres in area.

§ 155.374 LOT WIDTH.

   Lot width shall be not less than 200 feet in width, except as may be herein otherwise regulated for a specific permitted or conditional permitted use.

§ 155.375 BUILDING HEIGHT.

   There are no height limitations in the B4 District.

§ 155.376 FLOOR AREA RATIO.

   Floor area ratio in the B4 District shall not exceed 0.8.

§ 155.377 YARDS.

   Except as may be herein otherwise regulated for a specific permitted or conditional permitted use, yards shall be provided as follows:
   (A)   Front yard. Not less than 40 feet in depth;
   (B)   Side yards. Two side yards, neither of which is less than 20 feet in width, except a side yard adjoining a street, not less than 40 feet in width; and
   (C)   Rear yard. Not less than 50 feet in depth.

§ 155.378 AWNINGS, MARQUEES AND SIGNS.

   All marquees and signs shall be permitted and regulated as set forth in the B1 zoning regulations, and said regulations are hereby incorporated by reference.

§ 155.379 OFF-STREET PARKING AND LOADING.

   Off-street parking and off-street loading shall be in accordance with regulations set forth in this chapter.
