CHAPTER 19

34.- B-3 GENERAL RETAIL AND SERVICE COMMERCIAL DISTRICT REGULATIONS

Sec. 19.34.010.- Statement of intent.

(a)

The B-3 District is intended to provide for general retail and service commercial areas outside of the central business district. The uses permitted are intended to accommodate primarily the local and trade area retail consumer.

Sec. 19.34.020. - Principal permitted uses.

(a)

Only the use of structures or land listed in this section shall be permitted in the B-3 District:

(1)

Any use permitted and as limited in the B-2 District.

(2)

Retail business and service establishments, including, but not limited to, the following and similar uses as may be determined by the zoning administrator:

a.

Auction rooms.

b.

Exterminating shops.

c.

Gas station, garage for general motor vehicle repair.

d.

Laboratories (medical, dental, experimental and testing), provided that there is no production or manufacturing of products.

e.

Lawn mower repair shops.

f.

Locker plant for storage and retail sales only.

g.

Pawnshops.

h.

Parking garages and parking lots, both public and private.

i.

Pool halls and coin-operated amusement arcades.

j.

Radio and television broadcasting stations.

k.

Secondhand stores and rummage shops.

l.

Veterinary clinics (see definition).

Sec. 19.34.030. - Permitted accessory uses.

(a)

Accessory uses and structures customarily incidental to any principal permitted use, including accessory uses permitted in the R-3 and B-2 districts.

(b)

Storage of merchandise incidental to the principal use.

Sec. 19.34.040. - Bulk regulations.

(a)

The following minimum requirements shall be observed subject to the modifications contained in Section 19.02.100:

(1)

Lot area: Same as required in the B-2 District.

(2)

Lot area per dwelling unit: Same as required in the B-2 District.

(3)

Lot width: Same as required in the B-2 District.

(4)

Front yard: 25 feet.

(5)

Side yards: None required except when adjoining any "R" district or street right-of-way line, in which case, twenty-five (25) feet.

(6)

Rear yard: 25 feet; provided, however, that for every foot the front yard is increased over twenty-five (25) feet, the rear yard may be decreased in direct proportion thereto; but in no case shall the rear yard be less than ten (10) feet.

(7)

Maximum height: 45 feet.

(8)

Maximum number of stories: 3 stories.

Sec. 19.34.050. - Minimum open space.

(a)

The total land area devoted to open space and landscaping shall not be less than ten (10) percent of the gross land area included in the building lot.

(b)

Such open space shall be maintained as grassed and landscaped area and shall not include access drives, parking areas, structures or buildings except ornamental structures included as part of the landscaping theme.

Sec. 19.34.060. - Off-street parking and loading.

(a)

Spaces for off-street parking and loading shall be provided in accordance with the provisions of Chapter 19.06.

Sec. 19.34.070. - Site plans.

(a)

Site plans shall be required in accordance with the provisions of Chapter 19.12 for all uses permitted in this district.

Sec. 19.34.080. - Signs.

(a)

Signs shall be provided in accordance with the provisions of Chapter 19.09.

Sec. 19.34.090. - Minimum dimension regulation.

The minimum dimension of the main body of buildings containing any number of dwellings, and having as its only principal permitted use a residential use, shall not be less than twenty-four (24) feet.
