(A) A transmission or reception tower, as defined in §
151.05, may be sited and constructed within any industrial zoning district, provided that the following requirements shall be met, and further provided that the applicant shall provide the Village of Navarre Zoning Inspector with sufficient plans and drawings from which the Zoning Inspector may ascertain that the proposed tower meets the requirements of this §
151.54.
(B) The following are required with respect to the siting and construction of any transmission or reception tower within the Village of Navarre:
(1) All buildings, structures, and tower components must be surrounded by an eight-foot chain link fence, with an additional three strands of barb wire on top.
(2) Interior ground of all fenced areas will have a stone aggregate surface treated with an environmentally safe herbicide.
(3) The applicant shall furnish the Village Zoning Inspector with a copy of a liability insurance policy showing coverage limitations and volume of insurance that are deemed adequate, to protect the village and surrounding properties.
(4) The tower shall be lighted with standard FAA lighting. The tower is to be painted per FAA specifications with standard red beacon and obstruction lights. No strobe or similar high intensity lighting will be permitted.
(5) The operating frequency of cellular or other communication transmission from the tower shall have no effect on television, radio, or other reception within the village.
(6) The tower height shall not exceed 300 feet.
(7) The required setback distance from all adjacent property lines for any buildings, structures, or tower components, except for guy cable anchors, shall be one-half the height of the tower.
(8) They guy cable anchors shall be located at least ten feet from all adjacent property lines.
(9) Any applicant requesting permission to install a new tower shall provide evidence at the time of making the application of a written contact with all wireless service providers who supply service within a close proximity of the proposed facility. The applicant must inquire about potential co-location opportunities at all technically feasible locations. The written contact shall request written response from the other providers within 30 days. It is the responsibility of the applicant to present all written responses received to the Village Zoning Inspector or Village Board of Zoning Appeals as a means of demonstrating the need for a new tower.
(10) An applicant shall demonstrate that the new tower must be located where it is proposed in order to service the applicant’s, or its tenant’s, service area. There shall be a written explanation of why a tower in this proposed location is technically necessary.
(11) Any applicant requesting permission to install a new tower must allow the extent possible for other providers to co-locate on the proposed tower.
(12) No advertising will be permitted on the tower or any building, structure, or component associated with it. The tower shall be painted a non-contrasting grey or similar color minimizing its visibility unless otherwise required by the Federal Communications Commission, the Federal Aviation Commission, or any State of Ohio equivalent agency.
(13) The tower shall meet radio frequency emissions standards as established by the Federal Communications Commission.
(C) The Village Zoning Inspector may approve any application that meets all of the foregoing criteria, or may, in his or her sole good faith discretion, require the applicant to apply to the Board of Zoning Appeals for approval of a zoning certificate.
