CHAPTER 1262

R-12 Multifamily Residential Districts

1262.01 SIZE.

   An R-12 Multifamily Residential District shall contain a minimum of two acres.

1262.02 INTENT; DENSITY; FRONTAGE; UTILITIES.

   The intent of R-12 Multifamily Residential Districts is to encourage the establishment of multifamily residential uses not to exceed ten dwelling units per gross acre. All such Districts must abut upon a collector street, primary thoroughfare or secondary thoroughfare as specified in the Official Thoroughfare Plan and have centralized water and sewer facilities.

1262.03 PERMITTED USES.

   The following uses are permitted in an R-12 Multifamily Residential District:
   (a)   Two-family attached dwellings and multifamily dwellings;
   (b)   Churches and other places of worship, and schools and institutions for academic instruction; and
   (c)   Public parks and recreation sites.

1262.04 CONDITIONAL USES.

   The following uses may be permitted in an R-12 Multifamily Residential District only if expressly authorized by Council in accordance with Chapter 1284 and subject to limitations and restrictions deemed necessary by the Planning Board and/or Council:
   (a)   Private, noncommercial recreation areas and facilities such as recreation clubs, golf courses and country clubs;
   (b)   Structures and installations which are necessary public facilities and utilities and which require location in an R-12 District;
   (c)   Fraternal lodges and private clubs;
   (d)   Nursery schools and day care centers;
   (e)   Home occupations, as regulated in accordance with Section 1280.27; and
   (f)   Community gardens.

1262.05 PROHIBITED USES.

   No building or other structure in an R-12 Multifamily Residential District shall be used by a commercial or industrial establishment.

1262.06 ACCESSORY BUILDINGS AND USES.

   An accessory use or building or other structure customary and incidental to a use permitted in this chapter is permitted in an R-12 Multifamily Residential District, provided that such accessory use or building or other structure does not involve any type of business, trade, manufacturing or industry.

1262.07 LOTS.

   In no case shall the area of a multifamily zoning lot in an R-12 Multifamily Residential District be less than 3,600 square feet per dwelling unit. No such lot shall have a width less than eighty feet. Such lots are permitted only if they are served by group or central sewage treatment.

1262.08 YARDS.

   Yard requirements for an R-12 Multifamily Residential District are as follows:
   (a)   Front. There shall be a minimum depth of twenty-five feet.
   (b)   Side. There shall be a minimum width on either side of ten feet, with the combined width of both side yards not less than twenty-five feet.
   (c)   Rear. There shall be a minimum depth of twenty feet.

1262.09 COVERAGE OF LOT BY BUILDINGS.

   In an R-12 Multifamily Residential District, the principal and accessory buildings on a lot may occupy up to a maximum of forty percent thereof.

1262.10 FLOOR AREA.

   In an R-12 Multifamily Residential District, a one-bedroom dwelling shall have a minimum floor area of 750 feet. (Ord. 82-38. Passed 9-20-82.)

1262.11 BUILDING HEIGHT.

   In an R-12 Multifamily Residential District, no building shall exceed three stories, or thirty-six feet in height.

1262.12 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading in an R-12 Multifamily Residential District shall be provided for in accordance with Chapter 1292.
