CHAPTER 1266

OA Office-Apartment Districts

1266.01 SIZE.

   An OA Office-Apartment District shall contain a minimum of three and one-half acres.

1266.02 INTENT.

   The intent of OA Office-Apartment Districts is to make special provisions for appropriate apartment and limited office uses in selected locations, particularly along highways, which can serve as logical transition districts between single-family residential uses and areas of heavy traffic. OA Districts are also designed to act as buffers between various nonresidential uses and less dense residential uses, and thus are transitional uses.

1266.03 PERMITTED USES.

   The following uses are permitted in an OA Office-Apartment District:
   (a)   One-family, two-family and multifamily dwellings;
   (b)   Business and professional offices;
   (c)   Rest and nursing homes; and
   (d)   Public facilities.

1266.04 CONDITIONAL USES.

   The following uses are permitted in an OA Office-Apartment District only if expressly authorized by Council in accordance with Chapter 1284 and subject to limitations and restrictions deemed necessary by the Planning Board and/or Council:
   (a)   Fraternal lodges and private clubs;
   (b)   Nonresidential off-street parking;
   (c)   Funeral homes and mortuaries;
   (d)   Home occupations as regulated in accordance with Section 1280.27; and
   (e)   Community gardens.

1266.05 PROHIBITED USES.

   No building or other structure in an OA Office-Apartment District shall be used for an industrial or commercial use, except as otherwise specifically permitted in this Zoning Code.

1266.06 ACCESSORY BUILDINGS AND USES.

   An accessory use or building or other structure customary and incidental to a use permitted in this chapter is permitted in an OA Office-Apartment District.

1266.07 LOTS.

   No zoning lot less than 8,000 square feet, for a two-family or three-family dwelling, is permitted in an OA Office-Apartment District. An additional 2,000 square feet per unit for each additional dwelling unit is permitted in an OA Office-Apartment District. No such lot shall have a width less than sixty feet. Such lots shall be permitted only if they are serviced by group or central sewage treatment.

1266.08 YARDS.

   Yard requirements for an OA Office-Apartment District are as follows:
   (a)   Front. There shall be a minimum depth of fifteen feet.
   (b)   Side. There shall be a minimum width on either side of five feet, with the combined width of both side yards not less than fifteen feet.
   (c)   Rear. There shall be a minimum depth of five feet.

1266.09 COVERAGE OF LOT BY BUILDINGS.

   In an OA Office-Apartment District, the principal and accessory buildings on a lot may occupy up to a maximum of forty percent thereof.

1266.10 FLOOR AREA.

   In an OA Office-Apartment District, a one-bedroom dwelling shall have a minimum floor area of 600 square feet. A two-bedroom dwelling shall have a minimum floor area of 800 square feet. No dwelling shall have more than two bedrooms.

1266.11 BUILDING HEIGHT.

   In an OA Office-Apartment District, no building shall exceed three stories, or thirty- five feet in height.

1266.12 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading in an OA Office-Apartment District shall be provided for in accordance with Chapter 1292.
